Change And Continuity: Foreign Affairs And Procedure At The Supreme Court 2024–25, Margaret E. Mcguinness Aug 2026

Change And Continuity: Foreign Affairs And Procedure At The Supreme Court 2024–25, Margaret E. Mcguinness

St. John's Law Review

(Excerpt)

The 100th anniversary of the founding of the Law School is a wonderful occasion to discuss how research and teaching form us as professors within the St. John’s community. I teach, research, and write about international law, international human rights, diplomacy, and the ways in which international law becomes law in the United States. I also teach civil procedure and international litigation. These two strands of my work allow me to think about the complex interplay between international law and domestic court procedure. I also have professional experience in each of these areas: First, as a career diplomat for …

How Law Changed Sex In The Twenty-First Century, Noa Ben-Asher Aug 2026

How Law Changed Sex In The Twenty-First Century, Noa Ben-Asher

St. John's Law Review

(Excerpt)

Thank you, wonderful students of St. John’s Law. Thank you, Professor Eva Subotnik, for your ongoing work on this event. Thank you, Dean Exum, for leading the school in these consequential times for the legal profession. And thank you, Judge Lohier, for taking the time to join us today.

Transgender issues have been in the spotlight in recent years. While many litigators and scholars think of this growing body of law and politics as “transgender rights,” I would like to persuade you in the short time that I have today that what is broadly and interestingly at stake is …

Respecting Who Legislates: Congresses And Presidents, John Q. Barrett Aug 2026

Respecting Who Legislates: Congresses And Presidents, John Q. Barrett

St. John's Law Review

(Excerpt)

Under the United States Constitution, who legislates? The Constitution says, in plain words, that “[a]ll legislative Powers herein granted shall be vested in a Congress of the United States, which shall consist of a Senate and House of Representatives.” So people who know the Constitution tend to say that “Congress” legislates.

There are two problems with that answer. The first is rhetorical: that summary answer is too disembodied. “Congress,” when it passes a bill, in fact, is many, typically highly respectable, elected Senators and Representatives. At minimum, 269 people—fifty-one Senators (or fifty Senators plus one Vice President of the …

On Being A Scholar And A Teacher In Polarized Times, Michael A. Simons Aug 2026

On Being A Scholar And A Teacher In Polarized Times, Michael A. Simons

St. John's Law Review

(Excerpt)

There’s an old expression, sometimes attributed to a Chinese curse, that says “May you live in interesting times.” That expression is very much in the air these days. One hundred years after the founding of our law school, it feels like we are in not just “interesting” but unprecedented times.

Perhaps every era feels unprecedented, but right now our country seems acutely polarized, our legal system seems to be under great stress, and fundamental assumptions we’ve held about the Rule of Law seem to be eroding. And then, to add to that, the assassination of Charlie Kirk and the …

Opening Symposium Remarks: Celebrating 100 Years Of Scholarly Impact At St. John’S Law, Jelani Jefferson Exum

St. John's Law Review

(Excerpt)

Good morning, everyone. It is both an honor and a joy to open today’s symposium—Impact That Endures: Celebrating the Past, Present, and Future of St. John’s Law Faculty Scholarship.

As we gather in this centennial year of St. John’s Law, we have the opportunity to reflect not only on our history but also on our identity. So that means thinking about who we have been, who we are, and then also, who we aspire to be.

Zeus Network And The Commercialization Of Conflict: A Critical Analysis Of Exploitation, Representation, And Reality Television, Delante Clark Aug 2026

Zeus Network And The Commercialization Of Conflict: A Critical Analysis Of Exploitation, Representation, And Reality Television, Delante Clark

Graduate Scholarship and Creative Works

This study examines Zeus Network as a prominent example of the commercialization of conflict within contemporary digital media. Through reality based programming that frequently emphasizes confrontation, public humiliation, emotional volatility, and interpersonal disputes, the network has cultivated a profitable entertainment model built upon spectacle and controversy. Drawing upon conflict theory, critical race theory, and media sociology, this paper investigates whether Zeus functions as a platform for cultural representation and economic opportunity or as a system that monetizes dysfunction for audience consumption. Particular attention is given to the portrayal of Black women and Black communities, whose experiences often become central to …

How Can Electronic Timekeeping Systems Provide Cost And Time Savings Compared To Manual Time Entry And Paper-Based Timesheets?, Jill Childs Aug 2026

How Can Electronic Timekeeping Systems Provide Cost And Time Savings Compared To Manual Time Entry And Paper-Based Timesheets?, Jill Childs

Certified Public Manager® Applied Research

Paper-based timekeeping methods have historically been the default way for both municipalities and businesses to document hours worked by employees. However, due to analog timekeeping’s lack of verification methods, human error and intentional dishonesty combine to make this method unreliable. These discrepancies are also costly, as human resources staff must be compensated for the time it takes to verify entries and correct mistakes, and if unchecked, the falsified time can potentially result in thousands of dollars of unearned wages lost. This article details various methods and motivations for falsification and argues for the implementation of electronic timekeeping systems, such as …

Lessons Learned For The Independent Panel For Evidence For Action Against Amr From Previous International Science Panels: Stakeholder Views From The 2025 Lagos Workshop, Iruka N. Okeke, Anthony Mcdonnell, Ayodele A. Akinyele, Javier Guzman, Kevin Outterson

Faculty Scholarship

In September, 2024, the UN General Assembly assigned the Quadripartite Joint Secretariat on Antimicrobial Resistance (AMR) the task of establishing an Independent Panel for Evidence for Action against AMR (IPEA). To promote stakeholder views and input around the constitution and functioning of this Panel, which could feed into the Quadripartite Joint Secretariat’s consultation process, we independently commissioned seven papers to examine the lessons that could be learned from other high-level scientific panels. We then convened 85 stakeholders, primed with the background papers. The Workshop, held in Lagos, Nigeria in April, 2025, drew representation from around the world, particularly low-income or …

Contract Theory In The Saudi Civil Transactions Law “A Critical Comparative Study”, Mohamad Arfan Alkhatib Aug 2026

Contract Theory In The Saudi Civil Transactions Law “A Critical Comparative Study”, Mohamad Arfan Alkhatib

BAU Journal - Journal of Legal Studies - مجلة الدراسات القانونية

This comparative critical study provides an in-depth doctrinal and analytical examination of contract theory under the Saudi Civil Transactions Law, situating its analysis within the broader framework of the modern law of obligations. The inquiry is structured around two interdependent axes. The first considers the determinants of contracting, analysed through the dual categories of contractual autonomy and the binding normative force of contract (force obligatoire). The second addresses the requirements of contracting, focusing on the constituent essentialia negotii and the extent to which such elements may be subject to curative mechanisms within the applicable invalidity …

Implementation Of The Retirement And Social Protection Law In Lebanon, Manal H. Choker Aug 2026

Implementation Of The Retirement And Social Protection Law In Lebanon, Manal H. Choker

BAU Journal - Journal of Legal Studies - مجلة الدراسات القانونية

The Law No. 319 dated December 22, 2023 constitutes a historic station in the process of developing social security legislation in Lebanon. This law - published in the Official Gazette No. 53 on 28/12/2023 - amended some provisions of the Social Security Law and established the retirement and social protection system in the National Social Security Fund. The adoption of this legislation was the result of efforts that lasted about twenty years of studies and consultations on the reform of the end-of-service system, where the adoption of a pension system was repeatedly postponed despite the urgent need for it. The …

Shedding Light On International Criminal Law, Mohamad Walid Abdulrahim Aug 2026

Shedding Light On International Criminal Law, Mohamad Walid Abdulrahim

BAU Journal - Journal of Legal Studies - مجلة الدراسات القانونية

The article sheds the light on International Criminal Law (ICL), one of the modern branches of Public International Law that defines international crimes and establishes the legal framework for prosecuting individuals responsible for the commission of these crimes, through substantive and procedural rules. It traces the historical evolution of the law, from traditional crimes like piracy and war crimes to the contemporary inclusion of international crimes: genocide, crimes against humanity, and the crime of aggression. Furthermore, it traces the evolution of enforcement mechanisms from the exclusive jurisdiction of national courts to ad hoc international tribunals and then to the International …

The 2024 New European Pact On Migration And Asylum: Recasting The European Legal Framework For Asylum Between Protection Guarantees And The Effectiveness Of Migration Management, Ali Mourad Aug 2026

The 2024 New European Pact On Migration And Asylum: Recasting The European Legal Framework For Asylum Between Protection Guarantees And The Effectiveness Of Migration Management, Ali Mourad

BAU Journal - Journal of Legal Studies - مجلة الدراسات القانونية

The New European Pact on Migration and Asylum, adopted on 14 May 2024, constitutes one of the most far-reaching reforms undertaken by the European Union in this field. Through a package of ten legislative instruments, it reorganizes screening at the external borders, procedures for international protection, the determination of the Member State responsible, solidarity mechanisms, crisis and force majeure situations, and the role of databases and European Union agencies. This reform emerged in a context in which the migration crises of 2015 and 2016 exposed the limits of the Dublin system, whose application, particularly the irregular-entry criterion—concentrated responsibility in practice …

The Role Of The Public Prosecutor At The Court Of Casssation And Its Role In Parellel Financal Investigations Related To Money Laundery And Terrorist Financing Offenses, Tanos Youssef Saghbini Aug 2026

The Role Of The Public Prosecutor At The Court Of Casssation And Its Role In Parellel Financal Investigations Related To Money Laundery And Terrorist Financing Offenses, Tanos Youssef Saghbini

BAU Journal - Journal of Legal Studies - مجلة الدراسات القانونية

The article concludes that the Public Prosecutor at the Court of Cassation in Lebanon plays a central role in parallel financial investigations related to money laundering and terrorist financing, because this approach allows authorities to trace suspicious funds, identify the real beneficiary, freeze assets, and prepare for confiscation instead of limiting the case to the underlying offense alone. It also explains that success depends on coordination between the Public Prosecutor, the Special Investigation Commission, and the judicial police, using practical procedures and circulars that give the investigation an effective judicial character and align it with international anti-financial-crime standards.

Who Controls The Block? How States Can Regulate Tokenized Residential Real Estate, David J. Reiss, Joseph Bizub, Justin Peralta Aug 2026

Who Controls The Block? How States Can Regulate Tokenized Residential Real Estate, David J. Reiss, Joseph Bizub, Justin Peralta

Cornell Law Faculty Working Papers

In July 2025, the City of Detroit filed a major nuisance abatement action against RealT, a fintech that had sold blockchain-based fractional interests in more than four hundred Detroit rental properties to some 22,000 investors around the world. Within a year, a court had ordered the company’s rents into escrow, the company had conceded to its investors that its “model no longer works,” and it had announced the liquidation of its portfolio -- leaving tenants without basic services and token holders facing steep losses.

This article uses the rise and collapse of RealT, together with case studies of the other …

Real Bullets, Plastic Guns: Evaluating The Strength Of 3-D Printed Gun Parts, Maria Latenia Mayol Aug 2026

Real Bullets, Plastic Guns: Evaluating The Strength Of 3-D Printed Gun Parts, Maria Latenia Mayol

Student Theses

Privately made firearms (PMFs), often referred to as “ghost guns,” are firearms manufactured or assembled by individuals rather than federally licensed manufacturers. Although the terms are frequently used interchangeably, “ghost gun” more specifically describes an unserialized firearm, whereas PMFs include a broader range of firearms produced through nontraditional manufacturing methods. PMFs may be entirely 3-D printed, assembled from partially completed firearm kits, or constructed by integrating additively manufactured components with commercially manufactured firearm parts. The increasing accessibility of additive manufacturing and widespread dissemination of computer-aided design files have raised concerns about concealment, regulation, and forensic evasion, particularly when factory-manufactured components …

Ai And Legal Malpractice: Are We Due For A Reckoning?, John Browning Aug 2026

Ai And Legal Malpractice: Are We Due For A Reckoning?, John Browning

Texas A&M Law Review

As the rate of AI adoption by lawyers steadily climbs, unfortunately so has the number of incidents of AI misuse by attorneys. For some time, courts satisfied themselves with giving offending lawyers warnings, ordering them to take additional CLE, and/or administering relatively nominal monetary sanctions. Lately, however, frustrated judges throughout the country have upped the ante by not only assessing increasingly higher sanctions but also imposing case dismissals and suspensions or disciplinary referrals for the lawyers involved. As this article discusses, with their negligence exposed to the public eye and the harsh gaze of their clients, lawyers who misuse AI …

Assessing The Impact Dynamics Of Less Lethal Ammunition, Steven Bermejo Aug 2026

Assessing The Impact Dynamics Of Less Lethal Ammunition, Steven Bermejo

Student Theses

Less-lethal ammunition is widely used by law enforcement as an alternative to lethal force during crowd control, on-street confrontations, and other situations requiring force. Although these projectiles are intended to reduce risk of fatal injury, serious injuries and fatalities have been reported, highlighting the need to better understand the factors that influence their impact behavior. This study evaluated the impact dynamics of four types of 12-gauge less-lethal ammunition, including rubber buckshot, single rubber ball, double rubber ball, and Byrna kinetic projectile, using kinetic energy calculations derived from projectile mass and velocity measurements. In addition, Attenuated Total Reflectance Fourier Transform Infrared …

From Global Principles To National Implementation: The 9th Un Conference And Its Product Safety Resolution, Suruchi ., Kumar Jyotish

International Journal on Consumer Law and Practice

The 9th United Nations Conference on Competition and Consumer Protection of 2025 advanced international consumer protection law by extending its scope. The Product Safety Resolution adopted at the Geneva-based conference is the first binding global resolution on product safety. Addressing the wide scope of problems associated with the emergence of more complex global and online markets, the Resolution presents a set of legal criteria to ensure the safety of goods, liability of defaulting manufacturers, rights of consumers, and the laying out of appropriate procedures. This paper presents a critical evaluation of the normative context of the Resolution and its variation …

A Poetic Call For And A Reflection And Commentary On Clarity, Understanding, Hope, Courage, And Compassion, Carroy U. Ferguson Aug 2026

A Poetic Call For And A Reflection And Commentary On Clarity, Understanding, Hope, Courage, And Compassion, Carroy U. Ferguson

Psychology Faculty Publication Series

Finding a published poem I had written as a teenager, titled “The Heavens Weep.” this article uses that poem as the basis for a commentary that reflects on the state of the world today (2026),  As a commentary, the article uses the poetic and metaphoric words in the poem as a relevant "reality check" for what is still going on today.  In essence, the commentary is about a call for Clarity, Understanding, Hope, Courage, and Compassion, or what I call Archetypal Energies, Higher Vibrational Energies that operate deep within our individual and collective psyches to creatively urge us to "see" …
