Introduction

When Fred Korematsu stood in the San Francisco federal district court in 1942 to challenge the constitutionality of a criminal charge that he had violated an exclusion order issued pursuant to Executive Order 9066, he was represented by pro bono counsel funded by the San Francisco office of the American Civil Liberties Union (ACLU). But just four days after Fred’s attorneys filed a motion to dismiss his criminal charges, ACLU director Roger Baldwin—wanting to avoid angering President Roosevelt—conveyed the “national board’s decision to prohibit test cases from challenging Roosevelt’s authority to issue Executive Order 9066.” Instead, local ACLU affiliates …

Why Liberal Feminist Law Fail Women Volunteers In India And The United States: Between Activism And Complicity, Amanda L. Stephens Apr 2025

Why Liberal Feminist Law Fail Women Volunteers In India And The United States: Between Activism And Complicity, Amanda L. Stephens

Presentations - 2025

In this section from my book, Women Volunteers in India and the United States: Between Activism and Complicity, I examine the potential and limitations of liberal-feminist laws in India and the United States to achieve gender equality. Liberal feminism, a strand of feminist thought, argues that gender equality can be achieved by reforming existing legal and political systems. For instance, a liberal-feminist approach to eradicating workplace sexual harassment might involve passing laws like Title VII of the Civil Rights Act of 1964, which allows employees to seek redress for harms caused by such practices.

Talking Trash: The Development Of International Legal Governance Over Marine Plastic Pollution, Olivia B. Berryman Apr 2025

Talking Trash: The Development Of International Legal Governance Over Marine Plastic Pollution, Olivia B. Berryman

Global Tides

Increasing amounts of marine plastic pollution entering into the ocean endangers the lives of sea animals, harms the health of human seafood consumers, degrades the marine ecosystem, and contributes to climate change. Despite these consequences, there remains no international legally binding treaty that is solely devoted towards mitigating marine plastic pollution. While there are current treaties in place that have created some regulations to control the entrance of marine plastics into the ocean, none have achieved significant reduction and prevention of the issue due to flaws such as weak enforcement mechanisms and lenient restrictions on ocean dumping. Thus, this research …

Book Review: Jill Elaine Hasday, We The Men: How Forgetting Women's Struggles For Equality Perpetuates Inequality, Taylor King

ConLawNOW

This essay reviews Jill Elaine Hasday’s book, We the Men. It explains how Hasday traces key historical cases and stories of women’s demand for equality that have been forgotten. These important histories include the Nineteenth Amendment, Title VII equal employment, and the Equal Rights Amendment, among others. The book makes the claim that erasing women’s history is problematic for protecting gender equality in the future.

Marvin Owens v. Gary Schuette

On Appeal from the United States District Court for the Eastern District of Michigan Case No. 2:24-cv-10787

From the Summary of the Argument

This appeal requires the Court to correct an error below—derived from a recently abrogated error in this Court’s own precedent—that denies the full remedial protections enacted to safeguard religious exercise under RLUIPA. The only question is whether RLUIPA allows courts to award damages against counties and their officials. The only answer—especially following the Supreme Court’s unanimous interpretation of an identical provision in RFRA—is yes.

As experts in constitutional law, legal ethics, and the history of the legal profession, among other fields, we have a significant interest in ensuring that the principles of free speech, freedom of association, the right …

Securing Biometric Data, Alyssa F. Carroll Apr 2025

Securing Biometric Data, Alyssa F. Carroll

Cybersecurity Undergraduate Research Showcase

Biometric data has been widely adopted across various sectors, including digital identity, artificial intelligence (AI), border control, digital wallets, and national identification systems. While biometric identifiers—such as fingerprints, retina scans, and facial recognition—offer reliable and convenient authentication, they also raise significant concerns regarding privacy and security. This paper examines how biometric data is stored, the vulnerabilities it faces, and the most effective methods for safeguarding it. By highlighting the critical importance of biometric data protection, this study reviews current research on approaches, strategies, and policies that enhance security while preserving the functionality and efficiency of biometric systems.
