The Labor-Bankruptcy Conflict: Rejection Of A Debtor's Collective Bargaining Agreement, Michigan Law Review
Michigan Law Review
This Note examines the courts' accommodation of the labor and bankruptcy policies when a debtor in possession or trustee seeks to reject a collective bargaining agreement. Part I criticizes a series of recent cases that failed to confront the statutory conflict. If these courts had recognized the conflict between the language of the Bankruptcy Act (now the Code) and the Labor Act, they would have been forced to consider whether the labor and bankruptcy policies actually clashed. Part II finds that in most instances they do not, and argues that requiring the debtor in possession to bargain with the union …

This comment presents an examination of the anti-competitive practice of dumping and the United States legislation aimed at its deterrence. The author presents an analysis of the procedure used in the repealed antidumping act. Additionally, the author addresses the question of the effect of the new Trade Agreements Act on the antidumping investigations in the future.

Marine Affairs Theses and Major Papers
During the late 1960's and early 1970's several significant pieces of environmental legislation were enacted. These pieces of legislation were designed to restore, improve, preserve and protect our natural resources. The legislation with the most impact on the United State Navy and Naval vessels has been the Federal Water Pollution Control Act. In order to meet the statutory requirements of the Clean Water Act, the United States Navy had to embark on a program to: modify existing vessels with Marine Sanitation Devices (MSD's) and install such devices on new construction ships.

This addition to the title of the book gives appropriate, if not exact, warning that a reader is about to fall under the influence of a spell-binding author, whose sense of theatre equals that of the lawyers whose exploits he exposes. It does not, however, prepare one for his serious analysis, arguments, and proposals concerning how law should distribute the losses of accidental injuries which occur in our society.

Innocuous Inoculum Or Perilous Parasite? Encouraging Genetic Research Through Patent Grants: A Call For Regulation And Debate, James F. Brashear

This Comment examines the effect of the United States Supreme Court decision in Diamond v. Chakrabarty, which involved research in recombinant genetics. The author examines the basis of the Court's decision in the Diamond case and discusses the propriety of extending patent grants for products of genetic research before establishing a regulatory system for such research and without the opportunity for public debate. The author argues that, while the Court has recited its inability to deny patents for microorganisms, there are several grounds for refusing to extend patent protection to products of genetic research, not least among which is the …

This paper will compare the global conventions concerned with controlling ship-borne pollution, noting the major differences in regulations concerned with the prevention, control and reporting of pollution incidents, as well as the enforcement provisions of these conventions.
