New Zealand Security Agencies’ Secrecy, Accountability, And Transparency In The Modern Era, Ben Amata
Secrecy and Society
New Zealand’s security agencies need to balance conflicting missions of secrecy, accountability, and transparency in conducting national security government operations. Citizens expect protection without violating their liberties and for security agencies to act effectively and legally. From public revelations about the agencies and government reform efforts, the agencies evolved from almost total secrecy to greater accountability and transparency since World War II. This study employs a historical methodology, which examines primary source documents to reveal the history of secret behavior and to reform the New Zealand Security Intelligence Service and the Government Communications Security Bureau.

Project 2025 supporters have been appointed to prominent federal offices in the second Trump Administration. This includes, most notably, the Office of Management and Budget, for a key strategy of implementing the Project’s goals is manipulation of federal funding. This Essay explores what this might mean for women’s rights and suggests a legal theory with which to challenge Project initiatives. Project 2025 repackages a platform that is fully anti-feminist. Women politicians have traditionally faced greater challenges when running for office than their male counterparts. These include less encouragement from political gatekeepers, fundraising obstacles, and voter skepticism about their abilities—particularly among men. Nevertheless, women have made substantial advances in the electoral arena, including increasing their numbers in Congress. Some of these gains can be attributed to changing voter attitudes, the mobilization of female campaign contributors, and recent female politicians learning from the successes of their predecessors. Like a hamster wheel, the “virtuous cycle” of data collection, collation, and computation spins to create algorithms to assist modern business operations. Companies accumulate data by the terabyte with hopes that their army of data scientists can make sense of all the noise using machine learning. Potential profits encourage companies to seek out data—sometimes unlawfully through collusion. The use of unlawfully collected data in algorithms harms competition. Such data provides a competitive edge that is not accessible to all marketplace participants. Antitrust laws can police unlawful data sharing, but existing remedies are not effective for restoring competition.

This article examines how personal data are regulated in emerging modelling and simulation environments, including computer games, mobile apps, and digital twin platforms. This article centers on a specific type of simulated and modelling environment, namely the metaverse. This article considers the privacy issues that arise when people subscribe to and participate in modelling and simulation platforms where vast amounts of data are collected, disclosed and stored. Such data may be vulnerable to misuse by the platform and third parties. Notwithstanding the increasing prevalence of artificial intelligence or AI in the legal field, Chief Justice Roberts recently predicted that “human judges will be around for a while.” The reason is that at this time, AI cannot perform judicial mental functions as well as human judges can in deciding cases. Yet, instead of having AI replace human judges, some have explored whether AI can be used to assist human judges with their adjudicative and administrative responsibilities.

In 2021, Congress passed the Corporate Transparency Act (“CTA”) to combat money laundering, terrorist financing, and other illicit activities by requiring certain business entities to report personal information about the individuals who own or control the business and those who helped create or register the business. The reported information will be held in a federal database controlled by the U.S. Department of the Treasury’s Financial Crimes Enforcement Network and can be disclosed upon request by domestic and foreign governmental agencies and financial institutions.

The looting of works of art during World War II represents one of the most significant cultural thefts in history, with the Nazi state seeking to enrich itself by seizing property of the people it persecuted. The Nazis systematically seized thousands of invaluable works of art and cultural assets from museums, galleries, and private collections across Europe. “Fighting the Hypothetical: Why Law Firms Should Rethink the Billable Hour in the Generative AI Era” analyzes how the emergence and adoption of generative artificial intelligence (GenAI) will fundamentally disrupt the traditional billable hour model that has dominated the industry since the 1960s. Professor Rapoport and Mr. Tiano contend that GenAI’s ability to perform routine legal tasks quickly and accurately will force law firms to shift away from billing structures based primarily on time spent (or inputs) and toward models that better reflect client value (or outputs).

When Can A Lawyer Lawfully Use Threats When Negotiating?, James M. Fischer

This Article focuses upon a basic negotiation device—a threat, used in a particular context—threats contained in settlement demand letters. In some, but not all, cases, however, the threat may be deemed a crime (extortion), in which case, the lawyer may be subject to sanction (criminal or civil liability, professional discipline) for making the threat. This consequence has, however, been largely ignored in academic literature. That is unfortunate, for it appears that many lawyers are unaware of the risks negotiation threats present because the risk is not well defined in the professional codes lawyers would normally look to for guidance.

Clients engage lawyers for many reasons. Regardless of the circumstances, however, the lawyer and the client need to agree on the scope of the lawyer’s representation, meaning the legal services the lawyer will perform for the client. The client must agree to and understand the scope of the lawyer’s representation as aspects of establishing her objectives for the matter and thereafter evaluating whether the lawyer is achieving those objectives. Given the Trump administration’s continued and varied assaults on the First Amendment, it is vital to monitor those attacks and then realize the gravity of the “sweeping and draconian sanctions ” imposed by unconstitutional executive fiat. Vigilance is especially important, as New York Times investigative reporter Michael S. Schmidt has noted, because “Mr. Trump has employed tactics including lawsuits, executive orders, regulations, dismissals from government jobs, withdrawal of security details and public intimidation to take on a wide range of individuals and institutions he views as having unfairly pursued him or sought to block his agenda.”
