Free Trade As An Extremist Ideology: The Case Of Nafta, Robert W. Benson

Seattle University Law Review

This article purports that free tradism has become such a classic extremist ideology, just as, until recently, Marxism-Leninism was. Free tradism is fairly described as fitting the two criteria that characterize extremist ideologies: (1) their adherents are oblivious to cognitive dissonance contradicting their analyses, and (2) their adherents are willing to plunge themselves and others into great risks in the name of the ideology. This article adduces evidence in these two categories, using NAFTA as an example, analyzing concrete issues of trade theory, jobs, the environment, human rights, and democracy.

Pto Perspective On Recent Developments In Patent Protection For Computer Hardware And Software, Lee E. Barrett

This Article explores the area of patent protection for computer related inventions, The author examines the problem of determining whether a mathematical algorithm qualifies as patentable subject matter under 35 U.S.C. § 101 and the interpretation of means-plus-function limitations under 35 U.S.C. § 112 6. In his examination, the author explains the perspective of the United States Patent and Trademark Office, as well as the position taken by the Federal Circuit Court of Appeals in the recent cases of In re Alappat and In re Donaldson Co.

Womb For Rent: Norplant And The Undoing Of Poor Women, Jeanne L. Vance

UC Law Constitutional Quarterly

In a desperate effort to cut government costs, many state legislators have introduced bills that would pay women on welfare to be surgically implanted with the longlasting contraceptive Norplant. This Note explores the constitutionality of these proposals by analyzing traditional and developing privacy law, the interplay between constitutional rights and the receipt of public benefits, and the equal protection doctrine as it applies to gender classifications. This Note argues for a constitutional interpretation that takes into account social conditions behind legislation and concludes that, under any of these doctrines, the described proposals would be unconstitutional.

Aiding And Altruism: A Mythopsycholegal Analysis, Thomas C. Galligan Jr.

University of Michigan Journal of Law Reform

This Article asserts that traditional tort law should be modified to provide for a duty to act in situations in which a reasonable person would act altruistically. Part I examines traditional and more recent tort doctrine governing the duty to aid. Part II discusses compassion from philosophical, literary, and mythological points of view and explores how these viewpoints inform compassion's possible relationship to a legal duty to help. Part III considers the connections between psychological theories and studies of action, altruism, and empathy. In addition to Batson's work, I reexamine the classic studies of Latan6 and Darley and the application …
