Public Land & Resources Law Review
The United States Court of Appeals for the Ninth Circuit upheld the district court’s grants of summary judgment and injunctive relief against BOEM for violating the ESA and CZMA. The Ninth Circuit found BOEM violated NEPA, CZMA, and the APA by failing to adequately consider the environmental impacts of well stimulation treatments. The Ninth Circuit also reversed the lower court’s grant of summary judgment against the Environmental Defense Center for their NEPA claims.
Robert Greenleaf: Changing Management To Change Society, Riccardo Colasanti
Robert Greenleaf: Changing Management To Change Society, Riccardo Colasanti
Journal of Vincentian Social Action
This paper is a critique of the thought provoking, if not problematic, ideas presented in Robert Greenleaf’s pamphlet, The Servant as Leader (Greenleaf, 2008) which appeared in print in the 1970’s. This text constituted the seminal work upon which a progressive, transformational movement was created in the training of management cadres in North American companies, with the transition of the concept of a “leader boss” to that of “leader as a servant”. The limits of Greenleaf’s servant leadership model are tested against the capitalist society within which we live and found contradictory, but no less inspiring in its attempt to …

Concealing More Than Your Affairs: A Deep Dive Into The World Of Cryptocurrency And Its Future Influence On Family Law In Ohio, Milica Prica
Cleveland State Law Review
This Note dives into the world of cryptocurrency and family law in Ohio. With its current popularity and dramatic fluctuations, cryptocurrency has created a new legal issue in the family law practice. Specifically, this Note focuses on the concealability of Bitcoin and how that influences division of property, spousal support, and child support in Ohio divorce proceedings and settlements. To tackle this issue, this Note begins with the history of Bitcoin, its value since the beginning, as well as the reason for its fluctuations. This Note also looks into what makes Bitcoin and other cryptocurrency forms so concealable. This Note …
A Call For The Legalization Of Two Sustainable Means Of Final Disposition In Ohio, Aimee Sheetz
A Call For The Legalization Of Two Sustainable Means Of Final Disposition In Ohio, Aimee Sheetz
Cleveland State Law Review
Several states currently have laws that allow for alkaline hydrolysis as an alternative to burial or cremation. A few states also allow for the composting of human remains. People are choosing these means of disposition for themselves and their loved ones due to environmental, financial, and societal reasons. Ohio currently does not allow either of these methods to be performed within the state. There have been attempts to legalize alkaline hydrolysis in Ohio. This Note calls for the legalization of both methods of disposition by including them in the Ohio Revised Code. This would provide clarity to the Ohio Board …
How To Be An Anti-Racist Educator: A Book Review Through An Educational Perspective, Maria Cristina F. Soares, Melanie Morales
How To Be An Anti-Racist Educator: A Book Review Through An Educational Perspective, Maria Cristina F. Soares, Melanie Morales
Journal of Multicultural Affairs
The authors reviewed the book How to be an Antiracist by Ibram X. Kendi (2019) while reflecting on how Kendi’s brilliant dismantlement of racism and discrimination would help educators become conscious of how racism operates in our society, their schools, and their communities. Kendi’s book could motivate teachers to self-reflect on intrinsic feelings and misconceptions about race and culture built over time, allowing them to adopt new attitudes towards their students and school community. The authors considered the need to reevaluate systemic racism in schools as research has, for instance, found evidence of discriminatory practices towards African American boys (Gregory …
Toward Justice Epidemiology: Outlining An Approach For Person-Centred Access To Justice, Andrew Pilliar
Toward Justice Epidemiology: Outlining An Approach For Person-Centred Access To Justice, Andrew Pilliar
Dalhousie Law Journal
The COVID-19 pandemic has brought widespread public attention to the fields of epidemiology and public health. These fields share a common commitment to the systematic study of disease across populations, with goals of better understanding, preventing, and treating adverse health events. They are empirical, evidence-based, and person-centred. This paper draws on the histories, norms, and methodologies of public health and epidemiology to construct a novel field of study: justice epidemiology. In recent years, a growing body of unmet legal needs research in Canada and elsewhere has demonstrated that justiciable events are likely ubiquitous, but also that these events tend to …
Ethical Considerations Of Clinical Research In Emergency Care Settings: A Review, Adith Velavan
Ethical Considerations Of Clinical Research In Emergency Care Settings: A Review, Adith Velavan
Honors Scholar Theses
Emergency and acute care settings are some of the most volatile and high intensity areas of any healthcare operation. Better understanding of systems and treatments in these spaces are critical to improving outcomes for the high risk patients that are treated there. Clinical research serves as a cornerstone of modern medical research, and is critical to the further improvement of clinical care in these settings. This thesis serves to explore the ethicality of such research given the constraints of emergency medicine settings. Not only does this thesis provide a strong foundation regarding the history and current practices of clinical research, …

Eugenics Not Eradication: How People With Disabilities Have Lost The Right To Life, Ava Standish
Eugenics Not Eradication: How People With Disabilities Have Lost The Right To Life, Ava Standish
Helm's School of Government Conference - 2021-2024
Disability-selective abortion stems from a eugenical philosophy not a hope of eradication. Disabilities cannot be eradicated because they are not diseases. Eugenics seeks to purify society from those who are considered “inferior” and to encourage the rate of births considered “superior.” Eugenics continues today through selective abortion of children with disabilities. These children deserve the right to life guaranteed by natural rights, human rights, and the laws of the United States. Children with disabilities, particularly Down Syndrome, have lost this right to life in the United States and abroad. In the United States, 67% of children with Down Syndrome are …

Renovating America's Electrical Grid: Renewable Sources And Resilient Delivery, Justin O'Hare Giffee
Renovating America's Electrical Grid: Renewable Sources And Resilient Delivery, Justin O'Hare Giffee
Student Theses 2015-Present
Since the late 1800s, America’s electrical grid systems have relied primarily upon fossil fuels for sources of electricity. Due to the outdated structural foundations and glaring holes in distribution networks, the existing electrical grids struggle with electricity escaping, and modern issues such as cybersecurity, resilience, and weather-related events associated with climate change. This essay discusses ongoing problems with current electric grid systems and aims at explaining the importance of incorporating renewables as a solution for these problems into a new grid system. In the first chapter, a detailed explanation is provided regarding the current issues present in America's grid systems. …
Cryptic Patent Reform Through The Inflation Reduction Act, Arti K. Rai, Rachel Sachs, Nicholson Price
Cryptic Patent Reform Through The Inflation Reduction Act, Arti K. Rai, Rachel Sachs, Nicholson Price
Law & Economics Working Papers
If a statute substantially changes the way patents work in an industry where patents are central, but says almost nothing about patents, is it patent reform? We argue the answer is yes — and it’s not a hypothetical question. The Inflation Reduction Act (IRA) does not address patents, but its drug pricing provisions are likely to prompt major changes in how patents work in the pharmaceutical industry. For many years scholars have decried industry’s ever-evolving strategies that use combinations of patents to block competition for as long as possible, widely known as “evergreening,” but legislators have not been receptive to …

Creating A New Sports Division The Importance Of Protecting Women’S Sports While Encouraging Sportsmanlike Competition, Taylor Nilson
Creating A New Sports Division The Importance Of Protecting Women’S Sports While Encouraging Sportsmanlike Competition, Taylor Nilson
Helm's School of Government Conference - 2021-2024
Creating a new sports division: The importance of protecting women’s sports while encouraging sportsmanlike competition
The foundation of sports is to encourage respectful and fair competition between two or more individuals. For those who choose to participate, they are pursuing the happiness they find in competition, others have found their livelihood in sports, and most find liberty in their carefree activities.
Given the recent rise in the popularity of the transgender community, it is natural for members that want to compete in sports, specifically women’s sports. However, with that there are also those who would abuse this popularity to support …
Fourthspace: The Role Of Active Social Inclusion In The Workforce Entry Of Syrian Refugees In Scandinavia, Anisa Abeytia
Fourthspace: The Role Of Active Social Inclusion In The Workforce Entry Of Syrian Refugees In Scandinavia, Anisa Abeytia
Master's Theses
The 2015 displacement of Syrian refugees into Scandinavian countries provoked a refugee integration policy adjustment that focused on workforce and higher education entry. It is a policy approach that requires attention on barriers to workforce entry to ensure effective policy implementation. This article provides insight into the larger, often overlooked barriers of Eurocentrism and historical biases on refugee labor integration and provides policy solutions to reduce their impact. Active social inclusion (ASI) and Fourthspace are introduced as a framework to reduce biases to workforce entry and integration time barriers faced by Syrian refugees. ASI can provide mechanisms to increase access …
Asking For It: Gendered Dimensions Of Surveillance Capitalism, Jessica Rizzo
Asking For It: Gendered Dimensions Of Surveillance Capitalism, Jessica Rizzo
Emancipations: A Journal of Critical Social Analysis
Advertising and privacy were once seen as mutually antagonistic. In the 1950s and 1960s, Americans went to court to fight for their right to be free from the invasion of privacy presented by unwanted advertising, but a strange realignment took place in the 1970s. Radical feminists were among those who were extremely concerned about the collection and computerization of personal data—they worried about private enterprise getting a hold of that data and using it to target women—but liberal feminists went in a different direction, making friends with advertising because they saw it as strategically valuable.
Liberal feminists argued that in …

The Tourism Industry And Plastic Waste Policies - Comparative Perspectives From The Portuguese Experience, Marina Monne De Oliveira, Romulo S.R. Sampaio, Patricia Regina Pinheiro Sampaio
Journal of Comparative Urban Law and Policy
This paper investigates the correlations between the tourism industry and plastic waste. It starts by evidencing that increase in tourism is likely to enhance the volume and improper destination of waste, including plastic, which has become a major environmental concern in touristic cities. The paper suggests that, on the other hand, negative environmental impact caused by plastic may disincentivize tourism, due to pollution in beaches and seas. As tourism grew in Portugal, the country experienced an increase in plastic waste and has taken measures to deal with the problem. Portugal passed federal legislation to ban single-use plastic tableware as of …

Georgetown Law Faculty Publications and Other Works
There is a broad consensus around equity’s importance. Even countries that hoarded supplies during the acute phase of COVID-19 seem to understand that the international community must find a means to ensure fairer allocation of medical resources when the next health crisis hits. But there has been little agreement about the concrete steps needed to operationalize fairer access and benefit sharing. That is, what are the workable mechanisms that could reduce the divide between richer and poorer populations? The World Health Assembly, the governing body of the World Health Organization, has appointed an Intergovernmental Negotiating Body to develop a pandemic …
“The Past Got Broken Off”: Classifying “Indian” In The Indian Child Welfare Act, Lucia Kello
“The Past Got Broken Off”: Classifying “Indian” In The Indian Child Welfare Act, Lucia Kello
Journal of Civil Rights and Economic Development
(Excerpt)
In her 1993 novel, Pigs in Heaven, Barbara Kingsolver chronicles the story of an American Indian child, Turtle, and her young, white, adoptive mother, Taylor Greer. In what has been criticized as a controversial imagined fact pattern, Kingsolver writes that while stopped in a parking lot in the middle of the night, Taylor is approached by an American Indian woman holding a baby. Rather mysteriously, the woman informs Taylor that the baby’s mother died and the baby was being abused, upon which Taylor notes that “it looked like someone had been hurting [the woman] too.” After placing the …

Privacy Lost: How The Montana Supreme Court Undercuts The Right Of Privacy, Kevin Frazier
Seattle Journal of Technology, Environmental, & Innovation Law
In 1972, Montanans ratified a new constitution that included a “right of privacy.” The plain text of the provision fails to express the intent of the Framers who not only intended to afford Montanans a right, but also to impose a responsibility on the State to continuously and thoroughly examine State practices in light of evolving means of invading residents’ privacy. This intent has gone unrealized despite the fact that the intent of the Framers is clear, readily available, and the primary source state courts ought to use when interpreting the Constitution. This article delves into the transcripts of the …
Assemblies Of Parties To Multilateral Treaties And Their Normative Authority, Ilias Bantekas
Assemblies Of Parties To Multilateral Treaties And Their Normative Authority, Ilias Bantekas
Georgia Journal of International & Comparative Law
Assemblies of states parties to multilateral treaties are of a twofold nature: those that are active, entrepreneurial, and rally both the political and financial dimensions as well as the stakeholders of their underlying constitutive instrument and those that are content to merely serve as meeting mechanisms. Several assemblies have undertaken extensive funding campaigns, without which their mandate could not have been achieved. In turn, these progressive assemblies have made significant inroads in respect to transnational contracting and forging their limited international personality in such a way as to become credible entities in international relations. This model should be replicated in …
The Ethics Of Governance Of Data Analytics In Healthcare, Andrew Harrington
The Ethics Of Governance Of Data Analytics In Healthcare, Andrew Harrington
Electronic Theses and Dissertations
Recent literature and studies on data governance usually focus on data ethics and governance from a specific country or industry, which has been mostly business, without considering the larger global impact that is affected. Data is a worldwide asset; thus, its implications and considerations should be viewed as such. Hence, this dissertation attempts to incorporate this view by weaving together topics in healthcare, such as the blending of finance and delivery, data governance at the micro and macro levels, data analytics in healthcare, ethics of AI and information management, and technology’s impact on end-of-life practices. Through highlighting these areas of …

Limits On Biomedical Research: Whether, Why, And How, Christine Grady
Limits On Biomedical Research: Whether, Why, And How, Christine Grady
Health Matrix: The Journal of Law-Medicine
This article examines the limitations of laws and regulations in regulating biomedical research. While laws and regulations can serve as guardrails to limit certain research studies, they are often blunt instruments that struggle to keep up with the rapid pace of scientific progress. Moreover, laws in one jurisdiction may not be binding on others, making it difficult to regulate the global scientific community. The article argues that regulatory parsimony should be exercised, imposing regulations only where they work and not where they are unhelpful. The article also explores the ethical considerations surrounding biomedical research and its impact on society, including …
