While the article Antiterrorism Military Commissions: Courting Illegality was set for publication, the Department of Defense formally issued its first set of Procedures for Trials by Military Commission of Certain Non-United States Citizens in the War Against Terrorism. The President's November 13th Military Order had set up several per se violations of international law. Instead of attempting to avoid them, the DOD Order of March 21, 2002 continued the violations, set up additional violations of international law, and created various rules of procedure and evidence that, if not per se violative of international law, are highly problematic. The Era Of Globalisation As A Challenge To International Law, Stephan Hobe

Duquesne Law Review

The author explores the effects of globalization on international law. Considering the technological advancements of the 20th century propelling globalization, the Article first recounts the history of international law from independent nation-state sovereignty to an international law of cooperation. Next, the author discusses the roles that nongovernmental organizations and other non-state actors play in international law, and how sources of international law may result. Finally, the author concludes that international law must undergo fundamental changes to adapt to a new globalized international system.

African Private Security Companies And The Alien Tort Claims Act: Could Multinational Oil And Mining Companies Be Liable?, Jennifer L. Heil

Northwestern Journal of International Law & Business

This paper focuses specifically on the possible liability under the ATCA of multinational oil and mining companies operating in Africa. First, it will examine the relationships between the multinational oil and mining companies, private security forces and African governments. In doing so, it will describe the actual activities and operations of the private security forces in conjunction with the oil and mining corhpanies. Second, this paper will outline the elements of liability under the ATCA.
