The National And International Legal Complications Of Subseabed Emplacement Of High-Level Nuclear Waste, Lynn Carlson

Marine Affairs Theses and Major Papers

High-level radioactive waste produced by nuclear power generation, weapons production, and medical research has been accumulating in temporary storage pools in many countries. A permanent method of disposal will soon benecessary to ensure against contamination of man and the environment. Land-based geologic formations, such as salt domes, are the preferred sites for disposal at this time in the United States. Subseabed emplacement is one option under consideration and the technological aspects of this method are currently being studied. In order to resolve these issues, it is proposed that relevant laws be conditionally amended to legalize subseabed emplacement, but only after …

Abuse And Neglect Of The Unborn: Can The State Intervene, John E. B. Myers

Advances in scientific knowledge of fetal development continue at a rapid pace. This expansion has enhanced the physician's ability to prevent fetal defects and to treat the child in utero. This article examines when, if ever, the state may intervene in the life of a pregnant woman to prevent abuse or neglect of her unborn child. The author examines the legal status of the unborn child through an historical examination of property, tort and criminal law. He then analyzes state interests in protecting the unborn as balanced against the rights of the parents. In conclusion, the author contends that a …

It is the central thesis of this paper that what is needed to assess the validity of many of the criticisms directed toward legal practice and training, and to resolve many of the controversies surrounding attempts to correct these criticisms, is a representation or documentation of the structure of expertise in legal practice - especially in trial advocacy since this represents the focus of most complaints. Without such a representation it is difficult to support allegations of incompetence or to defend the efficiency of specific reform on other than subjective or intuitive grounds. At this time no systematic representation exists.

n order to combat genetic disease, genetic engineering may (and frequently does in fact) rely upon eugenics, the science that deals with the improvement of heredity. Stated simply, a positive eugenics program seeks to develop superior qualities in man through the propagation of his superior genes; with the positive eugenists seeking to produce a 'new breed' with keener and more creative intelligence. Contrariwise, a negative eugenics program attempts only to eliminate genetic weaknesses. The United Nations has responded to marine pollution by charging its specialized agency, the Inter-Governmental Maritime Consultative Organization ("IMCO"), with the dual obligations of improving mari- time safety and preventing marine pollution. Yet, despite several major conventions intended to eliminate outmoded tanker designs and pollut- ing practices, oil spills and discharges continue. This article will address the question of compliance with and en- forcement of international agreements concerning oil pollution by tank- ers. We live in a highly complex, industrialized environment. Specific work-related events occurring within this context frequently impact negatively on those who are essential to the operation of our industrial system. Often the impact of events produces human misery, suffering and death. Men and women are injured, maimed and killed. This Article investigates two alternative methods of human conception: Specifically, the artificial insemination of unmarried women for either their own personal purposes of pregnancy without the benefit of marriage or as surrogates for infertile women. Surrogation is evaluated, then, as an analytic complement to the sexual privacy of women who are expressing their sexual freedom through unconventional means to become pregnant.

The conclusion drawn is that an unmarried woman’s fundamental right to privacy or procreation does not encompass a right to either artificial insemination or surrogation. To allow unfettered access to these two methods of conception would - quite simply …

This Comment reviews the history of tort law treatment of the fetus who is wrongfully injured or killed. The Comment discusses case history and wrongful death statutes, with a focus on Washington law.
