Race(Ial)Matters: The Quest For Environmental Justice Review Essay, Sheila R. Foster
Faculty Scholarship
The essays contained in Race and the Incidence of Environmental Hazards: A Time For Discourse and the recent report by the United States Environmental Protection Agency (EPA), Environmental Equity: Reducing Risk For All Communities represent what appears to be a remarkable consensus that low-income and minority communities bear a disproportionate share of environmental exposures and health risks. These two works also reflect the synergy of efforts by various elements of both the traditional civil rights and mainstream environmental movements to address issues of "environmental racism." Indeed, the current "environmental justice," or "environmental equity,"' movement is a combined effort of grassroots …

Child Custody Modification Based On A Parents Non-Marital Cohabitation: Protecting The Best Interests Of The Child In Virginia, Katherine A. Salmon
Child Custody Modification Based On A Parents Non-Marital Cohabitation: Protecting The Best Interests Of The Child In Virginia, Katherine A. Salmon
University of Richmond Law Review
In recent years, courts have been faced with deciding what constitutes "parental fitness" for custody purposes in light of society's changing mores and values. In attempting to define the role that a parent's sexual lifestyle plays in a custody or visitation dispute, courts across the country have lost sight of their ultimate responsibility - to protect the best interests of the child. Instead, courts often seem more concerned with protecting the sexual freedom of unmarried parents than in contemplating the impact cohabitation may have on children. The Court of Appeals of Virginia is no exception.

Preserving The Third Temple: Israel's Right Of Anticipatory Self-Defense Under International Law, Louis R. Beres
Preserving The Third Temple: Israel's Right Of Anticipatory Self-Defense Under International Law, Louis R. Beres
Vanderbilt Journal of Transnational Law
In this Article, Professor Beres discusses certain political tensions in the Middle East and the appropriateness of preemptive military action by Israel. He concludes that the ongoing hostilities and threatening overtures by Israel's enemies could give Israel sufficient basis pursuant to international law to conduct preemptive strikes. Upon reaching this conclusion, Professor Beres considers the level of force Israel should employ in various preemptive or counter retaliation scenarios. While the degree of preemption is debatable, the author believes that the preservation of Israel may require some preemptive action in the near future.
The Rights Of Gays To Adopt Children: Fortifying The Defenses Against Societal Prejudice, Stephanie Landay
The Rights Of Gays To Adopt Children: Fortifying The Defenses Against Societal Prejudice, Stephanie Landay
Cardozo Journal of Equal Rights & Social Justice
The article argues that the right of gays to adopt children is often denied due to societal prejudices and biases, which influence court decisions. It advocates for the adoption of the "nexus test" to ensure that decisions are based on the best interest of the child, free from discrimination. The article also emphasizes the need to classify gays as a suspect class to overturn discriminatory statutes.
