The Modern Utility Of Quasi In Rem Jurisdiction, Paul D. Carrington

Professor Carrington examines the proposed amendment to the Federal Rules of Civil Procedure that would confer quasi in rem jurisdiction on the federal courts and concludes that it should be rejected. Arguing that the expansion of the concept of personal jurisdiction has removed most of what justification there once was for quasi in rem jurisdiction, the author maintains that the latter jurisdiction often provides only limited and uncertain judgments for local plaintiffs while compelling nonresident defendants to litigate in an inconvenient forum, and herefore should not be made available in the federal courts merely to bring their practice into conformity …

This article is designed to help fill a gap in the literature and to warn government attorneys, particularly, about some questionable asides in the Hannah case. We shall not deal with record-keeping requirements or with agency inspections, subpoenas duces tecum, and related search and seizure problems. The focus instead is on the subpoenaed witness; that is, a man who knows that force may be used against him unless pursuant to government command he appears and answers questions. We examine several rights that may protect the witness; and we shall also ask whether the agencies, to discharge their governmental duties, truly …

In contrast with the previous lectures in this series on the Rule of Law, we are today not concerned with how the Rule of Law operates in a highly organized modem state like our own United States; but are turning instead to the world-wide community (or perhaps more properly international arena or international sphere of action, since the very word "community" may over-emphasize the degree of common sentiment!), in which the present role of the law is far less than within the state. This research project, presented by Caroline Drane in 1961, examines the regulatory framework and rating procedures of the Interstate Commerce Commission specifically concerning common motor freight carriers. The study utilizes the legal case of Watson Bros. Transportation Co., Inc. regarding the transport of meats and packinghouse products to illustrate how the Commission manages rate control and the resulting tensions between the trucking and railroad industries. Historically, the regulation of motor carriers through the Motor Carrier Act of 1935 was driven by intense competition and the need for a coordinated national transportation system rather than the monopolistic concerns that prompted railroad …

The recent congressional foray into the affairs of the Port of New York Authority has dramatized a growingly menacing attitude toward interstate compacts and agencies even while they have become increasingly indispensable arms of state government. In asking for a clarification of the nature of Congress' interest in the interstate compacts, Professor Leach urges a greater exercise of federal restraint. "Compromise and adjustment, not challenge and counterchallenge, are basic to a strong federal system."

The President of the United States has touched off a great debate with his recent declaration that the Constitution prohibits federal aid to church-related schools. From an examination of the cases and American traditions as well, Professor Manning concludes that nothing in the Constitution, in case law or in history precludes aid to church-related education in any form or at any level.
