The “Blurred Lines” Between Copyright Law And Its Role In The Music Industry, Caroline Mcdonald

This thesis examines the dynamic relationship between copyright law and the music industry by analyzing three landmark cases: Bright Tunes Music Corp. v. Harrisongs Music, Ltd., Williams v. Gaye, and Skidmore v. Zeppelin. Through these case studies, the paper explores how courts assess copyright infringement using the tests of extrinsic and intrinsic similarity, as well as identifies the weight of expert testimony in court, and the role of legal tools such as the inverse-ratio rule. Each case illustrates different implications for artists: from the threat of subconscious plagiarism to the controversial expansion of protectable musical elements, and finally, a shift …

Chevron U.S.A., Inc. v. Natural Resources Defense Council, Inc. is one of the most cited Supreme Court cases in history, with over 18,000 citations in federal courts alone (Merrill, 2012). It has reached doctrinal status and was widely considered a vital precedent, one that guided the fields of environmental and administrative law. However, in June of 2024, the Supreme Court released their opinion in Loper Bright Enterprises v. Raimondo, which overturned Chevron. Incarceration is a life-changing event. It is humbling to be surrounded by three cement walls and a row of metal bars reaching from the floor to the ceiling. Millions of individuals are impacted by the adverse effects of incarceration, but millions more feel the effect of their incarceration as well. This Article seeks to reimagine ways to prevent the circulation of conflict-affected gold and diamonds in the international jewelry market. This Article first examines the existing regulatory framework, and then applies that analysis to public survey data and conversations with industry leaders to create a set of informed proposals using behavioral analytics and modern solutions. This Article proposes increased use of two new technologies, blockchain and lab-creation, as well as a fundamental restructuring of the regulatory framework, including higher standards for gold regulation and an international council specific to jewelry regulation.

A fundamental precept of the law of conspiracy is that all members of a conspiracy are partners in crime. This precept is the rationale for many doctrines of conspiracy law, including the controversial judge-made rule that all members of a conspiracy are vicariously guilty of substantive crimes foreseeably committed by one member of the conspiracy even if the other members did not commit the substantive offense, intend the offense, or aid or abet its commission. This Article describes the forensic accounting and valuation tools available to Delaware litigators in commercial and corporate litigation as well as family law. Further, it details the licensing process and standards applicable to forensic accountants and shows how the methods utilized in this profession can assist litigators in a variety of contexts. Delaware cases in which courts have accepted or limited the use of expert forensic accountant testimony are explored and general principles for utilizing forensic accounting expertise in Delaware litigation are developed. It’s 2009 and Georgia regulators, against the protests of local residents, have approved the construction of two new nuclear reactors in the Shell Bluff community. Located in Burke County, Shell Bluff, an unincorporated community with a majority Black population, is all too familiar with the harmful environmental effects that stem from radioactive waste. It’s June 2020, the height of the COVID‑19 pandemic, and regulators in Georgia have ended the temporary moratorium which prevented utility companies from disconnecting service for customers who have fallen behind on payments. Hearing the term “child abductor” paints a shadowy figure within the mind, immediately invoking disdain and revulsion. But when the perpetrator is one of the parents, the shadow dissipates, and complications arise. These complications turn thorny when the parent absconds with the child to another country entirely, leaving behind the child’s old life—including the remaining parent. The Hague Convention on the Civil Aspects of International Child Abduction (Hague Convention) established procedures to ensure that children who were wrongfully removed from their habitual residence to foreign countries could be promptly returned.

Should restrictions on campaign financing in the United States be laissez-faire or stringent? This debate has been had at levels as high as the Supreme Court and as wide as the legislative chambers of all fifty states. This paper aims to create a broader understanding of campaign finance reform at the state level. Specifically, this paper analyzes state-level data on campaign finance reform adoption, educational attainment, and partisan lean to determine the strength of correlations between these variables. Central Bank Digital Currencies are digital currencies issued by the central bank government of a sovereign nation. It is a unique form of payment currently used by just a few countries that has the potential of transforming the US’s current financial landscape. According to the International Monetary Fund, more than 100 countries are currently developing their own central bank digital currencies. Environmental groups and their allies have seen two of the bedrock statutes of modern environmental law (the Clean Air Act, Clean Water Act) eroded through recent decisions from the Supreme Court. At the same time, political polarization around climate policy- the gap between Republicans and Democrats on whether worsening global warming merits a response- is wider than it has ever been.
Despite these dispiriting headwinds, there are some encouraging counterpoints of recent climate progress in politically conservative communities. The heart of this essay is simply sharing these stories so we can learn from them. I label the advocates who succeeded …

Armed conflicts have a significant and detrimental effect on the climate system, with considerable implications for efforts to mitigate and adapt to climate change and the civilian population. Yet the environmental provisions under the law of armed conflict (LOAC), drafted some half a century ago, struggle to adequately address these concerns. This article assesses the capacity of LOAC to address conflict-driven climate damage and its cascading impacts by characterizing these harms as environmental damage and as injury to civilians. When European settlers first colonized the Americas, claiming Native land as their own, they largely believed their actions to be justified. To Europeans, property rights over land emanated from putting one's labor into that land, "improving" it by removing it from a state of nature. Absent such ''productive use," land had not been claimed and was therefore ripe for the taking. Yet while Native Americans had labored significantly and fundamentally shaped the land around them, European settlers deemed the Americas to be in a state of nature. Rising healthcare costs have contributed to significant medical debt increases for Americans in recent years. One way patients are paying these charges is with a medical credit card. The increase in popularity of medical credit cards can, in part, be attributed to non-profit hospitals’ insufficient charity care offerings. Some hospitals are— themselves—offering healthcare financing products to patients rather than offering charity care. As a result, low income patients often become trapped in a cycle of medical debt. This is the preface to our forthcoming book Advanced Introduction to International Economic Law for Edward Elgar Publishing. The book is unique in multiple ways. It is the first book that addresses the breadth of international economic law thematically, instead of serially by sub-field of law. We examine the history of key sub-fields, their contested functions, and the ways that they disparately address issues of liberalization and market access, discrimination, state regulatory policy space, fairness, governance and dispute resolution. Following the emergence of COVID-19 and resulting civil orders seeking to stop its spread, many businesses filed claims with their insurance providers for “business interruption” coverage, a type of insurance intended to compensate businesses for income lost during a temporary forced closure. When insurance companies roundly denied these claims, many small-business owners filed lawsuits in state courts. Insurance company defendants largely removed these cases to federal courts, and business owner plaintiffs filed to remand back to state court. [Purpose/significance]To explore the direction for provincial governments to further plan data policies, with the aim of providing support for the establishment and improvement of data infrastructure systems in various regions. [Method/process] This article adopts the method of text similarity calculation to compare the policy texts of 22 provinces' data policies released before 2023 with the "Twenty Data Articles", and selects the "Twenty Provincial Version Data Articles" of 8 provinces for policy evaluation research. Distribution Comparisons Of Eac Cost Growth For Aircraft Work Breakdown Structure Elements, Kyle P. Marquis, Edward D. White, Brandon M. Lucas, Robert D. Fass, Jonathan D. Ritschel, Shawn M. Valentine

This article analyzes and investigates the distribution of cost growth of the Estimate at Completion (EAC) for the Work Breakdown Structure (WBS) elements of approximately 60 historical United States Acquisition Category I Research, Development, Test and Evaluation aircraft programs. Using the method of maximum likelihood in conjunction with the Akaike Information Criterion, the authors suggest that both the lognormal and Weibull distributions provide relatively good fit to EAC cost growth, with the lognormal slightly edging out the Weibull. Founding Father and Federalist Paper author Alexander Hamilton opined that “clemency was vital to temper the harshness of criminal codes because ‘without an easy access to exceptions in favor of unfortunate guilt, justice would wear a countenance too sanguinary and cruel.’” Hamilton and his contemporaries understood the need for a justice system that balanced strict enforcement of the law with the ability to recognize individual circumstances and extend compassion where warranted. Without the ability to make exceptions for people who are guilty but nonetheless deserving of compassion, the justice system would appear excessively harsh, violent, and unkind. The justice system …
