Legal Education: A More Optimistic View, Robert B. Mckay
Vanderbilt Law Review
While few would disagree with Dean Forrester's statement that"America is now in the midst of an attempted revolution," several questions naturally arise. Dean Forrester does not identify the nature and goals of the "attempted revolution," but the inference is that he disapproves. One wonders whether he objects to change because it challenges the status quo; whether he disagrees with the direction of the proposed change; or whether he opposes the method, particularly the abruptness, with which change is being forced upon us. Each possibility merits response.
Change Versus the Status Quo. It would be unfair to Dean Forrester to suggest …

Recommendations For A United States Position Regarding Delimitation Of The Outer Boundary Of The "Legal" Continental Shelves, Brian K. Hannula
Recommendations For A United States Position Regarding Delimitation Of The Outer Boundary Of The "Legal" Continental Shelves, Brian K. Hannula
Marine Affairs Theses and Major Papers
The Convention on the Continental Shelf has come under attack because it does not establish a precise outer boundary for the "legal" continental shelf. It is the author's opinion that the United States should propose or support a revision of the Convention which would rectify this situation. A suitable delimitation proposal must have considerable domestic support and should represent the best compromise between opposing domestic views. A proposed revision of the Convention must, also, have strong international support if it is to be adopted. Each nation will determine a preferred delimitation which depends on the configuration of its own continental …

Labor Law - Federal Courts - Labor Management Relations Act, 1947 - Suits Under § 301(A) To Enjoin Strikes In Breach Of A No-Strike Agreement, Richard I. Thomas
Duquesne Law Review
The Supreme Court of the United States has held that a federal court may enjoin a strike which violates the no-strike provision of a collective bargaining agreement if that agreement contains a mandatory grievance-arbitration procedure.
Boys Markets, Inc. v. Retail Clerks Union, Local 770, 398 U.S. 235 (1970).
In the Boys Market case, the Supreme Court of the United States once again considered the effect of § 4 of the Norris-LaGuardia Act on an action brought in federal court under § 301(a) of the Labor Management Relations Act, 1947 to enjoin a strike which violates the no-strike clause of …

An Introduction To Riot Legislation, Jerold H. Israel
Book Chapters
My speech will provide an introduction to criminal code legislation specifically pertaining to riots and a brief description of our recent experience with riots. Hopefully, this description, supplemented by the film on the Detroit riot, will provide an appropriate factual background for both the remainder of my own talk and the analyses of proper police procedures during riots (and other civil disorders) to be presented by Major Brown and Professor Martin.
