Abstract

This article relates the story of the paths of Roman law from the periods immediately before the gradual dissolution of the Western Roman Empire following the death of Justinian I in 565 A.D. through the several centuries thereafter. This period witnessed an acceleration of the absorption of Roman law into the customary law of the various Germanic groups that now occupied and ruled the former Roman territories, and the recitation of such new law in the form of new law codes promulgated by three major Gothic groupings: the Lombards, the Burgundians and the Salacian Franks.

The Imaginary Connection Between The Great Law Of Peace And The United States Constitution: A Reply To Professor Schaaf, Erik M. Jensen

This article challenges the politically correct theory advanced in a 1989 article by Gregory Schaaf, “From the Great Law of Peace to the Constitution of the United States: A Revision of America’s Democratic Roots.” Professor Schaaf argued that large parts of the U.S. Constitution were based on the Great Law of Peace, the founding document of the Iroquois Confederacy. This article points to the lack of primary authority supporting such a counterintuitive proposition and questions the likelihood that Iroquois principles could have silently influenced American founders. Agreeing To Disagree: Cultural Relativism And The Difficulty Of Defining Terrorism In A Post-9/11 World, Sami Zeidan

Paradoxically, in a post-9/11 world where there is an unprecedented international joint response to counter-terrorism, there is still no universal, permanent and comprehensive definition of terrorism. This essay exposes the legal and political issues arising from the tension created between the universal agreement to coordinate counter-terrorism efforts on the one hand, and the proliferation of culturally relativistic definitions of terrorism on the other.

Parolee And Police Officer Perceptions Of Prison Gang Etiology, Power, And Control, William Henry Richert

Examines the attitudes and perceptions among parolees, and police officers on why inmates join prison gangs, how powerful they are, and their power and control in prison. Data was gathered from 250 surveys distributed to a group of parolees at an undisclosed southern California municipal police department jail, and 250 surveys distributed to police managers attending the FBI National Academy in Quantico, Virginia. Results of this study validated the hypothesis that there is a significant difference in attitudes and perceptions of parolees and police officers of why inmates join prison gangs and the power and control gang inmates have in …

Federal Criminal Law And Tribal Self-Determination, Kevin Washburn

Under the rubric of "tribal self-determination," federal policymakers have shifted federal governmental power and control to tribal governments in nearly all areas of Indian policy. Normatively, this shift reflects an enlightened view about the role of Indian tribes in Indian policy. As a practical matter, it has also improved services to Indians on reservations by placing functions with tribal service providers who are more knowledgeable and more accountable than their federal counterparts. Despite broad adoption of self-determination as the dominant federal policy, felony criminal justice on Indian reservations has remained an exclusive federal function, and a highly ineffective enterprise, according …
