Constitutional Law-Saboteurs And The Jurisdiction Of Military Commissions, George T. Schilling Dec 1942

Constitutional Law-Saboteurs And The Jurisdiction Of Military Commissions, George T. Schilling

Michigan Law Review

The jurisdiction of military tribunals in the United States has troubled political and legal writers since the days of the Revolution. Decided cases are not numerous. The boundaries separating military and civil jurisdiction are not precise. Observations of the plight of oppressed peoples in other lands as well as the conception of total war and the course of action necessary for survival warrant a reexamination and reappraisal of our constitutional guarantees, which were in part based upon and reflect a fear of tyrannical military rule. A pronouncement of the Supreme Court of the United States in this field is, therefore, …

Military Commissions: Trial Of The Eight Saboteurs, Myron C. Cramer Nov 1942

Military Commissions: Trial Of The Eight Saboteurs, Myron C. Cramer

Washington Law Review

When your President asked me to talk about something and gave me the choice of subjects, I really didn't know just what to select. I much would have preferred that he would have told me what he would like to have me talk about, but being this is a lawyers' meeting and being that we have been through the trial of the eight saboteurs in Washington, I thought that probably you ladies and gentlemen would be interested in the legal aspects of that trial. Now, I have got to say at the outset that so far as the facts are …

The Collective Bargaining Agreement And Its Legal Effects [Part 1], Nona B. Fumerton Nov 1942

The Collective Bargaining Agreement And Its Legal Effects [Part 1], Nona B. Fumerton

Washington Law Review

The significance of the collective labor agreement is naturally of importance to employers and their workers, but the public as a whole has an equally vital interest in the matter. The strike and its picket line, the lockout and the blacklist all create economic waste ultimately borne by the public. The concurrent disruption of industrial life and the imminence of violence and bloodshed suggest the value of industrial peace to the community, ind this is particularly true in wartime, when the utmost possible elimination of interruptions in production becomes a matter of urgent iational concern. The collective agreement, representing the …

Instruments Of Discovery Under Federal Rules Of Civil Procedure, Alexander Holtzoff Oct 1942

Instruments Of Discovery Under Federal Rules Of Civil Procedure, Alexander Holtzoff

Michigan Law Review

The elimination of the "sporting theory" of justice, the simplification of procedure, and the prompt disposition of controversies on their merits are the great objectives of the new federal civil practice. One of the principal means for the attainment of these purposes is discovery, by which a disclosure may be obtained in respect to all pertinent information in the possession of any party to a litigation. An exception is, of course, made for privileged matter. It is one of the basic theories of the new procedure that every party to a law suit is under a duty to reveal to …

Torts - Wrongful Exclusion From An Elevator - Damages For Mental Pain And Humiliation, Michigan Law Review Jun 1942

Torts - Wrongful Exclusion From An Elevator - Damages For Mental Pain And Humiliation, Michigan Law Review

Michigan Law Review

Plaintiff's wife, a Caucasian, having business with a tenant on the fifteenth floor, entered defendant's elevator containing other whites. She and a Negro woman were directed by the operator to take an elevator in the rear of the store used for freight and Negro passengers; and being ignorant of this latter fact, she used this elevator. Asserting that she was wrongfully excluded from the elevator for white people and thereby was considered to be a negro by both whites and colored people, she claimed to have suffered mental anguish, humiliation, and physical suffering. Held, the defendant, while not a …

Labor Law - Right Of Employee To Sue On Collective Bargaining Contract Between Employer And Union, David Davidoff

Michigan Law Review

Defendant, a theatre owner, in March, 1939, entered into a collective bargaining contract with a local union by the terms of which he agreed to hire only union operators, to pay them a specified wage, and to give them two weeks' notice of their discharge, or two weeks' salary in lieu thereof, should he decide to go out of business. Plaintiff, a union member, was employed by the defendant from March, 1939, until he was discharged in December, 1939. It appeared that this discharge was occasioned by defendant's sale of his theatre and retirement from the business. Plaintiff sued for …

Injunctions - Extent To Which Equity Will Protect A Business On The Theory That It Is A Property Right, Michigan Law Review Apr 1942

Injunctions - Extent To Which Equity Will Protect A Business On The Theory That It Is A Property Right, Michigan Law Review

Michigan Law Review

Plaintiff, a corporation engaged in publishing a newspaper, in order to increase circulation conducted a puzzle contest, offering substantial prizes. Defendant, engaged in preparing and selling answers to various prize contests, sold answers to contestants in plaintiff's contests. Plaintiff sought to enjoin such activity. Held, that the right to conduct a lawful business is a property right which may be protected from unlawful interference. Even if, as mere offerees, the contestants are not bound to plaintiff by contract, defendant's acts amount to an inducement to tender spurious performance and may therefore be enjoined as improper and unlawful interference with …

Some Spadework On The Implied Warranty Of Authority, Albert S. Abel Feb 1942

Some Spadework On The Implied Warranty Of Authority, Albert S. Abel

West Virginia Law Review

There is no doubt that one who purports to deal as agent for a named principal will be made to foot the bill, if his agency turns out to be mythical or if his authority is not broad enough to cover what lie proposed to do. In undertaking one more discussion of the nature of the personal liability to which the agent of a disclosed principal or claimed principal subjects himself in the event no such agency or authority as is assumed really exists, the writer may seem to be threshing old straw. But prior treatments, while often excellent as …

Damages - Breach Of Contract - Right To Compete In A Contest, Michigan Law Review Feb 1942

Damages - Breach Of Contract - Right To Compete In A Contest, Michigan Law Review

Michigan Law Review

Defendant organized a contest whereby the public was invited to guess the number of beans in a jar, the fifteen persons submitting the answers most nearly correct to be entitled to become participants in a "quiz contest" in which the prize was an automobile to be awarded to "the person who is the last to be eliminated." The participants drew for the order in which they were to be questioned, the plaintiff drawing first position. On the fourth round of questions the plaintiff missed the question put to him, and then the other contestant failed to answer correctly, whereupon the …
