Early in 1978 the Carter Administration implemented a trigger price mechanism (TPM) to aid the distressed United States steel industry. Although the TPM by its terms is a monitoring system, the controversy it has aroused suggests that its actual function extends far beyond mere monitoring of steel imports. Part I of this Comment will examine the TPM in the context of world steel trade to show how the original system actually functioned, and how the new version is likely to operate. Part II will explore the ways in which this import relief program is inconsistent with traditional United States trade …

Industrial use of microorganisms has grown over the past few decades. In turn, inventors and discoverers of microorganisms have sought patents for their discoveries. Although the United States Patent and Trademark Office views microorganisms as unpatentable living matter, its position was successfully challenged in two cases recently decided by the Court of Customs and Patent Appeals. The first case involves a new bacterial species isolated from soil samples; the second concerns a bacterium created by DNA recombinant technology. The Broadening Of The Pentagon Papers Standard: An Impermissible Misapplication Of The National Security Exception To The Prior Restraint Doctrine, Sherrie L. Bennett
Seattle University Law Review
This comment examines the history of the national security exception to the prior restraint rule and discusses the elements of the Pentagon Papers standard in the context of the Marchetti and Progressive opinions. Application of those elements to the reasoning of the cases demonstrates the failure of these lower courts to follow the Supreme Court's strict view of when restraint is justified. Examining the theoretical basis underlying the first amendment, the comment concludes that strict application of the Pentagon Papers standard is essential to continuing protection of the American people's right to be informed of government activities.

World political reaction to the Southeast Asian refugee crisis has not asserted the refugees' human rights under international law. As a result, most of the refugees lack security from forcible return to the conditions they fled. They would have that security if the world powers act instead to implement non-refoulement, an established moral principle that arguably has attained the status of customary international law.

Executive Order 12,114 - Environmental Effects Abroad: Does It Really Further The Purpose Of Nepa, Francis M. Allegra

Executive order 12,144 is a cross-product of two separate vectors. On one axis it is a statement of foreign policy directing administrative review of the extra territorial environmental effects of major federal activities. On the other it is an alleged resolution of a long-standing intergovernmental controversy concerning the applicability of the National Environmental Policy Act of 1969 to major federal actions having solely nondomestic environmental impacts. In either context, the Order should be viewed as an attempt by the United States to assume a more responsible role in world environmental affairs.
