This Book Review examines the significance of Professor David E. Wilkins’s (Lumbee Nation) newest book Indigenous Governance: Clans, Constitutions, and Consent. It suggests that Wilkins has produced a critically important collection of primary sources related to the origins of tribal government and that his contribution could not come at a better time within the discipline of Indian Law.

Against General Law Constitutionalism, Joshua Macey, Ketan Ramakrishnan, Brian Richardson

This Article considers how and under what circumstances the “general law,” a species of unwritten law grounded in legal customs and practices shared across different legal jurisdictions, might be used in modern constitutional interpretation. Constitutional originalists have increasingly argued that central provisions of the Constitution, such as the First and Second Amendments and the Fourteenth Amendment’s Privileges or Immunities Clause, incorporate various bodies of general law. This Article argues that, even if the Constitution did incorporate various bodies of general law, most of those bodies of law have now been emptied of content, and must remain empty without profound changes …

How many amendments are in the Constitution? Americans should be able to know. But whether the Equal Rights Amendment is—right now—part of the Constitution remains controversial. Thirty-eight states have sought to ratify it, several of them after the seven-year deadline in the proposing resolution. Given President Joe Biden’s last-minute claim that the ERA is now the Twenty-Eighth Amendment, in a future administration this lingering debate could provoke a minor constitutional crisis.

This paper, the second in a series of two, focuses on the U.S. legal framework for the marine carbon dioxide removal (mCDR) approach of direct ocean carbon capture and storage (DOCCS). The first explores DOCCS governance under international law and is available here: https://scholarship.law.columbia.edu/sabin_climate_change/271/.

DOCCS aims to remove some of the carbon currently stored in the ocean and thereby enable it to uptake additional carbon dioxide from the atmosphere. DOCCS is still undergoing research, but early studies suggest it could have significant carbon dioxide removal potential. Climate advocates may hope to see dramatic commercial breakthroughs over the next several decades that reshape emissions-intensive components of our everyday lives, such as our dietary choices, household energy use, and transportation habits. Yet transforming these consumer sectors will require not only scientific ingenuity and entrepreneurial ambition, but also nimble competition policy to address complex market dynamics.

Sustainable food production likely necessitates substantial departure from traditional livestock-management practices. Agricultural production currently generates about one-third of global greenhouse gas emissions (“GHGs”). Walt Disney’s films were not simply entertainment, but a use of racial stereotypes as a profit strategy. Even scholarship that explores these tactics and critically analyzes his most problematic misrepresentations do not to consider the role of Walt Disney, as a man, in creating and promoting these narratives. These depictions, while somewhat in line with the culture when he first entered the business, failed to evolve as society changed. Rather, they were deliberate choices to attract white audiences and increase revenue.

Over time, these tropes became socially unacceptable, yet Disney maintained them for public consumption. While Disney and his company …

This report investigates the data collection practices of nine widely used workplace monitoring platforms to determine the extent to which they track and analyze employee activity, behavior, or performance during work, including how these platforms transmit worker information and to which third-parties. This report finds that (1) nine out of nine workplace monitoring platforms studied directly shared identifying worker data to third parties, (2) nine out of nine workplace monitoring platforms studied shared information about workers’ online activities with third parties, and (3) three out of nine workplace monitoring platforms studied utilize features to track workers’ precise location.
