Modalities, Anti-Modalities, And The Social Psychology Of Persuasive Constitutional Argument, Asma T. Uddin
Catholic University Law Review
Constitutional argumentation traditionally relies on modalities such as text, history, doctrine, and structure. However, the exclusion of certain “anti-modalities”—such as policy arguments, fundamentalist views, and emotional appeals—can create a “resonance gap” between legal reasoning and public understanding. This paper explores how social science insights, particularly from cultural cognition theory (CCT) and moral foundations theory (MFT), can help bridge this gap by guiding the strategic incorporation of pathos and moral intuitions into constitutional arguments. Techniques such as self-affirmation, expressive overdetermination, and aporetic reasoning can make opinions more persuasive and inclusive without compromising legal integrity. Re-Evaluating Fulton V. City Of Philadelphia: A “Narrow” “Wisp” Of A Decision Or Free Exercise “Bedrock?”, Mark Rienzi

In Fulton v. City of Philadelphia (2021), a unanimous Supreme Court held that Philadelphia violated the Free Exercise Clause by excluding Catholic Social Services from participating in its foster program because CSS would not certify same-sex couples. Both supporters and critics of the Court’s decision publicly characterized the decision as “narrow” and noted that Philadelphia (and other governments) can easily sidestep Fulton and continue excluding religious providers from foster and adoption programs.
Four years later, the evidence shows that Fulton is anything but narrow. In Philadelphia and in other jurisdictions, Fulton has played a strong role in ending litigation against …

Prenatal Personhood, State Duties, And Congress’S Abortion Power Under The Fourteenth Amendment, David R. Upham

Many antiabortion jurists have contended that by its original meaning, the Fourteenth Amendment not only (1) recognizes the personhood of prenatal human beings, but also (2) requires states to have and enforce the antiabortion laws necessary to the equal protection of these prenatal persons, and even (3) empowers Congress to pass remedial antiabortion laws where the state fail to protect such persons.
In this essay, I will contend that the Amendment does indeed recognize the personhood of prenatal human beings, but largely leaves with the states the authority to determine the scope of the protection to be afforded such persons. …

This comment explores the long and inconsistent history of the Necessary and Proper Clause and its unique role as both a grant of power to Congress and a limit on the outer reach of the federal government. The federal government is in theory one of limited powers; however, this promise of the Constitution cannot be truly recognized without developing a robust framework for applying the Necessary and Proper Clause as a reliable source of federal power. This paper addresses the issue of personal data transfers from a territory within the European Union to the People’s Republic of China (hereinafter: China). The underling research was designed to assess the privacy policy provisions on data transfer to third countries, particularly China. The analysis covered the privacy policies of selected Chinese entrepreneurs operating in the territory of the European Union, namely Xiaomi, Aliexpress and WeChat. These entities belong to the most popular Chinese businesses present in the European market. The analysis corroborated that ‘contractual clauses’ were most commonly used out of the ‘appropriate safeguards’ covered by Article 46 GDPR. …

In recent years, Justices Thomas and Gorsuch have expressed a strong interest in reconsidering, and perhaps overruling, the landmark defamation decision, New York Times Co. v. Sullivan. The Court’s defamation jurisprudence has undergone many changes since the landmark case was decided, namely, the Court has since adopted a test known as the “public concern” test. Though adopted by only a plurality of the Court, the “public concern” test has been integrated into the defamation decisions of lower federal courts and state courts. This comment encourages the Court to abandon any push toward the wholesale abandonment of Sullivan and, instead, …

There are growing challenges to free speech and academic freedom on American college campuses. There is pressure from both the political left and the political right to suppress controversial speech on campus, and there are calls to restrict speech that come both from members of the campus community and from those beyond the campus gates. In this difficult environment, it is essential that academics both understand the principles of academic freedom and campus free speech and work to advocate for them.

The article analyzes the discrepancies between the consumer protection standard established by Directive 2005/29/EC and the practices of Polish courts in cases concerning unfair commercial practices. The primary goal of the Polish Act on Counteracting Unfair Commercial Practices is to prevent dishonest actions by entrepreneurs, and the proper application of the law is essential for achieving this goal. However, Polish courts face significant challenges in this regard. Several factors contribute to this issue. Over one hundred years ago, Ohio was at the forefront of women’s political participation. In 1872, Victoria Woodhull became the first woman to run for president. In 1922, six women were elected to the Ohio state legislature for the first time, and Florence Allen was elected to the Ohio Supreme Court, making her the first woman to be elected to any state supreme court in the nation. This research looks at where the state stands now in the number of women running for office, their success rates, and the impact of having a woman at the top of the ticket. …

Memory evidence and forensic evidence are both residual traces of an event. While traditional trace evidence (hair, fiber, blood, fingerprints, etc.) is left behind by a perpetrator, memory evidence resides in a person’s mind, usually that of a victim or witness. Both types of evidence have the possibility of contamination; given that memory evidence cannot be bagged and tagged like other types of forensic evidence, it is especially susceptible to contamination which can undercut its ultimate reliability. When election procedure is challenged, courts must balance First Amendment rights against states’ prerogative to regulate elections. Residency requirements are an election procedure that require petition circulators be a resident of the jurisdiction. Residency restrictions on petition circulators—who collect signatures to achieve ballot access—weigh too heavily against First Amendment rights. In jurisdictions where residency requirements remain in place for initiative ballot access, voters are unconstitutionally shut out of the political process.

Scholarship on election-administration measures (like voter ID laws) and campaign-finance laws has been siloed. American political affiliations, in their current form, dictate that liberals support campaign-finance restrictions and oppose voter ID laws, and vice versa for conservatives. But the Court has analyzed both measures using the similarly odd lens of appearances—the perception of electoral integrity in voter ID cases and the perception of corruption in campaign-finance cases. Yet despite the nearly identical justifications for campaign-finance and election-administration measures, the Court has treated these claims quite differently. Election-administration laws receive nearly automatic deference, whereas campaign-finance laws are routinely overturned. This Article …

In this Article, we analyze the federal disqualification statute applicable to federal judges, magistrates, and Justices of the Supreme Court as compared to the disqualification provisions of the United States Supreme Court Code of Conduct and detail the ways in which the standards contained within the Code are contrary to law and history. To provide proper context, we examine the history, case law, and statutory framework that have created the current standards of judicial disqualification for all Article III judges and Justices.
