A Guide To Obtaining Required Regulatory Approvals For New Industrial Facilities In California, Bruce A. Beckman, Michael W. Prairie

This Article was written as a guide for the attorney advising his client who proposes to construct or expand an industrial facility in California. The authors first provide a digest of potentially applicable local, state, and federal regulatory programs and certain other non-regulatory considerations. The authors then discuss the air and water requirements and the other regulatory schemes that impose the most serious constraints on industrial development in California. The authors further examine the risks and uncertainties that might result from various aspects of the regulatory processes and the relative ineffectiveness of judicial review. This Special Project has carried out three broad purposes.First, it has synthesized and organized materials concerning drugs and criminal responsibility into a useful guide for legal practitioners and others interested in the problems of the drug dependent defendant. Second, it has identified serious analytical flaws in many of the defenses available to the criminal defendant. Finally,it has responded to these deficiencies with proposals intended to protect not only the legal rights of the drug dependent defendant but also the rights of society pertaining to criminal justice. Locke et al. argue elsewhere in this issue that medical licensure should be abolished. Their reasoning is direct and seductive - but their free market cure is worse than the disease they describe. Their major premise, for example, is simply wrong: "Any governmental action that violates individual rights is improper." For this notion they cite the ultraconservative novelist Ayn Rand who talks about things that are "right" for humans to do. There is, currently, a flurry of activity as the present Administration, along with the United States Department of Energy and the United States Nuclear Regulatory Commission, struggles to develop a comprehensive national program for the management and disposal of radioactive wastes. The first section of the paper deals with some of the inherent technical issues. This includes a review of the origin of nuclear wastes; the hazards of the wastes, including impacts upon the biological environment; and the extent of the state of the art for disposing of such wastes. Incapacitating The Habitual Criminal: The English Experience, Sir Leon Radzinowicz, Roger Hood

Michigan Law Review

In this Article, Sir Leon Radzinowicz and .Dr. Roger Hood trace 150 years of unsuccessful English efforts to identify, sentence, and reform habitual criminal offenders. The Supreme Court's recent decision in Rummel v. Estelle has publicized habitual offender statutes in the United States. But Rummel primarily addressed the constitutionality, rather than the desirability, of a state habitual offender statute. This Article examines the broader policy questions common to habitual offender programs in both the United Stales and Great Britain. It describes the tension between liberal tradition and the state's desire to incapacitate those who repeatedly threaten life or property.
