Symposium On Human Cloning: Legal, Social, And Moral Perspectives For The Twenty-First Century- Foreword: Cloning Debate, Janet L. Dolgin
Hofstra Law Review
In the United States, legislative responses to cloning among both federal and state lawmakers have been rapid and widespread. The Report of the NBAC to President Clinton proposed that Congress prohibit human cloning for a period of years. In the following year, Congress entertained a variety of bills proposing to ban or regulate human cloning. Some proposed prohibiting human cloning. Others proposed allowing such cloning for research purposes. Similarly, soon after Dolly's birth, state legislators presented a large number of bills aimed at regulating or prohibiting human cloning." Other governments and international bodies responded to Dolly's birth with similar speed …

Wrongful Life, Wrongful Birth, Wrongful Death, And The Right To Refuse Treatment: Can Reasonable Jurisdictions Recognize All But One, Mark Strasser
Wrongful Life, Wrongful Birth, Wrongful Death, And The Right To Refuse Treatment: Can Reasonable Jurisdictions Recognize All But One, Mark Strasser
Missouri Law Review
One of the most controversial birth-related torts is the wrongful life action in which a plaintiff sues for damages, claiming that he would have been better off never having lived at all and, but for defendant's negligence, would not in fact have lived. Most jurisdictions refuse to recognize this cause of action. However, the justifications for those refusals are often unpersuasive, since the acceptance of those rationales would imply that other existing practices must be changed. For example, although wrongful life and wrongful birth are different actions involving different duties and harms, many of the rationales for and against recognizing …

Clear And Present Danger: Enforcing The International Ban On Biological And Chemical Weapons Through Sanctions, Use Of Force, And Criminalization, Michael P. Scharf
Faculty Publications
Currently there are two means of enforcing the international prohibition of chemical and biological weapons. First, the international community can induce compliance through imposition of sanctions, such as trade embargoes, freezing of assets and diplomatic isolation. Second, when sanctions fail, States can individually or collectively respond to the threat of chemical or biological weapons by using military force. After exploring the potential strengths and weaknesses of these approaches, this article examines the desirability of supplementing them with a third approach based on the criminal prosecution of persons responsible for the production, stockpiling, transfer, or use of chemical and biological weapons.

Mother Still Knows Best: Cancer-Related Gene Mutations, Familial Privacy, And A Physician's Duty To Warn, Alissa
Fordham Urban Law Journal
The vows of the Hippocratic Oath which include a vow to abstain from sharing a patient's personal information remains an important tenet of medical care today. Physician-patient confidentiality even abstains sharing information with patients' families. However, when medical information affects the health of the patient's relatives, many medical professionals assert that they have a duty to share the information, with or without the patient's consent, particularly in the context of children of patients with genetic diseases and disorders, where forewarning may significantly decrease the risks or increase prevention of the effects of the disease or disorder. Currently, while physicians respect …

This nuclear unit is thought to be in "crisis" because of the tendency of many marriages to dissemble and dissolve. Some people claim that society is also in a state of crisis as a result of marital instability. Many are concerned by the assembling of "deviant" and competing intimate entities claiming entitlement to the benefits and privileges previously extended to marriage." The family has become the symbolic terrain for the cultural war in which our society is increasingly mired. If one believes the family is not inherently limited to any essential or natural form, but is as contrived as any …

Products Liability In The New Millennium: Products Liability And The Y2k Crisis, Philip J. Landau
Richmond Journal of Law & Technology
Imagine the following scenario. It's December 31, 1999 and two minutes until midnight. The champagne has just been poured and everyone is joyfully preparing to welcome in the new millennium. The clock ticks and the countdown begins. While millions of New Yorkers push and shove, millions more gather around television sets to catch a glimpse of the famous "ball" as it begins its descent in Times Square. Five . . . Four . . . Three . . . Two . . . One . . . "Happy New Year!!!" Little does the crowd know, that as they disperse and …

Regulation Of Dietary Supplements: Five Years Of Dshea, Laura A.W. Khatcheressian
Law Faculty Publications
On October 25, 1994, President Clinton signed into law the Dietary Supplement Health and Education Act (DSHEA),2 passed unanimously by both houses of Congress. This law radically changed the regulatory landscape for the sale and labeling of dietary supplements, restricting the Food and Drug Administration's (FDA's) authority in certain ways, and encouraging the sale of dietary supplements, including vitamins, minerals, herbs, botanicals, and amino acids.
This article examines DSHEA and discusses current FDA attempts to regulate dietary supplements. Part II provides a brief background and discusses FDA's concerns and attitude toward dietary supplements before the passage of DSHEA. Part III …
The Police-Ization Of The Military, Charles J. Dunlap Jr.
The Police-Ization Of The Military, Charles J. Dunlap Jr.
Faculty Scholarship
This essay will briefly review the background of the use of the armed forces in a police capacity, discuss the growth of that role in the I980s and 1990s, and forecast an even greater expansion into that role in the near future due to the emerging threat of "catastrophic terrorism." It will contend that this increased reliance on military resources for policing is not in the interest of either the armed forces or the public. Finally, it will make some observations with a view towards minimizing the dangers of police-ization of the military while ensuring the Nation's public safety.
