Indigenous Peoples' right to sovereignty forms the foundation for advocacy and actions toward greater Indigenous self-determination and control across a range of domains that impact Indigenous Peoples' communities and cultures. Declarations for sovereignty are rising throughout Indigenous communities and across diverse fields, including Network Sovereignty, Food Sovereignty, Energy Sovereignty, and Data Sovereignty. Indigenous Research Sovereignty draws in the sovereignty discourse of these initiatives to consider their applications to the broader research ecosystem. In June 2022, the Supreme Court revoked Americans’ fundamental right to abortion in Dobbs v. Jackson Women’s Health Organization. However, the Court said nothing about how its decision would impact tort claims related to reproductive care. Many states have since adopted near-total or early-gestational- age abortion bans, which has not only diminished access to reproductive care, but has also incidentally impaired the ability of plaintiffs to bring long-recognized prenatal tort claims. Prenatal tort claims—wrongful pregnancy, birth, and life—allow victims to recover when a medical professional negligently performs reproductive or prenatal care. Because not all disabilities look the same it is difficult to label a person with disabilities just by looking at them. The Boko Haram asymmetric insurgency and warfare have decimated the Northeastern region of Nigeria and its neighboring environs of Chad, Niger, and Benin. The purpose of this study was to explore the peculiar socioethnic and cultural challenges encountered by female victims of Boko Haram terrorism at internally displaced persons camps in Abuja, Nigeria, including challenges in functioning, relocating, and acclimating back into society. A phenomenological approach was applied to understand participants’ lived experiences. Data collection occurred through interviews and observation. Among African American males, deaths are alarmingly high for reasons that cannot be completely pinpointed. The purpose of this study was to analyze the definition and perception of respect and law enforcement by an African American male and to determine if Goffman’s dramaturgical model is sufficient to explain the social acceptance respect phenomena. Micro-sociological assessments of everyday social interactions are often based on dramaturgy, a sociological perspective. In a dramaturgical model, social interaction is analyzed as an actor’s performance on stage. This study employed a qualitative design so that the research questions could be answered. Enacted in 2004, the Virginia wrongful conviction compensation statute is unique in the United States. The decision to award compensation rests not with a court or an administrative agency, but with the state legislature. Unlike other compensation statutes that create an entitlement to compensation when a person is found eligible, the Virginia statute explicitly says that “[t]he payment and receipt of any compensation for wrongful incarceration shall be contingent upon the General Assembly appropriating funds for that purpose. The day-to-day operation of criminal court supervision—including probation, parole, and electronic ankle monitoring—is understudied and undertheorized. To better understand the mechanics of these systems, this study comprehensively analyzes the rules governing people on criminal court supervision in the United States. Drawing on the analysis of 187 public records from all fifty states, this study documents how criminal court supervision functions and impacts daily life. In particular, this study examines the various ways that supervision rules limit or restrict privacy, bodily autonomy, liberty, dignity, speech, and financial independence. This paper reviews recent successes and obstacles in using litigation as a tool to address issues in several contexts in the marine environment. It surveys developments at the international, national, and sub-national levels and offers lessons from creative climate litigation strategies as a way to enhance litigation to protect the marine environment. It also recommends ways in which the ocean-climate nexus can provide mutual benefits in advancing the agendas of climate change regulation and ocean stewardship.

This is a reflection on machine and human contributions to lawyering in the digital age. Increasingly capable machines can already unleash massive processing power on vast stores of discovery and research data to assess relevancies and, at times, to predict legal outcomes. At the same time, there is wide acceptance, at least among legal academics, of the conclusions from behavioral psychology that slow, deliberative “System 2” thinking (perhaps replicated computationally) needs to control the heuristics and biases to which fast, intuitive “System 1” thinking is prone. This Article makes a simple claim that has been overlooked for decades and yet has enormous theoretical and practical significance: the constitutional guarantee of counsel adopted by the U.S. Supreme Court in Gideon v. Wainwright accrues largely to the benefit of men. In this Article, we present original data analysis demonstrating that millions of women face compulsory and highly punitive encounters with the justice system but do so largely in the civil courts, where no right to counsel attaches. The demographic picture that emerges is one in which the right to counsel skews heavily against women’s interests. As this Article …

Advertisers are attempting to market to us while we dream. This is not science fiction, but rather a troubling new reality. Using a technique dubbed “targeted dream incubation” (TDI), companies have begun inserting commercial messages into people’s dreams. Roughly, TDI works by: (1) creating an association during waking life using sensory cues (for example, a pairing of sounds, visuals, or scents); and (2) as the subject is drifting off to sleep, the association is again introduced with the goal of triggering related dreams with related subject matter. The empirical literature on perception and memory consistently demonstrates the pitfalls of eyewitness identifications. Exoneration data lend external validity to these studies. With the goal of informing law enforcement officers, prosecutors, criminal defense attorneys, judges, and judicial law clerks about what they can do to reduce wrongful convictions based on misidentifications, this Article presents a synthesis of the scientific knowledge relevant to how perception and memory affect the (un)reliability of eyewitness identifications. A potent myth of legal academic scholarship is that it is mostly meritocratic and mostly solitary. Reality is more complicated. In this Article, we plumb the networks of knowledge co-production in legal academia by analyzing the star footnotes that appear at the beginning of most law review articles. Acknowledgments paint a rich picture of both the currency of scholarly credit and the relationships among scholars. Building on others’ prior work characterizing the potent impact of hierarchy, race, and gender in legal academia more generally, we examine the patterns of scholarly networks and probe the effects of those factors. Contrary to popular belief, when a child is adopted from abroad by an American citizen and brought to the United States, that child does not always become an American citizen. Many adoptees have not discovered until years later (sometimes far into adulthood) that they are not actually citizens, and some likely still do not know. To address this problem, the Child Citizenship Act of 2000 (CCA) was enacted to automate citizenship for certain international adoptees, but it does not cover everyone. Mahatma Gandhi (1869-1948) sought to alleviate poverty and empower women. His commitment to nonviolence and the economic ideal of “small is beautiful” continue to inspire grassroots movements around the globe. This article discusses the Chipko movement of northern India, the protection of rain forests in Kerala’s Silent Valley, the Self Employed Women’s Association (SEWA), and Medha Patkar’s valiant though ultimately futile attempt to save the Narmada River from a massive government damming project. The ongoing legacy of these movements can be found in AWAG, the Ahmedabad Women’s Action Group and Women’s Shanti Sena (Peace Force).

Everyone knows that going through puberty is associated with a multitude of changes: physical, mental, hormonal, etc. Fewer people know that when and how fast one goes through puberty can also be associated with changes to one’s legal rights. This article explains the use of p-values as part of statistical analyses to support several types of pharmaceutical litigation, focusing on how lawyers can best present relevant studies to benefit their clients “when the math matters” and indeed critically affects the outcome of the dispute. The article begins with a conceptual discussion of p-values as utilized in the scientific community and continues by describing the substantial concerns many scientists have voiced about the use of p-values to show much of anything. In the past year alone, news reports have shown how menstrual injustice is linked to gender inequality, a lack of economic opportunity, poor health outcomes, and human rights violations. Here is a small sampling of the unjust treatment of women and other people who menstruate: locked bathrooms at schools, inadequate supply of free period products, harmful menstruation-avoidance options for athletes, the human and economic costs of the lack of menstruation and menopause employment leave policies, and the mistreatment of people imprisoned who menstruate.

เอกัตศึกษานี้มีจุดมุ่งหมายเพื่อหาแนวทางการพัฒนาตัวชี้วัดด้านสิ่งแวดล้อมของโรงงานอุตสาหกรรมให้สอดคล้องกับแนวคิดเศรษฐกิจหมุนเวียน และยุทธศาสตร์ชาติ เนื่องจากการเติบโตของอุตสาหกรรมอย่างรวดเร็ว ทำให้เกิดปัญหาสภาพแวดล้อมและทรัพยากรธรรมชาติที่เสื่อมโทรม ดังนั้น จำเป็นจะต้องมีแนวทางการแก้ไขปัญหาที่เกิดขึ้น จากแนวคิดเศรษฐกิจหมุนเวียนที่มีหลักการใช้ทรัพยากรให้เกิดประสิทธิภาพที่สุดควบคู่ไปกับการพัฒนาทางเศรษฐกิจและสังคม การศึกษานี้จึงต้องการพัฒนาตัวชี้วัดด้านสิ่งแวดล้อมของโรงงานอุตสาหกรรมให้สอดล้องกับแนวคิดเศรษฐกิจหมุนเวียน และแนวทางตามยุทธศาสตร์ชาติ ซึ่งเป็นแผนการกำหนดทิศทางการพัฒนาประเทศ วิธีการศึกษาคือการศึกษาพระราชบัญญัติโรงงาน พ.ศ. 2535 ซึ่งเป็นกฎหมายที่เกี่ยวข้องกับโรงงานอุตสาหกรรมที่ได้นำหลักการของเศรษฐกิจหมุนเวียนมาปรับใช้ ทำให้สามารถวิเคราะห์ตัวชี้วัดด้านสิ่งแวดล้อมของโรงงานอุตสาหกรรมในปัจจุบันที่สอดคล้องแนวคิดเศรษฐกิจหมุนเวียน โดยนำมาเปรียบเทียบกับตัวชี้วัดของแนวคิดเศรษฐกิจหมุนเวียน ตัวชี้วัดของแผนยุทธศาสตร์ชาติที่สอดคล้องกับแนวคิดเศรษฐกิจหมุนเวียน และตัวชี้วัดกฎหมายส่งเสริมเศรษฐกิจหมุนเวียนในสาธารณรัฐประชาชนจีน ซึ่งเป็นประเทศที่มีกฎหมายส่งเสริมเศรษฐกิจหมุนเวียนและประกาศใช้ตัวชี้วัดของกฎหมายอย่างเป็นทางการ ทำให้เป็นตัวอย่างในการเปรียบเทียบเพื่อหาแนวทางการพัฒนาตัวชี้วัดของกฎหมายโรงงานอุตสาหกรรมไทยที่สอดคล้องกับแนวคิดเศรษฐกิจหมุนเวียนและยุทธศาสตร์ชาติ ผู้เขียนได้เสนอให้ใช้ตัวชี้วัดด้านสิ่งแวดล้อมของโรงงานอุตสาหกรรม ซึ่งจะต้องสอดคล้องกับแนวคิดเศรษฐกิจหมุนเวียนและยุทธศาสตร์ชาติ โดยครอบคลุมถึงกระบวนการทางอุตสาหกรรม ซึ่งสามารถสรุปตัวชี้วัดเป็น 4 ขั้นตอน ดังนี้ 1) ขั้นตอนการแสวงหาทรัพยากรธรรมชาติ ควรมีตัวชี้วัด คือ ผลิตภาพทรัพยากร 2) ขั้นตอนการเปลี่ยนวัสดุดิบและทรัพยากรธรรมชาติให้กลายเป็นผลิตภัณฑ์ ควรมีตัวชี้วัด คือ อัตราการใช้ประโยชน์จากทรัพยากร อัตราการใช้ทรัพยากรต่อหน่วย GDP 3) ขั้นตอนการนำวัสดุและทรัพยากรที่เหลือใช้มาปรับผลผลิตให้กลายเป็นวัตถุดิบหรือทรัพยากรขั้นทุติยภูมิ ควรมีตัวชี้วัด คือ อัตราการใช้ทรัพยากรขั้นทุติยภูมิ อัตราการรีไซเคิลทรัพยากรทุติยภูมิ อัตราการใช้ประโยชน์วัสดุหมุนเวียนในการเพิ่มมูลค่าอุตสาหกรรม ปริมาณการฟื้นตัวของทรัพยากรหมุนเวียน4) ขั้นตอนการกลับคืนสู่ธรรมชาติของทรัพยากร ควรมีตัวชี้วัด คือ ปริมาณการกำจัดขยะสิ่งปฏิกูลหรือวัสดุที่ไม่ใช้แล้วอย่างปลอดภัย ปริมาณการปล่อยมลพิษที่สำคัญ จำนวนประชาชนมีจิตสาธารณะและรับผิดชอบต่อสังคม โดยตัวชี้วัดที่เป็นรูปธรรมชัดเจนที่คำนึงถึงการใช้ทรัพยากรอย่างมีประสิทธิภาพ จะทำให้มีเครื่องมือที่สามารถติดตามและประเมินผลทำให้เกิดการบรรลุผลตามเป้าหมายที่ตั้งไว้ตามยุทธศาสตร์ชาติและความร่วมมือระหว่างประเทศ ในขณะเดียวกันก็เป็นประโยชน์ต่อสิ่งแวดล้อมและทรัพยากรธรรมชาติควบคู่ไปกับการเติบโตทางเศรษฐกิจและสังคม

เอกัตศึกษานี้มุ่งศึกษาปัญหาและความเหมาะสมในการกำหนดฐานความผิดอาญาสำหรับการหลอกลวงว่ามีวัตถุระเบิดอันอาจก่อให้เกิดความโกลาหล สืบเนื่องจากการกระทำในลักษณะหลอกลวงว่ามีระเบิดหรือขู่วางระเบิดตามกฎหมายไทยไม่ได้ถูกบัญญัติไว้เป็นการเฉพาะ แต่มีบทบัญญัติหลักที่ใช้บังคับคือ ประมวลกฎหมายอาญา มาตรา 384 ซึ่งอยู่ในภาคลหุโทษ มีระวางโทษจำคุกไม่เกินหนึ่งเดือน หรือปรับไม่เกินหนึ่งหมื่นบาท หรือทั้งจำทั้งปรับ การกำหนดโทษทางอาญาตามมาตราดังกล่าวจึงไม่สอดคล้องแก่ความร้ายแรงของการกระทำความผิดที่อาจก่อให้เกิดความโกลาหลแก่สังคมได้ จากการศึกษาพบว่า เมื่อเทียบกับความร้ายแรงของการหลอกลวงว่ามีระเบิดหรือขู่วางระเบิดซึ่งก่อให้เกิดความแตกตื่นตกใจแก่ประชาชนหรือถึงขั้นเกิดการบาดเจ็บหรือเสียชีวิต ประมวลกฎหมายอาญา มาตรา 384 ไม่สามารถป้องกันและยับยั้งการกระทำความผิดดังกล่าวได้ อีกทั้งจากการเปรียบเทียบกับกฎหมายของต่างประเทศ ได้แก่ ประเทศสหรัฐอเมริกา ประเทศอังกฤษ และประเทศฝรั่งเศส พบว่าทั้งสามประเทศมีบทบัญญัติความผิดอาญาที่เกี่ยวข้องกับการหลอกลวงว่ามีระเบิดไว้เป็นการเฉพาะและจัดเป็นอาชญากรรมที่มีความร้ายแรงจึงมีอัตราโทษที่ค่อนข้างสูง ดังนั้น เอกัตศึกษาฉบับนี้จึงเสนอให้กำหนดฐานความผิดอาญาสำหรับการหลอกลวงว่ามีวัตถุระเบิดอันอาจก่อให้เกิดความโกลาหลขึ้นมาใหม่ เพื่อแก้ไขปัญหาความแตกต่างของโทษทางอาญาสำหรับการกระทำความผิดอย่างเดียวกันในการหลอกลวงว่ามีระเบิดและปัญหาเรื่องสัดส่วนการลงโทษที่ไม่สอดคล้องกับความร้ายแรงของการกระทำความผิด

เอกัตศึกษาฉบับนี้มีวัตถุประสงค์เพื่อศึกษาแนวทางปรับปรุงเหตุฉกรรจ์สำหรับความผิดฐานมีไว้ครอบครองซึ่งยาเสพติดและวัตถุออกฤทธิ์ให้สอดคล้องกับหลักการลงโทษที่ได้สัดส่วน โดยผู้วิจัยมุ่งศึกษาทั้งแนวคิดและทฤษฎีที่เกี่ยวข้อง พัฒนาการของกฎหมายยาเสพติดไทยและแนวทางการตีความของศาลฎีกา ตลอดจนศึกษาในเชิงเปรียบเทียบกับพันธกรณีระหว่างประเทศและบทบัญญัติในกฎหมายยาเสพติดของต่างประเทศ เพื่อนำมาวิเคราะห์และเสนอแนะแนวทางปรับปรุงเหตุฉกรรจ์สำหรับฐานความผิดดังกล่าวให้มีความเหมาะสมมากยิ่งขึ้นจากการศึกษาพบว่า แม้ประมวลกฎหมายยาเสพติดมีเจตนารมณ์ในการลงโทษผู้กระทำความผิดให้เหมาะสมกับบทบาทของผู้กระทำและความร้ายแรงของความผิด รวมถึงกำหนดให้ผู้บังคับใช้กฎหมายคำนึงถึงพฤติการณ์ประกอบการกระทำความผิดอื่น ๆ นอกเหนือจากปริมาณยาเสพติดในคดีด้วยก็ตาม อย่างไรก็ดี บทบัญญัติเหตุฉกรรจ์หลายกรณีตามประมวลกฎหมายยาเสพติดได้ใช้ถ้อยคำที่กว้างขวางและมิได้มีนิยามกำหนดไว้อย่างชัดเจน กล่าวคือ เหตุฉกรรจ์กรณีการกระทำเพื่อการค้า, เหตุฉกรรจ์กรณีการก่อให้เกิดการแพร่กระจายในกลุ่มประชาชน และเหตุฉกรรจ์กรณีการทำให้เกิดผลกระทบต่อความมั่นคงของรัฐหรือความปลอดภัยของประชาชนทั่วไป ซึ่งเมื่อนำมาปรับใช้กับความผิดฐานมีไว้ครอบครองซึ่งยาเสพติด ย่อมก่อให้เกิดปัญหาในการตีความและบังคับใช้อย่างมาก เนื่องจากลักษณะของความผิดฐานมีไว้ครอบครองซึ่งยาเสพติดนั้นมิได้มีพฤติการณ์ประกอบการกระทำความผิดที่บ่งชี้ถึงเจตนาตามเหตุฉกรรจ์ได้ชัดเจนเท่ากับความผิดฐานอื่น ๆ จนในท้ายที่สุด ผู้บังคับใช้กฎหมายมักจะตีความเหตุฉกรรจ์ดังกล่าวตามอัตวิสัย ซึ่งก่อให้เกิดผลลักลั่นกันในแต่ละคดี และทำให้การลงโทษผู้กระทำความผิดไม่สอดคล้องกับหลักการลงโทษที่ได้สัดส่วนอย่างแท้จริง ดังนั้น ผู้วิจัยจึงเสนอแนวทางในการปรับปรุงแก้ไขโครงสร้างบทบัญญัติและเหตุฉกรรจ์สำหรับความผิดฐานมีไว้ครอบครองซึ่งยาเสพติด เพื่อให้การบังคับใช้เหตุฉกรรจ์สำหรับความผิดฐานดังกล่าว มีขอบเขตที่ชัดเจนเป็นธรรม และสอดคล้องหลักการลงโทษที่ได้ส่วนมากยิ่งขึ้น

ปัจจุบัน มีการใช้ข้อมูลเกษตรกรรมในระบบเกษตรอัจฉริยะอย่างแพร่หลาย วิทยานิพนธ์ฉบับนี้ จึงมีวัตถุประสงค์ที่จะศึกษาแนวคิด ทฤษฎี กฎหมาย มาตรฐาน และแนวปฏิบัติเกี่ยวกับ การคุ้มครองข้อมูลเกษตรกรรมในระบบเกษตรอัจฉริยะ รวมถึงปัญหาที่เกิดขึ้นจากการเข้าถึงและการใช้ข้อมูลเกษตรกรรมในระบบเกษตรอัจฉริยะทั้งโดยภาครัฐและภาคเอกชน โดยศึกษากลุ่มตัวอย่างโครงการที่ได้รับการสนับสนุนจากกองทุนพัฒนาดิจิทัลเพื่อเศรษฐกิจและสังคม ในกรอบนโยบายด้านการเกษตร ผลการศึกษาได้แสดงให้เห็นว่ายังไม่ปรากฏว่ามีผู้ให้บริการระบบเกษตรอัจฉริยะรายใดที่ดำเนินการอย่างมีความชัดเจนและปฏิบัติตามกฎหมาย มาตรฐาน และแนวปฏิบัติที่เกี่ยวข้อง ได้ตามสมควรจึงจำเป็นต้องมีกฎหมายและนโยบายที่สอดคล้องกับข้อเท็จจริงที่เกิดขึ้นในปัจจุบัน และเป็นไปตามแนวทางสากล เข้ามากำกับดูแล โดยเฉพาะในประเด็นเกี่ยวกับการเข้าถึงและการใช้ข้อมูล ความเป็นเจ้าของข้อมูล วัตถุประสงค์ของการใช้ข้อมูล ความเป็นส่วนตัว และความมั่นคงปลอดภัย
