A Nation Of Kings: Judicial Overextension Of Official Immunity And The Abdication Of Responsibility For Our Most Vulnerable Citizens, Adam Schexnayder
A Nation Of Kings: Judicial Overextension Of Official Immunity And The Abdication Of Responsibility For Our Most Vulnerable Citizens, Adam Schexnayder
Missouri Law Review
Imagine a man who cannot speak, cannot walk, cannot feed himself, and cannot clean himself. He has no family to speak of, or if he does, the time and economic burden of his care will jeopardize their own survival. Our society has enacted laws to provide some level of support and care for this man and employs the resources of the state to pursue that goal. Tragically, the man dies in the state’s care due to unquestionable negligence. If his family had the resources to place him in a private facility, basic negligence law tells us the private facility may …
Time And Retribution, Meghan J. Ryan
Time And Retribution, Meghan J. Ryan
Missouri Law Review
Time is missing from discussions on the theory of retribution. A colossal body of scholarship has been devoted to exploring the theory of retribution, or “just deserts,” but much less has attempted to translate this theory into practice, explaining how to determine an actual offender’s desert in real life. The limited scholarship on this topic touches on who might best assess an offender’s desert. For example, should a judge, a juror, or the public itself be making these desert decisions? But there is also a temporal aspect to this decision-making that has thus far largely eluded exploration: When should the …

The Right To Truth In Transitional Justice, Nouran Hassan
The Right To Truth In Transitional Justice, Nouran Hassan
Theses and Dissertations
Transitional justice is sought by nations suffering from legacies of human rights violations. The field of transitional justice stands on four main pillars: truth seeking, criminal justice, reparations and guarantees of non-recurrence. It promotes utilizing legal and non-legal mechanisms to achieve a transition to democracy and the mechanisms employed must relate to, at least, one of its pillars. Truth is considered substantial for transitions to happen. Revealing the truth is believed to be essential for reconciliation and promoting peace. However, in various experiences the truth did not lead to reconciliation and was widely distorted. The approach of the transitional justice …
Disconnected Connection, Dyane O'Leary
Disconnected Connection, Dyane O'Leary
Suffolk University Law School Faculty Works
Lawyers are more digitally connected than ever, but the human side of connection is shifting. In a profession built on relationships, technological transformations from videoconferencing to Generative AI reshape how lawyers converse, empathize, and build rapport. Amid industry calls to prioritize ‘soft’ people skills, lawyers face a growing paradox: tools offering convenience and efficiency disrupt traditional methods of on-the-job training and mentorship from generations past. This Article draws on lessons from an empirical, interview-based study of law students, professional development legal personnel, and senior lawyers to examine interpersonal connection as a modern lawyering skill. Against a backdrop of swirling influences …
Two Justifications For The Major Questions Doctrine, Cass R. Sunstein
Two Justifications For The Major Questions Doctrine, Cass R. Sunstein
Florida Law Review
There are two justifications for the major questions doctrine. The first justification, vigorously offered by Justice Neil Gorsuch, might be described as Lockean; it sees the doctrine as an effort to preserve legislative primacy and to reduce the policymaking authority of the executive branch. On the Lockean view, the major questions doctrine is a clear-statement principle, and it is in evident tension with textualism. The second justification, vigorously offered by Justice Amy Coney Barrett, might be described as Wittgensteinian; it sees the doctrine as an effort to capture Congress’s likely instructions. The Wittgensteinian justification fits comfortably with textualism, and it …

Antitrust & The Immoral Energy Economy, Kristen Van De Biezendos
Antitrust & The Immoral Energy Economy, Kristen Van De Biezendos
Faculty Scholarship
The age of climate change is upon us, but regulations and programs intended to decarbonize the electricity sector have been effectively stymied by utilities defending their monopoly power. The lack of robust antitrust enforcement against the utilities to date is a result of the belief that regulation is sufficient to police monopoly anticompetitive activity, that the natural monopoly structure of utilities makes them a poor fit for antitrust principles, and that the utilities are immune from Sherman Act claims under the state action exemption. But both rationales reflect a misunderstanding of the purpose of public utility law and its preference …

This paper not only analyzes effective strategies for mitigating "cultural discounts" but also challenges the traditional one-dimensional view of …

Voices For Justice: Firsthand Accounts Of Innocent People Fighting For Access In New York’S Post-Conviction Process, Perlmutter Center For Legal Justice At Cardozo Law
Perlmutter Center Reports
In 2018, the New York State Court of Appeals’ decision in People v. Natascha Tiger created an insurmountable obstacle for wrongfully convicted individuals pursuing innocence claims. The ruling held that a guilty plea precluded persons accused of crime from challenging their conviction in the absence of newly discovered, exculpatory DNA evidence. This is a troubling fact given 97% of felony convictions and 99% of misdemeanor convictions in New York State are resolved by guilty plea. The National Registry of Exonerations documented that 24% of all exonerated people across the United States pled guilty to crimes they did not commit. According …

International Review of Humanities Studies
This study explores the moral ontology of law within the framework of Legal Realism, contextualizing law as both a social institution and an institution of justice. Drawing on Joseph Raz's perspectives on practical reason, normativity, and the foundations of norms, the analysis examines how law, as a practical guide, inherently carries moral dimensions in regulating social interactions and pursuing justice. Legal Realism frames law as a dynamic product of human interaction within a social context, while Raz's philosophical insights illuminate the interplay between practical reasoning, normativity, and legal structures. By focusing on the moral underpinnings of legal norms, this paper …

Cross-border business transactions have the potential to be corrupted, especially in the form of bribery committed by actors from different countries and within different jurisdictions. The Indonesian Corruption Law has not regulated how to criminalize Indonesian public officials or certain private companies who bribe officials in other countries or vice versa. Although Indonesia has ratified the United Nation Convention Against Corruption, it has not adopted provision on bribery of foreign public officials. Among the international community, the regulations for bribery of foreign public officials have been started by the US Foreign Corrupt Practices Act of 1977. The United Kingdom also …

The International Court Of Justice And Clean Hands Doctrine: Shifting Approach With Reference To The Certain Iranian Assets Case, Atul Alexander, Tanay Khanna
Indonesian Journal of International Law
States have often invoked the clean hands doctrine (CHD) before the International Court of Justice (ICJ). The prevailing practice among States is to invoke the CHD with the purpose of deeming the assertions of the opposing State as impermissible or challenging the jurisdiction of the court. While the ICJ has constantly refused to uphold any argument based on the CHD, there are judges whose individual opinions have upheld the validity of the CHD. A common trend that is witnessed in cases where the courts have agreed or rejected the applicability of the CHD is when the application is not based …
