The research method used in the writing of this thesis is normative juridical with a qualitative approach where the data comes from literature studies …

Evaluating A Test For Shedding Propensity Using Tape Lifts From Different Skin Locations, Xiao M. Chen Dec 2021

Evaluating A Test For Shedding Propensity Using Tape Lifts From Different Skin Locations, Xiao M. Chen

Student Theses

The shedding propensity of a person can assist data interpretation in casework when assessing the possibility of passive transfer for DNA analysis. Past studies on shedding propensity evaluated palmar skin (washed and unwashed) deposits. This study compared different skin locations with respect to shedding propensity, and explored the potential of tape-lifts as a skin surface collection method. Eight different skin types and samples were collected with adhesive tape disks from 28 participants over three non-consecutive days; the washed and unwashed fingers from both hands, toe, and arm, neck below ear, and nape. Samples were extracted, quantified, amplified, genotyped, and evaluated …

You Are The Father! An Argument For Court-Ordered Prenatal Paternity Testing And Child Support In Tennessee, Michael Stooksbury Dec 2021

You Are The Father! An Argument For Court-Ordered Prenatal Paternity Testing And Child Support In Tennessee, Michael Stooksbury

Lincoln Memorial University Law Review Archive

As long as the concept of monogamy has existed, humans have looked for ways to escape it. Children, a natural consequence of sexual activity, are often negatively affected by the lack of a supportive family structure in single-family households. To correct this, courts often order child support to be paid from one parent to another, usually through the State. This is why paternity determinations are an important court function. One aspect courts have neglected, however, is child support for expecting mothers during pregnancy. Prenatal child support for expecting mothers would help alleviate some of the prenatal costs and make the …

The important questions laid out by the Appeals Chamber in this case highlight the need for the proper delineation and interplay between mental illness and criminal responsibility under international law. Specifically, this case represents a watershed moment for the Appeals Chamber to set a framework for adjudicating mental illness in the context of collectivized child abuse and trauma. This is especially true for former child soldiers who occupy both a victim and alleged perpetrator status.

A Modest Proposal: Leveraging Private Enforcement Mechanisms And The Bayh-Dole Act To Reduce Drug Prices In The U.S. Healthcare Industry, Brittany Day Dec 2021

A Modest Proposal: Leveraging Private Enforcement Mechanisms And The Bayh-Dole Act To Reduce Drug Prices In The U.S. Healthcare Industry, Brittany Day

Duke Journal of Constitutional Law & Public Policy Sidebar

The United States healthcare system is one of the most expensive in the world. Unlike other products, when drug prices skyrocket, people may die. While advocating for various solutions, both the Biden and Trump administrations have recognized the importance of halting the rise of prescription drug prices. Most of the solutions advanced are focused on government-side initiatives, such as allowing Medicare to directly negotiate with pharmaceutical companies. Yet, the "march-in rights" built into the Bayh-Dole Act create an opportunity to set up a mechanism that would invite private actors to sue pharmaceutical companies for unconscionable drug pricing. The Bayh-Dole Act …

This systems understanding provides the foundation for some initial and overarching observations about law and systemic racism.

Systemic Racism And Minority Disparities In Health Care, Constance Fain

The Bridge: Interdisciplinary Perspectives on Legal & Social Policy

Historically, racial discrimination in society has had an adverse effect on the health of African Americans. This type of inequality has also affected other persons of color, and it has been reported that racism has insidious effects on many White individuals, especially on their health as well. Four critical issues will be addressed in this paper: First, the impact of discrimination on the health care of African Americans and others. From slavery to lynching to incarceration, generations of African American families have endured trauma. Psychologist and other social scientists have said that these continuing experiences with racism may lie at …

Contract Remedies Need Not Undercompensate Aspiring Parents When Cryopreserved Reproductive Material Is Lost Or Destroyed: Recovery Of Consequential Damages For Emotional Disturbance When Breach Of Contract Results In The Lost Opportunity To Become Pregnant With One's Own Biological Child, Joseph M. Hnylka

Journal of Law and Health

The Center for Disease Control and Prevention (CDC) has reported that the use of assisted reproductive technology (ART) has doubled over the past decade. In vitro fertilization (IVF) is the most prevalent form of ART. During IVF, a woman’s eggs are extracted, fertilized in a laboratory setting, and then implanted in the uterus. Many IVF procedures use eggs or sperm that were stored using a process called cryopreservation. A recent survey reported that cryopreservation consultations increased exponentially during the coronavirus pandemic, rising as much as 60 percent. It is estimated that more than one million embryos are stored in cryopreservation …

An Analysis Of University Students’ Self-Labeling And Perception Of Feminism, Emilie Seibert Dec 2021

An Analysis Of University Students’ Self-Labeling And Perception Of Feminism, Emilie Seibert

Honors Projects

This project investigates students’ perceptions of feminism, whether or not they identify as feminist, and how closely their ideals align with basic feminist ideals. There is currently no research that investigates self-labeling as a feminist among the current generation of college students in the United States. Despite the immense benefits to holding a feminist identification, it is estimated that only about 21% of the United States population identifies as feminist (Swirsky & Angelone, 2014, p. 230). Understanding the perspectives of current students is important as they have the potential to become activists and impact the future of the feminist movement. …

Birth Rights And Wrongs Extended, Reuven Brandt Dec 2021

Birth Rights And Wrongs Extended, Reuven Brandt

The Journal of Contemporary Legal Issues

Dov Fox’s Birth Rights and Wrongs offers a largely compelling argument for expanding the scope of legal actions and remedies available to those whose reproductive choices are wrongfully frustrated by the actions of others. The dominant focus of the book is individuals who, due to the negligence and/‌or malice of medical professionals, suffer harms arising from reproduction imposed, denied, or confounded. A serious examination of these kinds of injuries is certainly appropriate given that medical professionals are increasingly involved in individuals’ reproductive plans and that serious harms may arise when desired medical interventions are improperly implemented. I will not take …

Birth Rights And Birth Wrongs Through A Common Law Lens: Why The No Liability Regime Is Likely To Endure, Richard A. Epstein Dec 2021

Birth Rights And Birth Wrongs Through A Common Law Lens: Why The No Liability Regime Is Likely To Endure, Richard A. Epstein

The Journal of Contemporary Legal Issues

Dov Fox’s recent book, the aptly named Birth Rights and Wrongs, is, as its title suggests, a study of the stark conflicts that arise in the highly contested area of reproductive rights. Fox makes the powerful case that the legal protection of reproductive rights, in all their protean forms, is systematically under-protected relative to two key benchmarks: the standards of ordinary decency, and social expectations. In my view, he has an acute awareness of these failures. But his greatest strength is also his greatest weakness, as he systematically ignores the great successes wrought through the current system, as disjointed …

Family Planning And Its Limits, Dov Fox Dec 2021

Family Planning And Its Limits, Dov Fox

The Journal of Contemporary Legal Issues

A doctor botches a vasectomy. Or says it’d be dangerous to keep a healthy pregnancy. Or misses a risk of passing along disease. Our laws do little to deter such reproductive negligence or compensate its victims. Some of this misconduct leaves people without the baby they desperately want. Other times, it foists on parents a child they’d set out to avoid. Or one with meaningfully different traits than what they were led to believe.

I call these three harms procreation deprived, procreation imposed, and procreation confounded.

Thousands of fertility patients were deprived of biological parenthood when their …

Plural Agents, Private Intentions, And Legal Interpretation, Scott Soames Dec 2021

Plural Agents, Private Intentions, And Legal Interpretation, Scott Soames

The Journal of Contemporary Legal Issues

The chief problem posed in Multimember Legislative Bodies and Intended Meaning is one in which lawmakers pass a tax bill supported by two equal groups with conflicting interpretations of the bill’s content. One believes it taxes imported tomatoes, among other things; the other believes it exempts tomatoes. They disagree because they received supposedly authoritative, but in fact conflicting, information about the meaning of “fruit” in the bill’s text. One group was told it is used with its biological sense, which includes tomatoes as edible seed-bearing reproductive parts of a plant. The other group was told that “fruit” is used with …

Commentary, Stanley Fish Dec 2021

Commentary, Stanley Fish

The Journal of Contemporary Legal Issues

Suppose you are walking in the corridors of a law firm and you hear a person in one of the offices say “You have no consideration.” What do you take the speaker to have said or meant? You might reasonably assume that you have overheard a snatch of a conversation between a lawyer and a client who is being told that he cannot allege breach of contract because in the conversation he reports between himself and the one he would accuse there was an absence of reciprocally offered inducements of the kind “if you do X, I will do Y” …

Intentional Procreation, Robin L. West Dec 2021

Intentional Procreation, Robin L. West

The Journal of Contemporary Legal Issues

Dov Fox’s book Birth Rights and Wrongs makes the case for the development, through judicial decision-making, of various torts that would respond to the disruption of intentional conception, contraception, gestation and childbirth, where those intentions are thwarted because of the negligence of professionals employed to assist or guide consumers of their services in reaching their reproductive goals.

Disinheritance, Discrimination, And The Case For Including Adult Independent Children In Dependants’ Relief Schemes: Lawen Estate V Nova Scotia, Jane Thomson Dec 2021

Disinheritance, Discrimination, And The Case For Including Adult Independent Children In Dependants’ Relief Schemes: Lawen Estate V Nova Scotia, Jane Thomson

Dalhousie Law Journal

In 2019 a Superior Court in Nova Scotia excluded adult independent children as “Dependants” under Nova Scotia’s Testator’s Family Maintenance Act. The decision was based on a finding that testamentary autonomy is a constitutional right protected by s. 7 of Canada’s Charter of Rights and Freedoms. This article explains why the constitutional decision in Lawen Estate v Nova Scotia was incorrect. It also demonstrates why the inclusion of adult independent children in dependants’ relief schemes is not only benign in most instances, but may play a role in preventing the perpetuation of discrimination in the private law. This article also …

Canada’S Right-Wing Extremists: Mapping Their Ties, Location, And Ideas, Bessma Momani, Ryan Deschamps

Canada has often been seen as a progressive country that is welcoming to immigrants, promotes multiculturalism, and generally as a kind and tolerant society. The Shortcomings Of Corporate Accountability In Post-Conflict Colombia: Land, Rivers And Animals, Isabella Ariza Buitrago, Luisa Gomez Betancur Dec 2021

The Shortcomings Of Corporate Accountability In Post-Conflict Colombia: Land, Rivers And Animals, Isabella Ariza Buitrago, Luisa Gomez Betancur

Biennial Conference: The Social Practice of Human Rights

Although the notion of sustainable peace requires acknowledging the role played by all actors, transitional processes around the world have inadequately addressed or completely ignored the direct and indirect participation of economic actors. In particular, Colombia's transitional justice regime left out corporations entirely. A skillshare between Colombian lawyers and US-based human rights attorneys showed some of the gaps that let corporations continue in impunity for profiting, benefiting from, or directly financing the conflict. Other than harming and deeply fracturing communities, the shortcomings of corporate accountability in post-conflict Colombia also leave land, rivers, and animals without redress. This paper explores some …

Classrooms Into Courtrooms, Naomi M. Mann Dec 2021

Classrooms Into Courtrooms, Naomi M. Mann

Faculty Scholarship

The federal Department of Education’s (DOE) 2020 Title IX Rule fundamentally transformed the relationship between postsecondary schools (schools) and students. While courts have long warned against turning classrooms into courtrooms, the 2020 Rule nonetheless imposed a mandatory quasi-criminal courtroom procedure for Title IX sexual harassment investigatory proceedings in schools. This transformation is a reflection of the larger trend of importing criminal law norms and due process protections into Title IX school proceedings. It is especially regressive at a time where calls for long-overdue criminal justice reform are reaching a boiling point across the nation. Its effects are especially troubling because …
