การพัฒนาที่ยั่งยืน (Sustainable Development) เป็นแนวคิดด้านการพัฒนาที่ได้รับการยอมรับในระดับสากลและมีบทบาทเป็นแนวทางการพัฒนาที่ทุกประเทศนำไปปรับใช้ โดยมีนิยามว่า การพัฒนาที่ตอบสนองความต้องการของคนรุ่นปัจจุบัน โดยไม่กระทบต่อความสามารถในการตอบสนองความต้องการของคนรุ่นอนาคต โดยมี สามเสาหลักแห่งการพัฒนาที่ยั่งยืน (The three pillars of sustainability) เป็นหัวใจสำคัญของหลักการ ซึ่งการบูรณาการมิติด้านการพัฒนาทั้งสามด้าน ได้แก่ เศรษฐกิจ สังคม และสิ่งแวดล้อม ให้สอดคล้องกัน ซึ่งประเทศไทยมีพันธกิจในระดับสากลในการนำหลักการพัฒนาที่ยั่งยืนมาปรับใช้กับการพัฒนาภายในประเทศทุกภาคส่วน รวมถึงการจัดการป่าไม้อันเป็นทรัพยากรธรรมชาติภายในประเทศ บทความฉบับนี้จึงเป็นการศึกษาและวิเคราะห์กฎหมายป่าไม้ของไทย โดยศึกษาในเชิงประวัติศาสตร์กฎหมายนับตั้งแต่ก่อนการก่อตั้งกรมป่าไม้ในสมัยรัชกาลที่ 5 ซึ่งเป็นช่วงแรกเริ่มของการตรากฎหมายป่าไม้ มาจนถึงกฎหมายป่าไม้ในช่วงเวลาปัจจุบัน เพื่อชี้ให้เห็นว่ากฎหมายป่าไม้ของไทยได้นำเอาหลักการพัฒนาที่ยั่งยืนมาปรับใช้จริงและมีความสอดคล้องกับพัฒนาการของหลักการพัฒนาที่ยั่งยืน โดยปรากฏผ่านหลักการของกฎหมายป่าไม้ในหลายภาคส่วนที่แสดงให้เห็นถึงการบูรณาการทางเศรษฐกิจ สังคม และสิ่งแวดล้อม ซึ่งเป็นหัวใจสำคัญของหลักการพัฒนาที่ยั่งยืน

บทความวิจัยนี้ศึกษาพันธกรณีภายใต้ความตกลงระหว่างประเทศว่าด้วยการลงทุนที่เกี่ยวข้องกับการกระทำทางตุลาการ และแนวคำชี้ขาดของคณะอนุญาโตตุลาการที่ระงับข้อพิพาทระหว่างรัฐกับนักลงทุน เพื่อวิเคราะห์นัยของพันธกรณีของรัฐตามความตกลงดังกล่าวต่อการทำหน้าที่ของศาลโดยเฉพาะอย่างยิ่งในการกำกับดูแลการอนุญาโต ตุลาการทางพาณิชย์ มีหลายคดีที่นักลงทุนกล่าวหาว่าการกระทำของศาลในการกำกับดูแลการอนุญาโตตุลาการทางพาณิชย์ละเมิดพันธกรณีของรัฐตามความตกลงระหว่างประเทศว่าด้วยการลงทุน ซึ่งทำให้คณะอนุญาโตตุลาการต้องทบทวนคำพิพากษาและคำสั่งของศาลภายใน จากการศึกษาพบว่าคณะอนุญาโตตุลาการมีแนวโน้มที่จะยอมรับดุลพินิจของศาลภายใน กรณีที่ถือว่าการกระทำของศาลเป็นการละเมิดพันธกรณีตามความตกลงระหว่างประเทศว่าด้วยการลงทุนต้องเป็นกรณีที่การกระทำของศาลมีความบกพร่องอย่างร้ายแรงซึ่งพิจารณาจากมาตรฐานระหว่างประเทศ อนุสัญญาว่าด้วยการยอมรับนับถือและการบังคับตามคำชี้ขาดอนุญาโตตุลาการต่างประเทศ ค.ศ. 1958 มีบทบาทสำคัญในการพิจารณาความรับผิดของรัฐตามความตกลงระหว่างประเทศว่าด้วยการลงทุน

This book review evaluates Selbi Durdiyeva's The Role of Civil Society in Transitional Justice: The Case of Russia as a vital contribution to genocide prevention scholarship, which is particularly timely given Russia's mass atrocity crimes in Ukraine and their connection to domestic repression. The book's theoretical innovation in challenging state-centric transitional justice paradigms through rigorous analysis of Memorial NGO, Orthodox Church activities, and revisionist groups across three decades of post-Soviet Russia is critical for the transitional justice field. Polygamy in Islamic tenets is a difficult thing to do. It is required to be able to act fairly in fulfilling all the rights of his wives. Meanwhile, polygamy, which is allowed by Islam, is also limited to a maximum of four wives at a time. This study contains an overview of Polish case law and aims to present selected judgments of common courts and the Supreme Court issued between 2023 and 2025 concerning the enforcement of consumer protection laws in the financial services market, in the most ‘active’ areas of recent times that are of relevance to legal practice. It presents judgments relating to four main issues, i.e. so-called free credit sanctions, unauthorised payment transactions, mortgage loans linked to foreign currencies, and loans where the interest rate mechanism is based on the WIBOR index.

This article is devoted to a discussion of the Institutional Protection Scheme (IPS) model, in the context of both EU and national legislation. The following sections discuss the legal and economic aspects of IPS. Over the holiday break we lost a distinguished friend and alumnus with the passing of Ken Nunn ’67. He was 85.
Anyone who’s ever spent time in Indiana has likely seen or heard Nunn. His appearances in television commercials, on highway billboards, and on radio spots made him one of the most recognizable figures in the Hoosier State. And on days when the weather was just right, it was almost an Indiana University rite of passage to spot him—gray hair, sparkling smile—rolling down Kirkwood Avenue in a convertible.

This article aims to examine the legal basis to prosecute gratifiers in Indonesian Corruption Justice System. Samin Tan as the giver of gratification to Eni Maulani Saragih had been acquitted by the Corruption Court of Jakarta Decision Number 37/Pid.Sus-TPK/2021/PN.Jkt.Pst on 30th August 2021. Then, the Cassation to Supreme Court had also been rejected by Supreme Court Decision Number 2205 K/Pid.sus/2022 on 9th June, 2022. Hence, Samin Tan stays acquitted. Transnational Mass Tort Litigation: A Proposal For An International Court Of Civil Justice, Maya Steinitz

This chapter argues for the creation of an International Court of Civil Justice for transnational mass tort cases. It considers the challenges of adjudicating cross-border mass torts along with the incentives and feasibility of a new international court. Drawing upon case studies including the Bhopal disaster, litigation surrounding the devastation of the Ecuadorian rainforest, and the attempts to sue over human rights abuses in Nigeria, the chapter demonstrates that the world's legal systems were not designed to solve these kinds of complex cases, and the absence of mechanisms to ensure coordination means that victims try, but fail, to find justice …

For decades, international child abduction by one parent from the legal custody of the other has been a persistent issue which continues to be overlooked by international organizations and countries from around the world. Climate change, which is already making itself felt, poses challenges for international law and the international community. Climate change and its consequences will lead to (involuntary) human mobility and affect many people. This forced migration is not yet specifically addressed by international law. This article addresses climate-induced migration and the protection of climate refugees through international refugee and migration law, international human rights law, international environmental law, climate change law and international disaster law. Both the United States and Australia would benefit from more conservation of private land, and conservation servitudes can help both countries achieve this. However, in the United States and Australia, the power of eminent domain is a threat to the perpetuity of conservation servitudes. The prior public use doctrine, a common law doctrine in the United States arising out of the public trust doctrine, could limit eminent domain in these cases and provide protection to conservation servitudes. Jails throughout the United States hold thousands of legally eligible voters who have not been convicted of a crime While those convicted of felonies are often statutorily disenfranchised, pretrial detainees retain their civil rights—including the right to vote. In theory, this should guarantee them a voice. In practice, pretrial detention operates like a legal disqualification. Without meaningful enforcement mechanisms, the right to vote becomes hollow.
This Comment argues that implementing a national standard based on the proactive policies of Massachusetts and Nevada will ensure accessible voting for pretrial detainees. To build that argument, this Comment first explores the low level …

This Note addresses the insufficiency of the current system in protecting criminal defendants’ privilege against self-incrimination. Part II will outline the background legal principles of the issue, including the privilege against self-incrimination, the presumption of innocence, and the no-impeachment rule. This part will also address the Supreme Court’s sole judicial exception to the no-impeachment rule as laid out in Peña-Rodriguez v. Colorado. Part III will address the statistical significance of juror bias against criminal defendants who invoke the privilege, highlight the widespread nature of the bias, and argue that the procedural safeguards currently in place are insufficient to protect.

Workplace Retaliation And The Intersection Of Protected Conduct And Job Performance, Chris M. Schmidt

A host of statutory schemes seek to ensure equal employment opportunities in the United States by eradicating workplace discrimination (“EEO laws”). Consider two foundational pillars necessary for these EEO laws to strike the desired balance between individual rights and workplace efficiency. First, employees require robust protection from retaliation if they engage in protected conduct—for example, by reporting perceived discrimination. Second, employers can—and ideally, should—make employment decisions based on how an employee performs the job.

What happens when the conflict of interest relates to the conservatee’s substantial talents and their potential earnings? In this circumstance, a conservator has a perverse incentive to profit off of and coerce their conservatee into labor which serves to benefit the conservator—a kind of involuntary servitude that would seem to implicate the plain text of the Thirteenth Amendment of the United States Constitution.

It is not new that students struggle in law school. Research has shown for decades that, while students generally begin law school with healthy well-being, the competitive nature of law school combined with the stress of the Bar and securing post-Bar employment causes increased anxiety, depression, isolation, and related symptoms among students, especially women and underrepresented groups. What is new is the sheer number of law students struggling with serious mental health challenges today—a number that has reached crisis proportions.
