Throughout the last two decades, various researchers have continuously examined the way that climate justice principles are integrated within national climate policies, paying most attention to the extent of their impact on specifically vulnerable populations. Climate justice, encompassing distributive, procedural, recognition, and restorative dimensions, has become one of the central ideals when it comes to global climate governance. Indigenous people manage significant global terrestrial surface while simultaneously guarding around 80% of the world's biodiversity (With methodological uncertainty), despite only comprising a small fraction of the global population.Their traditional ecological knowledge (TEK) supports essential climate solutions and helps in the adaptation and mitigation of greenhouse gas emissions. A significant depth of injustice, however, and security risk in the existing climate governance mechanisms is pronounced given that less than 1% of direct global climate finance is allocated to indigenous peoples. The climate emergency is deepening and needs urgent attention involving radical, binding, and multilateral measures. Ecocide is the large-scale and deliberate destruction of ecosystems which undermines human security, destabilizes the fragile states and increases geopolitical tensions. It has been contended in this policy brief that ecocide needs to be internationally criminalized pursuant to the Rome Statute of the International Criminal Court (ICC) to place environmental destruction firmly within the scope of global peace and security. This article presents the findings derived from the construction of an Index that evaluates the state of promotion of Civil Society Organizations (CSOs) across Mexico’s 32 federal entities during the year 2021. It also outlines the criteria considered in building the Index and the results obtained in each of its dimensions. The Index provides a comprehensive and multidimensional perspective on the study of CSO promotion, analyzing legal, institutional, and programmatic dimensions with the aim of comparing progress and setbacks in this area. Climate Justice Across Borders: Responding To Ecocide And Displacement, Camila Micheletti Flores

This policy paper examines how climate change accelerates cross-border displacement, especially in regions most vulnerable to ecocide and environmental degradation. Climate refugees remain unprotected under international law, as the 1951 Refugee Convention excludes environmental grounds for asylum, leaving populations exposed to human rights violations and securitized responses. It analyzes legal and institutional gaps, highlighting failures in global climate governance and the disproportionate risks faced by SIDS and other affected regions. The paper calls for COP30 to mandate a high-level UNFCCC forum on climate displacement and ecocide to build a just, cooperative, and rights-based international framework.

The climate emergency and the scale of environmental harm require moving beyond voluntary and overly localized approaches to establish binding legal mechanisms at the global level. Transnational corporations operating in high-impact ecological sectors must be held accountable for their actions — not only to remedy the damage caused, but also to prevent future violations. This policy paper examines the Climate justice, Ecocide and security implications of carbon market mechanisms for Indigenous Peoples (IPs). Despite global recognition of Indigenous people participation , existing frameworks under the UNFCCC and mechanisms often lack enforceable safeguards to protect Indigenous sovereignty. The paper identifies critical gaps in governance, particularly the absence of Indigenous-led oversight in Carbon markets. Drawing on two case studies: Yurok Tribe and Ogiek people, it demonstrates how carbon markets can reproduce neo-colonial patterns of resource appropriation. Addressing The Abuse Of Monopsony Power In Labor Markets: Examining Potential Public And Civil Law Remedies And Sanctions, Zofia M. Mazur

Although thousands of reported cases involve allegations of firms illegally forming cartels in product markets, relatively few deal with similar allegations in labor markets. Moreover, as observed in legal doctrine, labor markets tend to be more concentrated than product markets and, consequently, more susceptible to anticompetitive conducts by undertakings. The article, therefore, analyzes the so-called monopsony power in the labor market, which refers to any case where employers hold labor market power that allows them to unilaterally determine wages or to worsen working conditions by reducing employment.

การวิจัยนี้มีวัตถุประสงค์เพื่อศึกษาแนวทางการกำกับดูแลบริษัทโฮลดิ้งภายใต้พระราชบัญญัติการแข่งขันทางการค้า พ.ศ. 2560 โดยเปรียบเทียบกับกฎหมายและแนวปฏิบัติของต่างประเทศ เพื่อเสนอแนะแนวทางการปรับปรุงกฎหมายที่เหมาะสมสำหรับประเทศไทย การวิจัยใช้วิธีการศึกษาเชิงเอกสาร โดยวิเคราะห์เปรียบเทียบบทบัญญัติของกฎหมาย แนวปฏิบัติ และคำพิพากษาที่เกี่ยวข้องกับการกำกับดูแลบริษัทโฮลดิ้งตามกฎหมายการแข่งขันทางการค้าของสหรัฐอเมริกา สหภาพยุโรป และสาธารณรัฐเกาหลี ผลการศึกษาพบว่า กฎหมายการแข่งขันทางการค้าของไทยมีข้อจำกัดสำคัญในการกำกับดูแลบริษัทโฮลดิ้ง เนื่องจากนิยาม “ผู้ประกอบธุรกิจ” มีขอบเขตจำกัดเฉพาะผู้ที่ประกอบธุรกิจโดยตรง ทำให้ไม่ครอบคลุมถึงบริษัทโฮลดิ้งที่แม้จะมีอำนาจควบคุมบริษัทในเครือแต่มิได้ประกอบธุรกิจด้วยตนเอง ในขณะที่กฎหมายต่างประเทศมีการตีความอย่างกว้างให้ครอบคลุมถึงบริษัทที่มีอิทธิพลต่อการดำเนินธุรกิจของบริษัทอื่น หรือมีบทบัญญัติเฉพาะในการกำกับดูแลบริษัทโฮลดิ้ง การวิจัยนี้จึงเสนอให้แก้ไขนิยาม “ผู้ประกอบธุรกิจ” ให้ครอบคลุมถึงบริษัทที่มีอำนาจควบคุมหรือมีอิทธิพลอย่างมีนัยสำคัญต่อผู้ประกอบธุรกิจอื่น ปรับปรุงประกาศเกี่ยวกับหลักเกณฑ์การพิจารณาความสัมพันธ์ทางนโยบายหรืออำนาจสั่งการ และออกแนวปฏิบัติที่ชัดเจนในการพิจารณาอำนาจควบคุมและความรับผิดของบริษัทโฮลดิ้ง เพื่อให้การกำกับดูแลมีประสิทธิภาพและสอดคล้องกับมาตรฐานสากล

วิธีการทางกฎหมายอันเหมาะสมและบทบัญญัติของกฎหมายที่เพียงพอต่อการลงโทษนิติบุคลคลซึ่งละเลยหน้าที่อันต้องกระทำการหลังการขุดเหมืองแร่นั้นถือเป็นประเด็นในทางกฎหมายที่หลายประเทศทั่วโลกไม่ได้ให้ความสนใจเท่าไรนัก นอกจากการละเว้นหน้าที่ดังกล่าวโดยประมาทจะส่งผลร้ายทั้งทางตรงและทางอ้อมต่อสิ่งแวดล้อมและชุมชน บริเวณรอบพื้นที่แล้ว การกระทำดังกล่าวยังส่งผลเสียต่อตัวนิติบุคคลด้วย ในอินโดนีเซียมีผู้เห็นว่าการบังคับใช้มาตรการบังคับทางปกครองเพียงอย่างเดียวก็สามารถป้องปรามการกระทำดังกล่าวได้อย่างเพียงพอ แต่อย่างไรก็ตาม เมื่อได้ศึกษาเปรียบเทียบกฎหมายของอินโดนีเซียกับประเทศไทยและแอฟริกาใต้แล้ว พบว่ามีการใช้มาตรการทางอาญาควบคู่ไปกับมาตรการบังคับทางปกครอง ดังนั้น กรณีดังกล่าวจึงนำมาสู่ปัญหาของงานวิจัยฉบับนี้ว่า การบังคับใช้มาตรการทางอาญาควบคู่ไปกับมาตรการบังคับทางปกครองต่อความผิดฐานละเลยหน้าที่ที่พึงต้องกระทำหลังการขุดเหมืองแร่โดยประมาทจะมีผลสัมฤทธิ์มากกว่าการใช้มาตรการบังคับทางปกครองเพียงอย่างเดียวหรือไม่ และการใช้โทษทางอาญาในความผิดฐานดังกล่าวนั้นขัดต่อหลักความได้สัดส่วนและหลักการกำหนดความผิดในทางอาญาหรือไม่ บทความวิจัยนี้จึงมุ่งศึกษาปัญหาดังกล่าวโดยเน้นการวิเคราะห์หลักเกณฑ์ทางทฤษฎีที่เกี่ยวข้อง และเปรียบเทียบกฎหมายของประเทศไทยและแอฟริกาใต้

The past decade has seen an onslaught of high-profile litigation against the National Collegiate Athletic Association (NCAA). The litigation has almost exclusively consisted of claims alleging that some of the NCAA’s policies constitute anticompetitive practices under U.S. antitrust laws. In National Collegiate Athletic Association v. Alston, the Supreme Court ruled that, by limiting the education-related benefits schools were allowed to offer student athletes, the NCAA violated the Sherman Antitrust Act. งานวิจัยนี้มีวัตถุประสงค์เพื่อศึกษาความรับผิดทางแพ่งของบริษัทแม่ต่อผู้เสียหายที่ได้รับผลกระทบจากพื้นที่ปนเปื้อนสารอันตรายของบริษัทลูก โดยเป็นการศึกษาวิจัยเอกสารจากบทบัญญัติกฎหมาย คำพิพากษาศาล หนังสือตำรา และบทความเชิงวิชาการที่เกี่ยวข้อง ทั้งในประเทศและต่างประเทศ ผลการศึกษาพบว่า ปัจจุบันพระราชบัญญัติส่งเสริมและรักษาคุณภาพสิ่งแวดล้อมแห่งชาติ พ.ศ. 2535 ยังไม่มีบทบัญญัติให้บริษัทแม่เข้ามารับผิดชอบในความเสียหายจากพื้นที่ปนเปื้อนสารอันตรายของบริษัทลูก หากบริษัทแม่มีส่วนร่วมในแหล่งกำเนิดมลพิษหรือกำกับดูแลบริษัทลูก แต่ขาดการยึดถือแหล่งกำเนิดมลพิษทางกายภาพหรือเจตนาเพื่อตนอย่างใดอย่างหนึ่งไป อันไม่ครบองค์ประกอบของการเป็นผู้ครอบครองที่ต้องรับผิดตามมาตรา 96 หากบริษัทแม่มีการกระทำที่ไม่คำนึงถึงความเป็นนิติบุคคลของบริษัทลูกที่ไม่ใช่การกระทำละเมิด หากแต่เป็นการใช้โครงสร้างความเป็นนิติบุคคลของบริษัทลูกในทางมิชอบ อันได้แก่ การใช้นิติบุคคลเป็นเครื่องมือเพื่อหลบเลี่ยงหรือรับหน้าที่หรือความรับผิด และการมีทรัพย์สินปะปนกัน ดังนั้น จึงสมควรกำหนดบทบัญญัติที่เกี่ยวกับความรับผิดของบริษัทแม่ภายใต้พระราชบัญญัติดังกล่าว เพื่อให้ผู้เสียหายในคดีมลพิษจะได้รับความเป็นธรรมในการเยียวยา

การวิจัยนี้เป็นงานวิจัยเอกสารซึ่งมีวัตถุประสงค์เพื่อศึกษาประเด็นหลักดังต่อไปนี้ 1) บทบัญญัติกฎเกณฑ์ว่าด้วยการขัดกันแห่งกฎหมายสามารถเป็นวัตถุแห่งการควบคุมความชอบด้วยรัฐธรรมนูญของไทยได้หรือไม่ 2) บทบัญญัติกฎเกณฑ์ว่าด้วยการขัดกันแห่งกฎหมายซึ่งกำหนดให้ใช้สัญชาติของสามีเป็นจุดเกาะเกี่ยวในความสัมพันธ์ระหว่างคู่สมรสและให้ใช้สัญชาติของบิดาในความสัมพันธ์ระหว่างบิดามารดาและบุตรขัดหรือแย้งกับหลักความเสมอภาคระหว่างเพศตามรัฐธรรมนูญของไทยหรือไม่ จากการศึกษาพบว่า พระราชบัญญัติว่าด้วยการขัดกันแห่งกฎหมาย พุทธศักราช 2481 ไม่ควรอยู่นอกขอบเขตของการควบคุมความชอบด้วยรัฐธรรมนูญ เนื่องจากการเลือกกำหนดจุดเกาะเกี่ยวของแต่ละลักษณะข้อกฎหมายล้วนได้รับอิทธิพลจากข้อความคิดที่ปรากฏอยู่ในกฎหมายแพ่งและระบบคุณค่าของสังคมในขณะที่ตรากฎหมาย นอกจากนี้ ยังไม่เคยปรากฏในคำวินิจฉัยของศาลรัฐธรรมนูญไทยที่เกี่ยวกับหลักความเสมอภาคระหว่างเพศว่า ศาลอาศัยเหตุผลที่ว่าระบบคุณค่าที่อยู่เบื้องหลังบทบัญญัติของกฎหมายขัดต่อหลักความเสมอภาคระหว่างเพศเพื่อวินิจฉัยว่าบทบัญญัติกฎหมายใดขัดต่อหลักการดังกล่าว แต่จะต้องเป็นกรณีซึ่งกฎหมายบัญญัติให้ปฏิบัติแตกต่างกันและส่งผลให้บุคคลเสียไปซึ่งสิทธิบางประการอย่างเป็นรูปธรรมด้วยเหตุแห่งเพศ ดังนั้น ผู้วิจัยเห็นว่าการวินิจฉัยความชอบด้วยรัฐธรรมนูญของบทบัญญัติกฎเกณฑ์ว่าด้วยการขัดกันแห่งกฎหมาย ควรนำระบบคุณค่าที่อยู่เบื้องหลังการบัญญัติกฎหมายมาพิจารณาประกอบด้วย นอกจากนี้ ควรแก้ไขจุดเกาะเกี่ยวในกฎหมายขัดกันของไทยให้เป็นกลางทางเพศโดยให้สามารถรองรับการก่อตั้งครอบครัวในบริบทของความหลากหลายทางเพศ

Lack of access to evidence-based care for drug addiction is an urgent problem amid a decades-long overdose crisis that kills more than one hundred thousand Americans a year. Opioid addiction is the primary driver of overdoses today, and medicines exist to treat such addiction that can dramatically improve quality of life while reducing the risk of deadly overdose by more than half. In February 2024, in LePage v. Center for Reproductive Medicine, the Alabama Supreme Court held that embryos created through in-vitro fertilization (IVF) were legal persons. The national conversation about this ruling focused on the implications for IVF treatment. The impact of fetal personhood on the realm of vital records law has, to date, gone unnoticed. Vital records laws in the United States mandate the registration and collection of data for legislatively determined vital events. The use of compulsory prison labor in American jails and prisons has reached alarming levels. Despite the Thirteenth Amendment’s purpose of abolishing slavery in the United States, slavery-like conditions persist under the guise of compulsory prison labor. The Thirteenth Amendment created an important caveat to the prohibition of slavery in the United States: involuntary servitude is permissible as a punishment for crime. Across the country, incarcerated individuals are forced against their will to engage in physical labor with sub-standard safety protocols, endure physically and mentally abusive superiors, and receive little to no pay.
