After decades of reports on the need for considered
public policy on immunization,' it is time for action. The
"problem" of immunization is complex, but the constituent complexities have been recognized for years. In a recent report on Vaccine Supply and Innovation, the Institute of Medicine referred to vaccines as "an elegant solution to one of the perennial problems of the human race-infectious
disease." Vaccines are effective, inexpensive, simple to produce, and easy to deliver. They have succeeded in quelling the threat to public health of such formerly devastating diseases as smallpox, poliomyelitis, and diphtheria. Today, however, the prospects for …

Reducing Acid Rain In Eastern North America: The Scientific Basis For An Acid Rain Control Policy, Michael Oppenheimer

This Article presents the scientific basis for an effective acid rain control policy. Part I suggests that if a choice must be made, regulation should focus primarily on sulfur dioxide emissions rather than nitrogen oxide emissions because sulfur deposition is the major cause of watershed acidification. Part II explains the need for at least a fifty percent reduction in sulfur dioxide emissions to meet a "safe" deposition level. Part III specifies the geographical allocation of sulfur emission reductions necessary to attain target deposition levels in the northeastern United States and southeastern Canada. The Dilution Of The Clean Water Act, Mark C. Van Putten, Bradley D. Jackson

This Article argues that the zero discharge goal of the Clean Water Act is more than naive rhetoric. To the contrary, it is the Act's raison d'être, and it is woven into the fabric of the Act's operative provisions. So understood, the zero discharge goal can and should provide continuing guidance for EPA's implementation of the Act.

During the past several decades, litigation has played a major role in the attempt by citizens to realize environmental objectives. Its impact has been elaborated extensively in the vast array of writing in law journals as well as in the cases themselves. Most analyses have focused on specialized subjects of either substantive policy or legal procedure. In this brief Essay I attempt a more comprehensive overview involving two background factors- the growth of environmental values since World War II and the response of governmental institutions to the resulting demands placed upon them. Georges Bank--Common Ground Or Continued Battleground--Comparative Marine Resource Management And Environmental Assessment In The United States And Canada, Donna R. Christie

This Article examines the United States and Canadian legal frameworks for marine resource management in the area of the Bay of Fundy, Gulf of Maine, and Georges Bank. The author argues that, while the controversies between the United States and Canada concerning boundaries, fish, and transboundary environmental effects of energy development have existed for almost two centuries, current environmental problems are straining the relations between the two countries. The author presents a comparative analysis of the environmental assessment and the marine fisheries management and outer continental shelf development regimes of the United States and Canada, addresses the prospects for the …

International Environmental Law And Policy: An Overview Of Transboundary Pollution, John Warren Kindt
San Diego Law Review
This Article provides an overview of several of the transboundary pollution issues affecting the Law of the Sea. The author argues that global pollution and transboundary pollution have historically been viewed from two major perspectives, namely from the land and from the ocean. The author suggests that more emphasis should be placed upon the ocean as the observational standpoint, because this standpoint is relatively unencumbered by pre-existing disputes involving land-based pollution. The author further argues that this oceanic standpoint also provides for fresh perspectives and allows for innovative policymaking to prevent, reduce, and control international pollution.

This Article discusses the nature of spatial and functional zones in the ocean, and their relation to the purposes of coastal-state and international jurisdictions. The author argues that advances in ocean technology, growing requirements for marine resources, and an increasing number of ocean users, have created the need for a functional and managerial approach to the exploitation of offshore resources and the use of ocean space. The author further argues that the boundaries which man has set in the ocean have generally inhibited such a development, because they carry with them an idea of separation or divisiveness, which has been …

This Comment demonstrates that artificial nutrition and hydration are life-sustaining treatments which all patients have a right to forego under Washington's common law, state constitution, and NDA. Countervailing state interests do not compel a contrary result. Moreover, artificial nutrition and hydration do not require the preclusion of surrogate decisionmaking already recognized by Washington in the life-sustaining treatment context. However, since current judicial guidelines for surrogate-made decisions are inadequate, this Comment concludes by proposing substantive guidelines for such decisions.

This Note indicates that both the district court's use of declaratory relief on the hatchery fish issue and the merits of its declaration on the environmental issue were entitled to affirmance. An analysis of the procedural history of the case suggests that the court should have decided the environmental issue. An analysis of the right to habitat protection reveals that habitat protection should be regarded as an implied term of the treaty right to take fish and that measuring the scope of the right by the tribes' moderate living needs fulfills the purpose of the treaty fishing clause. This paper examines the EPA's new policy regulating plant pesticides and presents the legal, scientific and policy issues surrounding the regulation of genetically engineered plants. Part I introduces the concepts covered in this paper. Part II.A. discusses products that have originated from biotechnology. Part II.B. describes the EPA's legal authority for regulating plant pesticides and other biotechnology products. Part II.C. presents the history of federal regulation of biological pesticides and biotechnology products. Improving Parent-Child Relationships Within The Divorced Family: A Call For Legal Reform, John S. Murray

In this Article, I address these three questions within the framework provided by the goal to be achieved. Part I outlines the present system and its problems, discussing both its effects on divorced family members and the problems inherent in the exclusive custody rule. Part II builds a proposal for legal reform by first considering the effect of conflict within the family, then identifying five value guidelines that should control the relationships, and finally describing the proposal in detail. Part III analyzes the pros and cons of the reform proposal to determine whether its adoption could establish a healthier environment …
