This article will attempt to show that scrupulous adherence by both Israel and the United States to principles of international and U.S. law could be a major step in the resolution of the Palestinian- Israeli conflict. It will also attempt to show that the implementation of internationally recognized principles of human rights could reduce terrorism and violence in the region.

Tuna Fishery In The East Central Atlantic Region: The Feasibility Of Nigeria's Participation, Aderemi Olasupo Abioye

Marine Affairs Theses and Major Papers

Tuna fishery is widely practiced in the east central Atlantic region by many fleets of different nationality. Most of the catch is taken by distant-water fleets. The new Law of the Sea convention, which gives coastal states an exclusive economic zone with outer limit of 200 miles, now allows the coastal states to make the most use of the living resources in their waters. The surplus shall be allocated to other states in the region and those traditionally fishing in the area before. Nigeria with a population of about 100 million people spends substantial foreign exchange annually on the importation …

Having successfully initiated and developed the legal aspects of the Exclusive Economic Zone (EEZ) the challenge which now arises for the developing coastal nations is to implement an ocean management system to more fully realize the potential benefits of extended jurisdiction. This study discusses the needs and problems developing nations may encounter in developing such a management system and also considers the ways and means to meet these needs and overcome these problems. Civil Claims Of Adults Molested As Children: Maturation Of Harm And The Statute Of Limitations Hurdle, Carolyn B. Handler

Fordham Urban Law Journal

This Note, focusing on New York law, demonstrates that the statute of limitations is the primary procedural difficulty that adult victims of childhood incest abuse encounter in bringing their civil claims. Specifically, the traditionally short statutes of limitations for assault, battery and infliction of mental distress often preclude the adult victim of childhood incest from seeking a remedy within the statutorily prescribed time. Part II of this Note presents an overview of the nature of incest abuse and its resultant injuries and considers the purposes and policies behind statutes of limitations. Judicial Conscience And Natural Rights: A Reply To Professor Jaffa, Bruce Ledewitz

This Article replies to Professor Harry V. Jaffa’s article “What Were the ‘Original Intentions’ of the Framers of the Constitution of the United States?” The Article focuses on the gap the author argues Professor Jaffa left between the consciousness of the Framers and the practice of judicial review today. The author argues that the understanding that Professor Jaffa brings to the intent of the Framers is one that opens up the Constitution to the call of justice, but the author critiques the utility of Professor Jaffa’s work in resolving the contentious constitutional issues of today, including abortion and capital punishment.

Testing For Drugs Of Abuse: Methods And Reliability, Edward A. Kaufman

Journal of Law and Health

The purpose of this paper is to discuss the entire testing process, from specimen collection and preparation (vital processes that are often beyond the control of the laboratory) to test methods, quality assurance measures, medico-legal documentation, and result reporting and interpretation. Each of these steps demands careful attention, and the hallmark of a responsible, quality-conscious laboratory is that it can offer a complete testing system that focuses not only on the assays themselves but also on each of the necessary precautions and transactions so crucial to the viability of test results.

This country is in the midst of what has been identified as a medical malpractice "crisis."' A similar "crisis" was recognized over a decade ago. 2 In both eras, rates for medical liability insurance soared, 3 frequency and severity of claims reportedly increased, 4 and damage awards spiralled.' Decreased availability of malpractice insurance coverage, 6 and its increased cost, threatened availability of physician services in certain specialties and geographic areas.
