Tax policy discussions of how to tax married couples, as compared to singles, often focus on the by now much-criticized norms of “marriage neutrality” and “couples neutrality.” While these norms are largely unpersuasive, they do offer a useful analytic starting point, because of both (a) how they relate to more validly expressed concerns, and (b) the significance of the empirical reasons why they generally do not hold.

Looking back over the decade that has elapsed since the Supreme Court’s landmark marriage equality decisions in United States v. Windsor and Obergefell v. Hodges, this article explores the complex relationship between legal and social change through the prism of the impact that these decisions have had on the tax landscape for the LGBTQ+ community. The article examines the gap between the promise of “equal” treatment and respect for members of the LGBTQ+ community embodied in these legal decisions and a social reality in which discrimination—tax and otherwise—stubbornly persists.

Transgender rights have increasingly come under assault in the United States. As of early 2026, twenty-seven states have passed either bans or restrictions on access to gender-affirming care. The issue has also become a central focus at the federal level. The U.S. Supreme Court decided United States v. Skrmetti, a case concerning the legality of state restrictions on gender-affirming care, in the 2024 – 2025 term. This Article contends that the facially unconstitutional introduction of mandatory Biblical instruction into Oklahoma public schools and mandatory posting of the Ten Commandments in Louisiana and Texas public schools reflect a deliberate strategy to bring Everson v. On January 30, 2026, Mayor Mamdani and Department of Consumer and Worker Protection (“DCWP”) Commissioner Samuel Levine announced that food delivery app companies Uber Eats, Fantuan, and Hungry Panda owed more than $5 million in worker restitution, civil penalties, and damages to resolve violations of the Minimum Pay Rate for delivery workers. Like New York City, other municipalities across the United States should enact statutory protections for delivery workers, investigate compliance, and enforce penalties to ensure workers' rights and justice.

ปัญญาประดิษฐ์เข้ามามีบทบาทต่อการดำเนินชีวิตของบุคคลอย่างมาก ทำให้เกิดปัญหาความรับผิดจากความบกพร่องของปัญญาประดิษฐ์ จากคุณสมบัติเฉพาะที่มีความซับซ้อนและความเป็นอิสระจากการควบคุมของมนุษย์ ทำให้การใช้ทฤษฎีความผิดที่มุ่งหาตัวผู้กระทำผิดมารับผิดชอบต่อความบกพร่องของปัญญาประดิษฐ์นั้นไม่เหมาะสมอีกต่อไป เนื่องจากทฤษฎีความผิดมุ่งหาผู้กระทำความผิดโดยเจตนาหรือประมาท โดยมุ่งเน้นที่ตัวบุคคลผู้กระทำผิด ทำให้ผู้เสียหายไม่ได้รับความเป็นธรรม ต้องพิสูจน์ต่อศาลว่ามีการกระทำผิดโดยเจตนาหรือประมาทเกิดขึ้น ทั้งที่โดยคุณสมบัติของปัญญาประดิษฐ์นั้นมีความซับซ้อนทางเทคโนโลยี ผู้เสียหายไม่อาจพิสูจน์ความผิดหรือความเกี่ยวข้องระหว่างเหตุและผลของการกระทำและการตัดสินใจของปัญญาประดิษฐ์ได้โดยง่าย ด้วยเหตุนี้จึงจำเป็นต้องนำทฤษฎีความรับผิดขององค์กรมาใช้ เพื่อให้ผู้ผลิตปัญญาประดิษฐ์รับผิดต่อความบกพร่องของปัญญาประดิษฐ์แม้ไม่มีความผิดเกิดขึ้นก็ตาม โดยเป็นการรับผิดในความบกพร่องชำรุดของปัญญาประดิษฐ์โดยตรง ทั้งนี้ผู้เสียหายจะมีภาระการพิสูจน์เพียงว่าปัญญาประดิษฐ์นั้นมีความชำรุดบกพร่องและก่อให้เกิดความเสียหายต่อผู้เสียหายเท่านั้น ซึ่งหลักทฤษฎีความรับผิดขององค์กรมุ่งเน้นที่การกระจายความเสี่ยงและการคิดต้นทุนการผลิตภายในองค์กร หลักการนี้จะทำให้ผู้ผลิตสามารถคำนวณต้นทุนความเสียหายได้ล่วงหน้าและสามารถกระจายความเสี่ยงไปยังผู้มีส่วนได้เสียหรือผู้บริโภคในตลาด ไม่จำต้องแบกรับภาระของต้นทุนสินค้าและความเสียหายแต่เพียงผู้เดียว ความรับผิดขององค์กรจึงเป็นความรับผิดเด็ดขาดของผู้ผลิต ซึ่งมีความเหมาะสมกับปัญญาประดิษฐ์มากกว่าการใช้ทฤษฎีความผิดแบบดั้งเดิม

สิทธิและเสรีภาพของพระภิกษุในระบบกฎหมายไทยถูกจำกัดหลายประการด้วยกัน ในรัฐธรรมนูญแห่งราชอาณาจักรไทยทุกฉบับที่ผ่านมามีบทบัญญัติว่าพระภิกษุเป็นผู้ไม่มีสิทธิเลือกตั้งมาโดยตลอด ทำให้พระภิกษุไม่มีสิทธิประเภทอื่น ๆ ตามมา เช่น สิทธิในการลงประชามติ สิทธิในการเข้าชื่อเสนอร่างกฎหมายหรือแก้กฎหมาย ไม่เพียงเท่านี้ ยังมีพระราชบัญญัติคณะสงฆ์ พ.ศ. 2505 มาตรา 29 กำหนดให้เจ้าหน้าที่ราชอาณาจักร คือ พนักงานสอบสวนมีอำนาจสละสมณเพศพระภิกษุผู้ถูกกล่าวหาในคดีอาญาได้ และกำหนด ให้องค์กรคณะสงฆ์ คือ “มหาเถรสมาคม” ออกกฎ คำสั่ง มติ ระเบียบต่าง ๆ มาบังคับใช้กับพระภิกษุ ทำให้เกิดการจำกัดสิทธิภายในคณะสงฆ์มากขึ้นเรื่อย ๆ ปรากฏว่ากฎหมายเหล่านั้นบางฉบับไม่สอดคล้องกับหลักสากลว่าด้วยสิทธิมนุษยชน บางฉบับไม่สอดคล้องกับหลักการการจำกัดสิทธิและเสรีภาพตามรัฐธรรมนูญ และบางฉบับไม่สอดคล้องกับหลักพระธรรมวินัยของสงฆ์ บทความนี้จึงมุ่งพิจารณาว่ากฎหมายที่ตราขึ้นมาเพื่อจำกัดสิทธิและเสรีภาพนั้นเป็นไปสอดคล้องตามหลักสิทธิมนุษยชน รัฐธรรมนูญ กฎหมายบ้านเมือง และหลักพระธรรมวินัย มีผลสัมพันธ์กันหรือไม่ และได้ศึกษาเปรียบเทียบกับพระภิกษุในประเทศพม่า และประเทศศรีลังกา ซึ่งเป็นพุทธศาสนาเถรวาทเช่นเดียวกับพระภิกษุในประเทศไทย เพื่อแก้ไขกฎหมายให้เหมาะสมกับพระภิกษุในสังคมไทยต่อไป

เสรีภาพในการบันทึกทัศนียภาพ (freedom of panorama) เป็นหลักการที่ถูกพัฒนาขึ้นในลักษณะของการเป็นข้อยกเว้นการละเมิดลิขสิทธิ์ เพื่อทำให้บุคคลสามารถบันทึกภาพอาคารสิ่งปลูกสร้าง ประติมากรรม หรืองานศิลปกรรมอันมีลิขสิทธิ์ที่ตั้งอยู่ถาวรในที่สาธารณะได้โดยไม่ต้องขออนุญาตจากเจ้าของลิขสิทธิ์ หลักการนี้มุ่งที่จะสร้างสมดุลระหว่างสิทธิของเจ้าของผลงานที่ตั้งอยู่ในที่สาธารณะกับประโยชน์ของสาธารณชนและคุณค่าทางศิลปะในทัศนียภาพ แม้เสรีภาพในการบันทึกทัศนียภาพจะได้รับการยอมรับและบัญญัติเป็นข้อยกเว้นการละเมิดลิขสิทธิ์ในกฎหมายหลายประเทศทั่วโลก แต่กลับไม่มีนิยามและขอบเขตที่แน่ชัดและเป็นหนึ่งเดียวกัน ทั้งนี้การกำหนดขอบเขตของเสรีภาพในการบันทึกทัศนียภาพให้กว้างย่อมเป็นการจำกัดสิทธิของเจ้าของลิขสิทธิ์ แต่การให้ขอบเขตของเสรีภาพในการบันทึกทัศนียภาพที่แคบเกินไปก็จะเป็นการจำกัดเสรีภาพของปัจเจกชนและกระทบต่อประโยชน์สาธารณะ บทความวิจัยนี้นำเสนอที่มา หลักการและแนวคิดที่เกี่ยวข้องกับเสรีภาพในการบันทึกทัศนียภาพ โดยศึกษาวิเคราะห์บทบัญญัติข้อยกเว้นการละเมิดลิขสิทธิ์ที่เกี่ยวกับเสรีภาพในการบันทึกทัศนียภาพตามกฎหมายในต่างประเทศจำนวน 20 ประเทศและบทบัญญัติของประเทศไทย บทความวิจัยนี้เสนอบทวิเคราะห์ในประเด็นการกำหนดขอบเขต การปรับใช้และการตีความบทบัญญัติเพื่อให้สอดคล้องกับหลักคิดพื้นฐานของเสรีภาพในการบันทึกทัศนียภาพและหลักการกำหนดข้อยกเว้นการละเมิดลิขสิทธิ์ โดยคำนึงถึงการถ่วงดุลอย่างเหมาะสมระหว่างสิทธิของเจ้าของลิขสิทธิ์กับคุณค่าของเสรีภาพในการบันทึกทัศนียภาพในประเด็นสำคัญ 5 ประการ ได้แก่ การกำหนดประเภทของงานอันมีลิขสิทธิ์ที่อยู่ภายใต้ข้อยกเว้นการละเมิดลิขสิทธิ์ ลักษณะการตั้งอยู่ของงานนั้น ลักษณะการกระทำที่อนุญาตให้กระทำต่องานเหล่านั้น ขอบเขตการนำงานไปใช้ในทางพาณิชย์ และการกำหนดเงื่อนไขอื่นเพิ่มเติม

Capitalism began in murder. Bodies were marked by slavery, colonialism, and genocide, white to have, and black to have not. Capitalism, “covered in dirt and dripping with blood,” was born of these three “primitive accumulations.” Slavery is death, and just like colonialism and genocide, it is a capital sentence. The law of capital punishment continues this legacy of murder and racism, as if on “rails to infinity.” This article uses insights from the critique of political economy to examine the death penalty, and the role of law generally, in maintaining racial and other inequalities. The New Cja Form 24: Protecting Indigent Criminal Appellants’ Rights, Gabriel J. Chin, Hannah Bogen

This essay describes how the Judicial Conference of the United States elected to reform the provision of transcripts to indigent persons appealing criminal convictions in federal court. A conviction cannot be appealed without a transcript, but, by definition, indigent persons cannot afford to purchase them. A series of Supreme Court decisions held that indigent persons had to be provided transcripts without charge. However, the practical implementation of that right was blocked. In the federal system, appointed counsel had to request production of transcripts using Criminal Justice Act Form 24. That form required special permission for the court reporter to produce …

งานวิจัยนี้มีวัตถุประสงค์เพื่อ (1) ศึกษาความเป็นมา แนวคิด และทฤษฎีที่เกี่ยวข้องกับกระบวนการอนุญาโตตุลาการของประเทศไทย โดยเปรียบเทียบกับหลักการในอนุสัญญาว่าด้วยการยอมรับและการบังคับตามคำชี้ขาดของอนุญาโตตุลาการต่างประเทศ ค.ศ. 1958 (อนุสัญญานิวยอร์ก) กฎหมายแม่แบบว่าด้วยการอนุญาโตตุลาการพาณิชย์ระหว่างประเทศของคณะกรรมาธิการกฎหมายการค้าระหว่างประเทศแห่งสหประชาชาติ กฎหมายว่าด้วยการอนุญาโตตุลาการของสหราชอาณาจักร และกฎหมายว่าด้วยการอนุญาโตตุลาการของสาธารณรัฐสิงคโปร์ (2) ศึกษาและเปรียบเทียบกระบวนการอนุญาโตตุลาการของประเทศไทยกับแนวปฏิบัติสากล (3) วิเคราะห์ปัญหาในการบังคับใช้พระราชบัญญัติอนุญาโตตุลาการ พ.ศ. 2545 ที่เป็นอุปสรรคต่อประสิทธิภาพและความน่าเชื่อถือของกระบวนการอนุญาโตตุลาการในประเทศไทย และ (4) เสนอแนะแนวทางปรับปรุงกฎหมายให้เหมาะสมและทันสมัยยิ่งขึ้น งานวิจัยนี้เป็นการวิจัยเชิงคุณภาพ โดยใช้วิธีการศึกษาค้นคว้าเอกสารจากอนุสัญญาว่าด้วยการยอมรับและการบังคับตามคำชี้ขาดของอนุญาโตตุลาการต่างประเทศ ค.ศ. 1958 กฎหมายแม่แบบว่าด้วยการอนุญาโตตุลาการพาณิชย์ระหว่างประเทศของคณะกรรมาธิการกฎหมายการค้าระหว่างประเทศแห่งสหประชาชาติ กฎหมายว่าด้วยการอนุญาโตตุลาการของสหราชอาณาจักร และกฎหมายว่าด้วยการอนุญาโตตุลาการของสาธารณรัฐสิงคโปร์ ตลอดจนตำรา บทความวิชาการ คำพิพากษา งานวิจัย และวิทยานิพนธ์ทั้งภาษาไทยและต่างประเทศ โดยมุ่งวิเคราะห์เปรียบเทียบประเด็นสำคัญเพื่อเสนอข้อเสนอแนะในการพัฒนากฎหมายไทย ผลการวิจัยพบว่า (1) แนวคิดและทฤษฎีที่เกี่ยวข้องกับกระบวนการอนุญาโตตุลาการ เช่น ทฤษฎีอำนาจรัฐ ทฤษฎีสัญญา และทฤษฎีความเป็นเอกเทศ รวมถึงหลักความเป็นอิสระของคู่กรณีและหลักพันธกรณีตามสัญญา ยังไม่ถูกประยุกต์ใช้อย่างเหมาะสมในประเทศไทย ทำให้กระบวนการอนุญาโตตุลาการขาดความยืดหยุ่น (2) ข้อพิพาทที่ไม่อาจเข้าสู่กระบวนการอนุญาโตตุลาการตามมาตรา 40 วรรคสอง (2) (ก) ยังไม่มีการบัญญัติให้ชัดเจน ส่งผลให้เกิดความไม่แน่นอนในการตีความ (3) หลักเกณฑ์การเพิกถอนคำชี้ขาดที่ขัดต่อความสงบเรียบร้อยหรือศีลธรรมอันดีของประชาชนตามมาตรา 40 วรรคสอง (2) (ข) ยังขาดแนวทางการตีความที่แน่นอน และเปิดช่องให้ใช้ดุลพินิจเกินจำเป็น (4) มาตรการคุ้มครองชั่วคราวตามมาตรา 16 ยังไม่มีประสิทธิภาพเพียงพอ เนื่องจากต้องอาศัยข้อตกลงของคู่กรณีและขาดกลไกรองรับจากศาล และ (5) เมื่อเปรียบเทียบกับกฎหมายของประเทศที่มีกระบวนการอนุญาโตตุลาการที่พัฒนาแล้ว เช่น สหราชอาณาจักร สาธารณรัฐสิงคโปร์ รวมถึงอนุสัญญาว่าด้วยการยอมรับและการบังคับตามคำชี้ขาดของอนุญาโตตุลาการต่างประเทศ ค.ศ. 1958 กฎหมายแม่แบบว่าด้วยการอนุญาโตตุลาการพาณิชย์ระหว่างประเทศของคณะกรรมาธิการกฎหมายการค้าระหว่างประเทศแห่งสหประชาชาติ พบว่า ประเทศเหล่านี้มีแนวทางที่ส่งเสริมกระบวนการอย่างมีประสิทธิภาพ ทั้งในด้านบทบาทของศาล การตีความนโยบายสาธารณะ และการบังคับใช้มาตรการคุ้มครองชั่วคราว ซึ่งประเทศไทยควรนำมาเป็นแนวทาง โดยเฉพาะการกำหนดข้อยกเว้นของข้อพิพาทให้ชัดเจน การจำกัดขอบเขตของความสงบเรียบร้อยตามหลักนิติธรรม และการส่งเสริมบทบาทของศาลในการสนับสนุนมาตรการคุ้มครองชั่วคราว เพื่อยกระดับกระบวนการอนุญาโตตุลาการของไทยให้สอดคล้องกับมาตรฐานสากล

บทความนี้วิเคราะห์ผลลัพธ์ของนโยบาย “Transforming Rehabilitation” ซึ่งเป็นการปฏิรูปโครงสร้างงานคุมประพฤติในสหราชอาณาจักรโดยให้ภาคเอกชนเข้ามามีส่วนร่วมในการดำเนินงาน ภายใต้ความประสงค์ในการลดอัตราการกระทำผิดซ้ำ เพิ่มประสิทธิภาพในการปฏิบัติงาน และเสริมสร้างนวัตกรรมในการบริหารจัดการผู้กระทำผิด การปฏิรูปนี้ได้มอบหมายหน้าที่โดยให้บริษัทเอกชนที่เป็นผู้รับผิดชอบในการดูแลผู้กระทำผิดที่มีความเสี่ยงต่ำถึงปานกลางผ่านวิสาหกิจเพื่อการแก้ไขฟื้นฟูผู้กระทำผิดในชุมชน (Community Rehabilitation Companies) ในขณะที่หน่วยงานคุมประพฤติแห่งชาติ (National Probation Service) ยังคงรับผิดชอบผู้กระทำผิดที่มีความเสี่ยงสูง การประยุกต์ใช้เครื่องมือทางการเงิน เช่น “ค่าตอบแทนตามการให้บริการ” และ “การจ่ายเงินตามผลลัพธ์” ถูกนำมาใช้เพื่อดึงดูดการลงทุนจากภาคเอกชนและคาดหวังว่าจะเกิดนวัตกรรมด้านเทคโนโลยี จากการศึกษาพบว่าผลการดำเนินงานตามแผนปฏิรูปไม่เป็นไปตามเป้าหมายที่กำหนด ผู้ให้บริการเอกชนไม่สามารถจัดทำบริการเพื่อสนับสนุนการกลับคืนสู่สังคมได้อย่างเพียงพอ ส่งผลให้ผู้กระทำผิดที่ได้รับการแก้ไขฟื้นฟูไม่ได้รับความช่วยเหลือ การให้บริการงานคุมประพฤติขาดความคิดริเริ่มใหม่ และมาตรฐานงานและคุณภาพลดลง ซึ่งสาเหตุหลักเกิดจากการขาดการทดลองนำร่องที่เพียงพอก่อนการขยายผล รวมถึงข้อบกพร่องในกระบวนการประเมินความเสี่ยง ปัญหาทางการเงินทำให้วิสาหกิจเพื่อการแก้ไขฟื้นฟูผู้กระทำผิดในชุมชนหลายแห่งล้มละลาย ผลกระทบต่อเสถียรภาพของงานคุมประพฤติและความเชื่อมั่นของประชาชนที่ลดลง จนกลายเป็นปัจจัยให้แนวคิดการลงโทษได้รับความนิยม ขณะที่แนวทางการแก้ไขฟื้นฟูผู้กระทำผิดในชุมชนถูกลดบทบาทลง บทความเสนอแนวทางแก้ไขที่สำคัญ ได้แก่ การจำกัดบทบาทของภาคเอกชนให้เป็นเพียงผู้สนับสนุนงานคุมประพฤติ เสริมสร้างความแข็งแกร่งให้กับหน่วยงานคุมประพฤติแห่งชาติในฐานะผู้ให้บริการในการจัดทำงานคุมประพฤติ และการออกแบบเครื่องมือทางการเงินใหม่ที่สร้างแรงจูงใจและส่งเสริมการมีส่วนร่วมของภาคีเครือข่ายและภาคประชาชน นอกจากนี้ บทความยังเสนอแนะให้มีการนำร่องอย่างเป็นระบบเพื่อให้สามารถประเมินความเสี่ยงได้อย่างแม่นยำ และสร้างกลไกการกำกับดูแลที่มีประสิทธิภาพ เพื่อรักษาคุณภาพบริการและสร้างความเชื่อมั่นต่องานคุมประพฤติอย่างยั่งยืน

In criminal courtrooms across the country, well-meaning judges insist on running colorblind courtrooms — courtrooms in which the attorneys are not allowed to call attention to race. Many judges, including many US Supreme Court justices, believe it is best to ignore racial difference, and that noticing race will encourage racial discrimination. The problem is that colorblind courtrooms are likely to exacerbate, not ameliorate, implicit racial bias. Siding With Goliath: Nra V. Vullo, Dru Stevenson

The Supreme Court’s 2024 decision in NRA v. Vullo found a plausible First Amendment violation by a state regulator for allegedly coercing private entities to cease business with the NRA. While the Court portrayed its decision as merely applying longstanding precedent, the facts of the case were quite different from the cases on which the Court relied, especially related to Vullo’s responsibilities as a regulator of the financial sector.
