Representational Standing: U.S. Ex Rel. Stevens And The Future Of Public Law Litigation, Myriam E. Gilles

In May 2000, the Supreme Court handed down its decision in Vermont Agency of Natural Resources v. U.S. ex rel. Stevens, a seemingly predictable 11th Amendment case. In upholding the plaintiff's Article III standing to bring that case, however, the Court suggested a theory of "representational standing" that holds the potential to radically transform the entire body of law governing the ability of private citizens to seek, through the federal courts, the vindication of broadly-held public interests.

The purpose of this research was to produce a set of prescriptions that will facilitate the process of identifying a USAF command's set of core competencies. Theoretical approaches to outsourcing show the need for an organization to identify its own set of core competencies; however, there seems to be no set way for this identification process to be accomplished. This research will provide critical information to approach this important task. USAF commands that can identify their core competencies (and subsequently act on them) will become leaders in the Department of Defense (DoD), with the potential to reshape the DoD through …

"There is no information more personal and private than one's genetic information" – one's DNA. Under the Human Genome Project, mapping of the human genetic code is under way. From this mapping of genetic code, information such as the likelihood of developing cancer, diabetes, etc. would certainly become available. Although this information may be helpful to one's health providers, companies and governments may begin to use this information to discriminate individuals based on their genetic predispositions. The World Trade Organization (WTO) administers, enforces, and decides international trade disputes by establishing uniform rules of trade engagement designed to minimize trade wars. Countries that fail to abide by the WTO rules can be taken to the WTO courts and face eventual sanctioned retaliation. Without such rules, global economic competition can be as fierce as the most devastating battle and, as history has shown, can be the catalyst for war.

The South Carolina Secession Statement Of 1860 And The One Florida Initiative: The Limits Of A Historical Analogy And The Possibility Of Racial Reconciliation, Martina D. Carcieri

In Part II, we shall examine the Secession Statement in order to understand more fully the case it makes against the northern states and national government. Only then shall we be able to appreciate why this legally compelling document is ultimately not convincing. With that foundation, Part III examines One Florida opponents' arguments for preferences by government and the weaknesses of those arguments. With this background, we shall see in Part IV how One Florida opponents' position actually resembles that of South Carolina more than that of the Northerners, and ultimately embraces not civil society, but instead a state of …
