America Tries To Come To Terms With Terrorism: The United States Anti-Terrorism And Effective Death Penalty Act Of 1996 V. British Anti-Terrorism Law And International Response, Roberta Smith

Cardozo Journal of International and Comparative Law

The note examines the legal and policy responses to terrorism, focusing on the tension between combating terrorism effectively and safeguarding civil liberties. It critiques the Anti-Terrorism and Effective Death Penalty Act of 1996 (AEDPA) and comparable international measures, arguing that while these laws aim to address the growing threat of terrorism, they risk infringing on constitutional rights and international cooperation. An Analysis Of Two Federal Structures: The Articles Of Confederation And The Constitution, Douglas G. Smith

San Diego Law Review

This Article compares the Articles of Confederation and the Constitution to gain insight into both the Constitution and the contemporary federalism debate. The author employs textual analysis to the documents underlying both federal structures and discusses other models of political union which influenced the framers. The author concludes that the fundamental difference between the Articles and the Constitution is that the latter represented a compact among both the people and the states, whereas the former represented a compact among states alone. Facts: The petitioner, who had been growing a beard for many years, requested to exchange his protective kit and gas mask, which had been provided to him before the 1991 Gulf War, for a new kit, designed for those with beards. In order to obtain the special kit, the Civil Defense Authority required the petitioner to sign a statement that he grew a beard for religious reasons, in accordance with the applicable Civil Defense Regulations. UC Law SF International Law Review

A nation can exercise two types of jurisdiction: territorial and extraterritorial. The exercise of extraterritorial jurisdiction elicits controversy because of possible international law conflicts. The United States applies a presumption against extraterritorial application of domestic law. However, the presumption of extraterritorial application ignores the propriety of its use.

This Note revises the presumption upon reviewing various statutory and case law applications of extraterritorial jurisdiction in the United States. This Note also proposes a new paradigm for proper use of extraterritorial jurisdiction. Courts often succumb to the temptation to analogize new electronic media to present technologies since the courts can rely upon already existing models. However, the arrival of cyberspace and the World Wide Web has stretched the concept of linking legal precedents to actions to the breaking point. Any attempt to map existing legal metaphors, based on mechanical similarities, onto territory as unknown and changeable as cyberspace is difficult. This paper seeks to defend United States intervention in states that violate international human rights law. To explain the modem framework behind the legal justifications for intervention, it is necessary to review the historical development of international human rights law, the concept of sovereignty, and the continuing conflict between the two principles.
