Los Juegos De Rol Como Una Herramienta Psicoeducativa, Víctor E. Quintana Villarreal

Journal of Roleplaying Studies and STEAM

Journal of Roleplaying Studies and STEAM

Dentistry And The Law: The Importance Of Termination Rights, Daniel Schulte Jd

The Journal of the Michigan Dental Association

This column explores the legal importance of termination rights in contracts with dental product suppliers. It explains that termination provisions—including notice periods and termination fees—must be carefully negotiated upfront, as they are generally enforceable once signed. The author clarifies that large termination fees may be deemed unenforceable penalties if they do not reasonably approximate actual losses. The article advises dentists to shop around for favorable contract terms and seek explanations for restrictive clauses.

The Historical And Systemic Effects On Racial Disparities In Incarceration Rates Among Black Individuals, Vanessa Valentine May 2026

The Historical And Systemic Effects On Racial Disparities In Incarceration Rates Among Black Individuals, Vanessa Valentine

Electronic Theses, Projects, and Dissertations

Racial disparities in incarceration rates within the United States have existed for decades. This paper will examine these disparities in order to understand how Black individuals and communities are disproportionately affected by the criminal justice system. By exploring historical and systemic factors that have contributed to these disparities such as structural racism, discriminatory policing, and unequal sentencing policies this research will highlight how these practices have reinforced racial inequality within the criminal justice system. The significance of the presenting issue will be explored by analyzing how these disparities affect the incarcerated individual and their family and community. Using a mixed …

Arrest Rates And Police Presence In East Bay Area Counties Of Northern California, Christiana M. Tyler May 2026

Arrest Rates And Police Presence In East Bay Area Counties Of Northern California, Christiana M. Tyler

Electronic Theses, Projects, and Dissertations

In this research study, we discuss the social phenomenon of mass incarceration in the United States. Previous research has evidenced clear racial disparities within this social issue, but has yet to make a connection between high incarceration rates and the sheer volume of police officers in many communities. This descriptive study sets out to discover whether there is a difference in incarceration rates based on the level of police presence in select counties in Northern California. The study will measure police presence by the number of police officers, using secondary data from U.S. government and nonprofit agencies. The researcher hypothesizes …

Raising The Bar: Virginia Constitutional Interpretation Post-Vlaming, The Honorable Lisa M. Lorish, Alec Block, Amy Vanderveer May 2026

Raising The Bar: Virginia Constitutional Interpretation Post-Vlaming, The Honorable Lisa M. Lorish, Alec Block, Amy Vanderveer

University of Richmond Law Review

Across the United States, dozens of state supreme courts choose to interpret their state constitutions as co-extensive, or in “lockstep” with analogous provisions of the Constitution of the United States. Yet since the Supreme Court overruled or changed its interpretation in a number of rights-based cases, state constitutions are receiving new attention. In Virginia, several years before Dobbs sparked this new focus, the Supreme Court of Virginia departed from the Supreme Court of the United States’ interpretation of its Free Exercise Clause analogue and adopted a new standard providing increased protection. In doing so, the Court signaled its willingness to …

Rethinking The Scope Of State Power: Territorial Jurisdiction, Popular Sovereignty, And Extraterritorial Legislation, Jeffrey Schmitt May 2026

Rethinking The Scope Of State Power: Territorial Jurisdiction, Popular Sovereignty, And Extraterritorial Legislation, Jeffrey Schmitt

William & Mary Law Review

The Supreme Court applies the territorial framework of international law to resolve disputes over the reach of state power. Under this framework, a state’s power is coterminous with its borders, such that a state’s regulatory power within its territory is limited only by federal law. The Court recently used this framework to overrule an obscure line of Dormant Commerce Clause cases that held that a state regulation of local conduct could have impermissible extraterritorial effects.

This Article argues that the territorial model of state power from international law does not account for the division of sovereignty within our federal system. …

Too Cruel For School: How Parental Rights Doctrine Can Help Protect Against Book Bans, Tessa K. Wild

William & Mary Law Review

This Note argues that parents’ rights protections are crucial to protecting against broad censorship in public schools, and that if states want to effectively regulate book removals, they should preemptively adopt laws similar to Minnesota’s section 134.51.

[...]

Part I of this Note will provide background information about book removals as a freedom of speech issue, as well as a history of how parents’ rights rhetoric is tied to book-removal issues. Part II will address both the history and legal standards of parents’ rights protections. Finally, Part III, using Minnesota and Utah as case studies, will apply parents’ rights law …

That Song Sounds Familiar: An Analysis Of U.S. Copyright Considerations In Popular Music, Jessica Johnson May 2026

That Song Sounds Familiar: An Analysis Of U.S. Copyright Considerations In Popular Music, Jessica Johnson

Honors Theses

Much of popular music has started to bear resemblance to songs of the past as artists rely on techniques, including sampling and interpolations, to ensure their song is a guaranteed hit. But what are the legal implications behind that, and is the line between inspiration and copying getting blurred? This thesis aims to consider the precedent of copyright law as applied to modern musical works and how the landscape of popular music has evolved over time to raise more copyright concerns. It also looks at two modern case studies of musical inspiration that have resulted in legal claims: the song …

The Artificial Artist: Considering Ai’S Impact On Image Copyright, Alyse Mandelblatt May 2026

The Artificial Artist: Considering Ai’S Impact On Image Copyright, Alyse Mandelblatt

Communication Undergraduate Honors Theses

This thesis seeks to create empirical results to ground what has been a largely theoretical discussion about the effect of artificial intelligence (AI) on copyright law in the United States. AI has disrupted traditional ideas of creativity and expression, which are vital communication tools. Copyright is a regulatory agent to encourage the production of unique communication products by giving owners complete rights to their work. Copyright principles conflict with current AI model training practices. This research considers how AI literacy may provide insight into copyright knowledge and AI attitudes for prediction of how common law and AI regulation policy may …

Are Anti-Corruption Sanctions The New Fcpa? A Comparison Of The Foreign Corrupt Practices Act, The Foreign Extortion Prevention Act, And Sanctions, Karen Peters-Van Essen

Faculty Law Review Articles

With the rise of globalization, international corruption has been linked to a host of economic and social ills, including inter-state conflict.  By 2021, the U.S. government had identified corruption for the first time as a national security threat that required a broader range of inter- and cross- governmental policy tools to address the identified scope of the problem.  This national security focus was reinforced with the Russian invasion of Ukraine in 2022, which has been seen as being facilitated by corrupt oligarchs.  To be sure, the U.S. had decades prior passed the Foreign Corrupt Practices Act, which prohibits U.S. businesses …

Georgetown Law Faculty Publications and Other Works

On July 30, 2025, U.S. President Donald Trump imposed 50% tariffs on imports from Brazil and sanctioned a sitting Brazilian Supreme Court Justice, both partially because of Brazil’s online content moderation decisions. This is an extreme, but not an isolated event: worldwide, legislators and regulators struggle to craft public policies that address problems of disinformation and online harassment while protecting the freedom of expression—leading to increasing international confrontations. One key question in content moderation is content adjudication—or who is responsible for deciding what type of speech violates the law and should be taken down (or not). This article contributes to …

Place, Democracy, Law, And The Necessity Of Local News, Erin C. Carroll May 2026

Place, Democracy, Law, And The Necessity Of Local News, Erin C. Carroll

Georgetown Law Faculty Publications and Other Works

In 2025, the painter Amy Sherald pulled her show American Sublime from the Smithsonian after the museum considered removing a painting of a transgender Statue of Liberty to avoid angering President Trump. The Baltimore Museum of Art stepped in, and it was important that it did. American Sublime needs to be seen in person. It comprises dozens of portraits of Black Americans—a farmer, a bicyclist, a balloon-holder, a child on a playground slide. The portraits are dignified, beautiful, warm, and alluring. They are, in a word, human.

In the gallery, the paintings were hung low on the walls to increase …

The Role And Professional Obligations Of Crown Attorneys In Disposition Hearings For Not Criminally Responsible Accused At Provincial Review Boards, Andrew Flavelle Martin May 2026

The Role And Professional Obligations Of Crown Attorneys In Disposition Hearings For Not Criminally Responsible Accused At Provincial Review Boards, Andrew Flavelle Martin

Dalhousie Law Journal

Crown attorneys perform several different roles, each accompanied by a set of professional obligations. R v Boucher makes it clear that the role and professional obligations of the Crown attorney at trial are to pursue justice, not to win. Much less clear are the role and professional obligations of Crown attorneys at review board disposition hearings for not criminally responsible (NCR) accused under Part XX.1 of the Criminal Code. In this article, I do two things. First, I canvass and synthesize the case law, legislative proceedings, and literature to identify the correct role of Crown attorneys at disposition hearings. I …

Putting Labour Law To Work: Imperative Of Race Conscious Labour Law, Harshini Arumugam May 2026

Putting Labour Law To Work: Imperative Of Race Conscious Labour Law, Harshini Arumugam

Dalhousie Law Journal

History shows that race and labour are deeply connected in Canada. For the labour movement to advance racial equality, it must contend with this reality. Through a critical race analysis, this paper examines how race-evasive approaches in labour laws and practices have contributed to systemic racial inequality. It argues that race-conscious strategies are essential for addressing the specific experiences and needs of racialized workers. By leveraging existing legal tools and intentionally incorporating race-conscious approaches into areas such as collective bargaining, the collective agreement, and the duty of fair representation, labour law can be a powerful mechanism for achieving racial justice …

Saying What The Law Might Be? Courts, Geofence Warrants, And The Fourth Amendment Labyrinth, Ciara Lavin May 2026

Saying What The Law Might Be? Courts, Geofence Warrants, And The Fourth Amendment Labyrinth, Ciara Lavin

Cardozo Law Review

Since 2016, Google has received thousands of geofence warrant requests from law enforcement, requesting Google to scan through its vast database of users to identify who and what devices entered into, or exited out of, a set of coordinates in a specified period of time. Several cases began making their way through the federal courts to delineate the legality of such warrants—with challenges spanning the vast amount of data they search, their relative accuracy, and whether they comported with the Fourth Amendment. Then, in the summer of 2024, two federal appellate courts handed down decisions just weeks apart: the Fourth …

Insolvency Law In The Global South: Lessons For The Global North, Aurelio Gurrea-Martinez May 2026

Insolvency Law In The Global South: Lessons For The Global North, Aurelio Gurrea-Martinez

Research Collection Yong Pung How School Of Law

Despite the influence of the Global North in many insolvency laws and practices in the Global South, this article shows that the Global South has innovated in many aspects of insolvency law. In some cases, these innovations consist of solutions that, with certain adjustments, have been imported from the Global North. In others, they are really ‘autochthonous innovations’ from the Global South. This article identifies both types of innovations, providing examples from jurisdictions such as Brazil, Chile, China, Colombia, Dominican Republic, India, Malaysia, Mexico, Myanmar, Peru, Philippines, Thailand and Uruguay. More importantly, it will be shown how those innovations from …

How Ai Destroys Institutions, Woodrow Hartzog, Jessica Silbey May 2026

How Ai Destroys Institutions, Woodrow Hartzog, Jessica Silbey

UC Law Journal

Civic institutions—like the rule of law, higher education, and a free press—are the backbone of democratic life. They are the mechanisms through which complex societies encourage cooperation and stability, while also adapting to changing circumstances. The real power of institutions is their ability to evolve and adapt within a hierarchy of authority and framework for roles and rules while maintaining legitimacy in the knowledge produced and action taken. Purpose-driven institutions built around transparency, cooperation, and accountability empower individuals to take intellectual risks and challenge the status quo. This happens through the machinations of interpersonal relationships within organizations that comprise institutions. …

The Judicial Subjectivity In The Fair Use Analysis Of Andy Warhol Foundation For The Visual Arts, Inc. V. Goldsmith And Its Implications, Donna Khademi May 2026

The Judicial Subjectivity In The Fair Use Analysis Of Andy Warhol Foundation For The Visual Arts, Inc. V. Goldsmith And Its Implications, Donna Khademi

Theses

The case of Andy Warhol Foundation for the Visual Arts, Inc. v. Goldsmith demonstrates the subjective nature of the fair use doctrine. Scholars suggest that judges are often forced to interpret expressive works without specialized training in art, leading to inconsistent rulings. These discrepancies can lead to legal ambiguity and potentially weaken First Amendment protections. A deeper understanding of authorship, appropriation, and contemporary art highlights their crucial role in evaluating expressive works. By examining current legislation and judicial precedents, this paper shows the subjective and inconsistent nature of the present legal framework and offers a set of related proposals. It …

Disney's Illusion Of Inclusion, Marissa Davis May 2026

Disney's Illusion Of Inclusion, Marissa Davis

All Theses

Walt Disney’s films were not simply entertainment, but a use of racial stereotypes as a profit strategy. Even scholarship that explores these tactics and critically analyzes his most problematic misrepresentations do not to consider the role of Walt Disney, as a man, in creating and promoting these narratives. These depictions, while somewhat in line with the culture when he first entered the business, failed to evolve as society changed. Rather, they were deliberate choices to attract white audiences and increase revenue.

Over time, these tropes became socially unacceptable, yet Disney maintained them for public consumption. While Disney and his company …
