This transcendental phenomenological research shows the influence of mental health treatment on the self-efficacy of African American women who are secondary or post-secondary educators in Northern Illinois. For African American women educators, taking care of their mental well- being and being aware of mental health conditions are crucial. Sharing personal stories and experiences can help reduce the stigma surrounding mental health. Promoting awareness and understanding of mental health issues are vital in our communities, and access to resources and support are necessary. Using self-identity theory can aid in comprehending motivations and behaviors, leading to greater satisfaction and fulfillment and the …

Investigating The Relationship Between Noun Classes And Plant Folk Taxonomy In Chasu Language Of Kilimanjaro Region In Tanzania, Peter Rabson Mziray
Journal of Humanities and Social Sciences
The current study investigates the relationship between noun classes and plant folk taxonomy in Chasu (G 22). The study focuses on two objectives: the first objective is to describe the plant folk taxonomy in Chasu and the second objective is to determine the relationship between noun classes and plant folk taxonomy in Chasu. Data were collected from rural villages in Same and Mwanga districts by using free listing, field interviews (jungle-walk-and-identify), and written texts containing Chasu plant names. The findings reveal that Chasu folk taxonomy reflects different ethnobotanical categories; including a unique beginner which is mmea/mimea ‘plant(s)’, and three life …

Causation’S Due Process Dimensions, Cassandra Burke Robertson, Charles W. “Rocky” Rhodes
Texas A&M Law Review
For decades, courts have grappled with the tension between compensating victims of mass harms and maintaining fairness to defendants when causation is difficult to prove. This Article argues that the Supreme Court’s due process jurisprudence provides a relevant framework for navigating this tension. We contend that the Court over the last three decades has established a consistent Fourteenth Amendment due process approach in punitive damages and personal jurisdiction cases, which is rooted in antecedents tracing to the nineteenth century and relies on a nexus of interests that balances individual rights, state interests, and federalism concerns. Discerning Interstate Groundwater Law: An Evaluation Of Federal Common Law And Its Impacts On Groundwater Management, Brooke Collishaw

The Supreme Court has demonstrated a superficial understanding of ground water over the last century in interstate water disputes. In cases that indirectly affect groundwater, it has ignored the complexities of the resource and its connection with surface water. All but one Supreme Court case that mentions groundwater centers around surface water, leading to the inadequate consideration of groundwater. This has led to the development of a unique federal common law for how federal courts are to resolve interstate water disputes that affect groundwater. New Judicial Federalism And The Establishment Clause: Classroom Ten Commandments As A Case Study In State Constitutional Protection, Caroline Mala Corbin

Louisiana recently enacted a law requiring a Ten Commandments display in every public school classroom from kindergarten to college. Forty-five years ago, the U.S. Supreme Court ruled that a nearly identical attempt to introduce Christianity into the public schools violated the Establishment Clause—the clause in the U.S. Constitution’s First Amendment that requires some degree of separation between church and state.
Unfortunately, the U.S. Supreme Court has since reduced the Establishment Clause to a shadow of its former self. It replaced doctrinal tests that protected religious minorities with a history and tradition test that is easily manipulated and that presumes the …

Using cases collected in the Sabin Center for Climate Change Law’s Climate Litigation Database, this report analyzes the 630 climate change lawsuits filed in United States courts while President Joseph R. Biden was in office. During the Biden administration, the federal government reversed course on the first Trump administration’s climate deregulation and embarked on a “whole-of-government approach to combatting the climate crisis.” Many states and municipalities pursued their own efforts to mitigate and prepare for climate change, while other states undertook climate deregulatory efforts. Pesticides, Pollinators, And Producers: The Epa’S New Herbicide And Insecticide Strategies And Illinois Farmers, Jonathan Jerkatis

The Environmental Protection Agency (EPA) has introduced new herbicide and insecticide strategies to comply with the Endangered Species Act (ESA), a move that will have significant implications for Illinois farmers and endangered species. Illinois, a leading producer of corn and soybeans, relies heavily on pesticides. Unfortunately, these chemicals have been identified as a key driver of monarch and other endangered species population decline. This note examines how the EPA’s new strategies aim to balance species protection with agricultural viability, addressing concerns over financial burdens of compliance, the complexity of the strategies, and a lack of enforcement provisions. A large literature on regulation highlights the many different methods of policy-making: command-and-control rulemaking, informational disclosures, tort liability, taxes, and more. But the literature overlooks a powerful method to achieve policy objectives: data. The state can provide (or suppress) data as a regulatory tool to solve policy problems. For administrations with expansive views of government’s purpose, government-provided data can serve as infrastructure for innovation and push innovation in socially desirable directions; for administrations with deregulatory ambitions, suppressing or choosing not to collect data can reduce regulatory power or serve as a back-door mechanism to subvert statutory or common law rules. …

Police violence against disabled people is a fundamental problem of policing. Whether through so called wellness checks, quality of life policing, or coercive state civil commitment procedures, disabled people are often on the receiving end of intrusion, violence, and rights violations by law enforcement. Yet, so, too, is everyone else. That disabled people are similarly, and yet uniquely, vulnerable to intrusion, violence, and rights violations by law enforcement might seem like just another group to add to the list of groups harmed by policing and police violence. Beyond Autonomy: Rethinking Deception In Sexual Assault Law, Marie Manikis

This Article focuses on recent developments in Britain in which courts have recognised gender deception as a sexual assault by using an autonomy based argument to define deception/fraud that vitiates consent in sexual offences. This Article argues against the defensibility of a framework that criminalizes deception on the basis of an ill defined autonomist based understanding as opposed to a more restrictive standard. It proposes that any adopted standard should incorporate social context and be reflexive of the ways that the state has contributed to these contexts, namely the social conditions under which the deceit takes place as well as …

The Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS Agreement) was adopted on 15 April 1994, along with the estab-lishment of the World Trade Organization (WTO). With the WTO’s recent celebration of its thirtieth anniversary, it is high time we explore what the future will hold for this agreement. This chapter begins by revisiting the past to examine whether the TRIPS Agreement would be adopted if it were negotiated today. The chapter then discusses whether WTO members will undertake a major overhaul of this agreement in the future. Taking note of the fast-evolving international norm-setting environment and …
