Law, Medicine And The Mass Media: Uneasy Partners, Bernard Rubin

UC Law SF Communications and Entertainment Journal

Restraints have long been imposed on speech and advertising by doctors and lawyers with the result that members of these professions have traditionally feared publicity. Modern times, however, witness increasing exposure of the professions in the media. The author examines the traditional restraints, First Amendment implications, and the performance of the media in presenting legal and medical issues. He proposes new standards for medical and legal reporters and reports, and concludes that involvement in public debate should be part of satisfactory professional conduct.

The trend of current genetic research is clear. Assuming the legal system is eventually presented with the scientific capability of "reading" DNA and the statistical ability of predicting with substantial accuracy the probable future consequences of aberrant genetic structure, some very difficult questions will be posed. How should the criminal justice system deal with a criminal offender whose conduct was caused by a genetic aberration? Does society have the right to seek out such individuals before they cause harm and remove them from the community?

This Note advocates the use of the beyond-a-reasonable-doubt standard of proof in proceedings to terminate parental rights permanently. The Note will commence with background considerations such as the authority of the state to terminate parental rights, the rights of the parties involved in a termination proceeding and a discussion of standards of proof. Consideration will also be given to the factors which should have an impact on the standard of proof in permanent termination proceedings. Special Problems Of Custody For Unaccompanied Refugee Children In The United States, Ellen J. Durkee

Part I of this note provides an overview of federal legislation regarding admissions of unaccompanied refugee children. Part II describes various obstacles to a smooth transition from the child's admission into the United States to his or her placement by a state court with a permanent legal custodian who ensures that the child receives care and supervision. Problems in this area frequently result from uncertainties regarding long-term financial responsibility for the child. Also common are procedural difficulties in introducing unaccompanied refugee children into state child welfare systems. Proponents of surrogate gestation contracts base their case on both the constitutional privacy rights of persons involved in the contract and the notion that contractual agreements are capable of sufficiently protecting all interests involved. This article first speculates on how courts might handle surrogate gestation contracts under existing laws and offers arguments for and against such contracts. Although some commentary on the contractual aspect of the agreement exists, little attention has been given to the privacy arguments of the parties. Beyond Shooting Snaildarters In Porkbarrels: Endangered Species And Land Use In America, Irma S. Russell, George Cameron Coggins

This article examines endangered species law as it may affect land use in the United States. The first section describes the legal and biological contexts into which the ESA intruded. Section II outlines the protective mechanisms established by the 1973 version of the Act and their reception by the courts. The third section discusses the corrective amendments to the Act enacted in 1978. The final section applies the law as it has developed and as it is likely to evolve to a series of more or less hypothetical land use conflicts, forecasting multiplication of the disputes between endangered species and …

For purposes of this analysis, "civil commitment" is a form of noncriminal

confinement for those who are legally found to be mentally

Teaching The Theories Of Evolution And Scientific Creationism In The Public Schools: The First Amendment Religion Clauses And Permissible Relief, J. Greg Whitehair

University of Michigan Journal of Law Reform

This Note explores the propriety of teaching the theory of evolution and the scientific creation model in public elementary and secondary schools. Part I discusses the powers of the state and its political subdivisions to set public school policy and curriculum content and the extent to which those powers are circumscribed by the religion clauses of the first amendment. Part I concludes that the religion clauses permit the teaching of evolutionary theory in public schools.
