This article explores the proper classification of Israel’s current conflicts with Hamas and Hezbollah as international or non-international armed conflicts. It discusses the different possibilities of how the international humanitarian law of international or non-international armed conflict applies to those conflicts and whether and to what extent the international humanitarian law of military occupation applies to the conduct of Israel Defence Forces in the Gaza Strip and Lebanon. It also explains why the proper classification of the conflicts still matters and is not only an intellectual exercise for scholars or students. The rapid proliferation of foreign agent laws globally has become a hallmark of rising authoritarianism, with these laws weaponized to suppress dissent and stifle civil society. While the post-World War II study of legal transplants focused on liberal legal orders, the rise of authoritarian regimes has introduced a new dimension: the transnational movement and adaptation of authoritarian legal frameworks, or authoritarian transfers. This Article fills a critical gap by developing an analytical framework to distinguish authoritarian transfers from democratic ones, using transfer theory, a central theme in comparative law that explores how laws travel, adapt, and transform within new social …

Iran has invested heavily in proxy militias since the regime's founding in 1979. In the decades that followed, groups such as Hezbollah in Lebanon, Shi'a militias in Iraq and Syria, and the Houthis in Yemen have projected Iran's influence across the region. Today, Iran's proxy network is considerably weakened due to Israel's military actions following October 7, 2023, and the fall of the Assad regime in Syria. Yet the Houthis' attacks on Israel and against Red Sea shipping demonstrate how Iran's support to these groups continues to facilitate their conduct in violation of international law. Artificial intelligence (AI) is quickly transforming many professional activities, and the electric grid has already started to see adverse impacts from its use, such as the burgeoning demand for electricity from data centers. This Article acknowledges these impacts, but also demonstrates that AI can be put to beneficial use on the grid. It proposes and describes a specific use of AI: assisting citizen intervenors in public utility commission (PUC) proceedings, who currently face barriers to participation due to the technical complexity and confidentiality imposed by monopoly utilities. Regulating Government Statements Regarding Disinformation On Social Media, Michael J. Marando

The United States saw in the 2016 presidential election how Russia used social media to spread disinformation. Russia engaged in similar conduct during the lead-up to its full-scale invasion of Ukraine in 2022 and, most recently, during the days before the 2024 U.S. presidential election. An interesting development, however, has been the U.S. government’s issuance of public statements countering these disinformation attempts. This Article argues that such public statements are quite helpful, both in countering the disinformation and allowing social media companies to legitimately enforce their content. The Siren Song Of Territoriality, Robin J. Effron, Alan M. Trammell

Territoriality—the theory that a state’s physical borders determine its power and sovereignty—boasts a long, venerable history. For centuries, it served as the dominant political theory for myriad ideas. It defined a wide range of doctrines, including personal jurisdiction, choice of law, and prescriptive jurisdiction. By the middle of the twentieth century, though, this rigid territoriality no longer described or responded to the challenges of a society that had grown increasingly mobile and interconnected. Courts replaced inflexible territorial theories with more functional theories rooted in fairness and state regulatory interests.

In addition to regulation of securities market issuers, the Securities & Exchange Commission (SEC) is also responsible for regulation of those entities that provide the networks, either electronic or physical, that enable the functioning of our securities markets. On February 9, 2022, the Commission published a Release for Cybersecurity Risk Management for Investment Advisers, Registered Investment Companies, and Business Development Companies containing proposals that, if adopted, would establish a new cybersecurity incident reporting and disclosure regime and require registered investment advisers (“advisers”) and investment companies (“funds”) to implement policies and procedures designed to address cyber risks. Environmental destruction in conflict zones is an escalating global crisis that directly undermines climate justice and ecological stability. This policy paper examines the concept of ecocide through the lens of the war on Gaza, where the deliberate or reckless targeting of natural resources has caused severe and lasting damage to water, soil, air, and biodiversity. The Gaza case reveals how warfare can accelerate climate change, destroy carbon-absorbing ecosystems, and leave communities with uninhabitable land and poisoned water supplies. Outer space may be the last domain where States largely lack the capability to use coercive force as an instrument of State control. In all areas of the globe, major powers have militaries and police forces that far exceed the capability of even the largest corporations. As corporations take an increasingly large role in outer space commerce it is likely that these private actors will develop a capacity to use force that quickly surpasses even the most powerful States.

This report documents attacks on civilians and objects essential for their survival in Sudan. It concludes that both parties to the conflict violated international human rights and humanitarian law, with most violations amounting to war crimes. The Rapid Support Forces’ conduct may also constitute crimes against humanity, including persecution and extermination. The report calls for accountability and sets out a roadmap for justice.

This article argues that Russia’s Arctic land forces have been weakened by the Russia-Ukraine War and NATO’s northern expansion, creating a strategic window for Western militaries to bolster their Arctic capabilities. Unlike existing studies that focus on maritime operations and the Northern Sea Route, it integrates technical assessments of ground-based Arctic platforms with analysis of military-district reforms. Using a mixed methodology that incorporates equipment specifications, Russian government documents, media reports, and NATO strategic-response evaluations, this article constructs a comprehensive baseline understanding of Russia’s Arctic land-force potential and readiness. This article is the third installment of a three-part series on AI-enabled weapons and human control. Artificial intelligence (AI) is shaping debates about military technology by challenging the role of human decision-making in the use of autonomous weapon systems (AWS). This article argues that effective governance of AI-enabled AWS requires moving beyond narrow conceptions of “meaningful human control” and instead recognizing a network of embedded human judgment throughout the weapon system’s lifecycle. The 200th anniversary of the foundational Indian law decision Johnson v. M’Intosh has come and gone, with many scholars contributing criticism and commentary. The dominant focus has been the case’s notorious embrace of the so-called “doctrine of discovery,” an odious theory for rationalizing European nations’ claims of superior rights to lands occupied by Indigenous Native American peoples. Commanding less attention, however, is the Johnson decision’s core protective legal feature, i.e., its reinforcing the United States government’s duty to guard against the alienation of Indian lands through private, unauthorized acquisitions.

At the center of the emergence of artificial intelligence (AI) and autonomous weapon systems (AWS) is the challenge of human control. AI has the potential to reshape the boundaries of military capabilities. In particular, the increasing sophistication of AWS necessitates a deep examination of the balance between machine autonomy and the role and requirements of human decision-makers. In pursuit of this balance, the concept of meaningful human control emerged. Donald Trump’s election as president during November 2024 results in perhaps the most dramatic philosophical change in approach to governmental regulation in over ninety years. The Great Depression of the 1930s created a need for regulatory reform and resulted in the advent of such new regulatory frameworks as the U.S. Securities and Exchange Commission (SEC). In April 2024, Israeli airstrikes were directed at the Iranian consulate building located in the capital city of Syria, Damascus. The Israeli-Iranian relationship has escalated significantly, shifting from a diplomatic partnership to severe hostility over the course of almost fifty years. This article seeks to examine the legal implications of the Israeli attack on the Iranian consulate building by considering the United Nations Charter and the Vienna Conventions, as well as to analyse the responses of the Iranian government and the international community.
