Denial Of Unemployment Benefits To Otherwise Eligible Women On The Basis Of Pregnancy: Section 3304(A)(12) Of Federal Unemployment Tax Act, Michigan Law Review

This Note examines the conflicting interpretations of section 3304(a)(12) of the Federal Act. The Porcher decision serves as a point of reference throughout this Note, since opposing constructions of the section were presented in the case. Part I describes the basic framework of FUTA and presents the disparate interpretations of section 3304(a)(12) that have been advanced.
Part II analyzes section 3304(a)(12) with reference to the statutory language and legislative history. As a preliminary matter, this part considers the degree of deference that should be afforded the Secretary of Labor's certification of state programs that treat pregnancy like all other medical …

Orvs On The Cape Cod National Seashore, Karen G. Chaffee

With the creation of a National Seashore, we incur the responsibility of maintaining and preserving it. Since the establishment of the Cape Cod National Seashore in 1961, the use of off-road vehicles (ORV's) has increased dramatically. These vehicles damage the fragile ecosystems of the seashore. The National Park Service Cooperative Research Unit at the University of Massachusetts, Amherst was commissioned to undertake a five year study of the many facets of off-road vehicle impact on beach and dune as well as salt marsh and tidal flats.

The Tender Years Presumption: Is It Presumably Unconstitutional, Robb Strom
San Diego Law Review
This Comment examines a common presumption that arises in disputes between the natural parents of young children, the presumption that custody should be awarded to the mother. The author argues that this presumption is based on the perception of mothers as better custodians through their physical caretaking ability and cultural biases regarding the role of women in the family. The author argues that the tender years presumption violates the equal protection clause of the fourteenth amendment. Cetacean Rights Under Human Laws, Mary A. Winters

This Comment addresses the recent controversy surrounding the award of a permit to Sea World, Inc., pursuant to the Marine Mammal Protection Act of 1972, allowing them to scientifically study ninety orca whales and capture ten whales for public display. The author analyzes the standards a court would use to review the controversial permit, and discusses the proposed legal actions and options of those opposed to the permit. The author then changes perspective and advocates protecting the animals by granting cetaceans themselves legal rights, and examines the justifications and advantages of this new approach.
