From Conflict To Cooperation: Fishery Relations In The Sea Of Japan, Tsuneo Akaha

Washington International Law Journal

This article traces the postwar experiences of Japan, the most important fishing nation of the Japan Sea region, in establishing and expanding fishery relations with the Soviet Union/Russia, South Korea, and North Korea. The gradual shift from conflict to cooperation in the exploitation and management of fishery resources shows that pragmatic cooperation among the countries involved has been made possible by their willingness to accommodate mutual economic interests on an increasingly reciprocal basis. International law, particularly the U.N. Convention on the Law of the Sea, and the legal norms and principles it embodies have aided the parties in arriving at …

Ortho Pharmaceutical Corp. V. Smith: Willful Infringement-Reliance On A Flawed Letter From Counsel, Brian David Bellamy

In Ortho Pharmaceutical Corp. v. Smith, the Federal Circuit Court of Appeals held that an infringer's reliance on patent counsel's letter is justified if the "opinion [is] thorough enough, as combined with other factors, to instill a belief in the infringer that a court might reasonably hold the patent is invalid, not infringed, or unenforceable."' In crafting this decision, the court focused on the intent and the reasonable beliefs of the infringer. In this article the author notes that the Endangered Species Act has increasingly come under attack. The attack on the ESA has been brought about primarily due to the substantial adverse economic effects caused by enforcement of the ESA 's provision. The author seeks to alleviate the economic burden on the affected parties in order to decrease the push for ESA reform. First, the author examines Fifth Amendment taking theory and concludes that it is insufficient to rectify the problem. Agriculture, broadly defined, is the country's largest industry. Fully one-fourth of the work force is involved in agricultural production, processing and manufacturing, and in the marketing and distribution of agricultural products. Agriculture's contribution to the Gross National Product is at least twenty percent of the total. Agriculture is a highly regulated industry. For example, it has been estimated that to bring an ordinary product such as the hamburger to the American consumer almost 300 statutory programs are involved. The cost of regulation for a pound of Thanksgiving turkey could be as high as fifteen cents.2 And, for highly processed products …

Addicted Pregnancy As A Sex Crime, Lorraine Schmall

Northern Illinois University Law Review

This article examines how controls on addictive pregnancy present a new and dangerous threat to the treatment of women under the law. The author first examines the relationship between the mother and the fetus, concluding that no coherent status attaches to the unborn vis-a-vis its own mother which could justify depriving her of her privacy, autonomy, and the right to make personal family decisions. The article continues with a historical discussion of disparate legal treatment of women throughout history, and the discriminatory effect of state intervention into cases of addicted pregnancy on poor people and people of color. In focusing on legal designations of male parentage as of the time of birth, this Essay first reviews the methods by which such designations currently are made. The difficulties raised by contemporary methods then will be explored, together with suggested reforms involving laws that could promote earlier, more complete, and more accurate designations of male parentage as of the time of a child's birth.

This article describes and analyzes the role of non-governmental organizations, or NGOs, in the system of governance that has developed to manage the use of natural resources, and that management's impact on the Great Lakes ecosystem. Particular emphasis is given to the organizational history of one such NGO, Great Lakes United, and its actions and strategies in relation to the Canada-U.S. Great Lakes Water Quality Agreements, and to the negotiations leading to the 1987 Protocol to the Agreements.
