War Decisions In The Late 1990s By Partial Congressional Declaration, Charles Tiefer Jan 1999

War Decisions In The Late 1990s By Partial Congressional Declaration, Charles Tiefer

San Diego Law Review

The great surprise in actual war powers decision making of the late 1990s has been the emergence of a practically decisive, yet

constitutionally unexplored paradigm: "partial" congressional declara- tion of war.' Presently, the Senate and the House seem to have the

function of deciding on warlike action through unmatched, "partial" declarations; just how constitutional can this be?

The Future Of Bioethics Testimony: Guidelines For Determining Qualifications, Reliability, And Helpfulness, Bethany Spielman, George Agich

San Diego Law Review

This Article addresses key questions about expert bioethics testimony4 from within the framework of the basic rule concerning expert witnesses, Federal Rule of Evidence 702.' This Rule6 requires judges to affirmatively answer three basic questions before admitting expert testimony: (1) does this witness qualify as an expert by knowledge, skill, experience, training, or education; (2) does the testimony consist of scientific, technical or other specialized knowledge; and (3) will the testimony assist the trier of fact. Bioethics testimony presents distinctive problems in each area, on which commentators have not necessarily focused. Part II of this Article addresses the question of …

The Freedom To Marry For Same-Sex Couples: The Opening Appellate Brief Of Plaintiffs Stan Baker Et Al. In Baker Et Al. V. State Of Vermont, Mary Bonauto, Susan M. Murray, Beth Robinson

Michigan Journal of Gender & Law

As the first state to prohibit slavery by constitution, and one of the few states which, from its inception, extended the vote to male citizens who did not own land, the State of Vermont has long been at the forefront of this nation's march toward full equality for all of its citizens. In July 1997, three same-sex couples challenged Vermont to act as a leader yet again, this time in affording full civil rights to the State's gay and lesbian citizens. Stan Baker and Peter Harrigan, Nina Beck and Stacy Jolles, and Holly Puterbaugh and Lois Farnham were denied marriage …

Foundations For 15(1): Equality Rights In Canada, Martha A. Mccarthy, Joanna L. Radbord Jan 1999

Foundations For 15(1): Equality Rights In Canada, Martha A. Mccarthy, Joanna L. Radbord

Michigan Journal of Gender & Law

The paper discusses a selection of important cases under section 15 of the Canadian Charter of Rights and Freedoms. It traces the development of equality jurisprudence from the introduction of section 15 to early approaches in Andrews, Hess, Weatherall, Symes, and McKinney. This review illustrates the persistence of formal equality analysis and the threats of biology, morality, and tradition to the realization of substantive equality. The May 25, 1995, trilogy of Egan, Miron, and Thibaudeau is critiqued in detail. Finally, we turn to more recent jurisprudence and offer a brief discussion of M. v. H.

Communities Take Control Of Crime: Incorporating The Conference Model Into The United States Juvenile Justice System, Amanda L. Paye Jan 1999

Communities Take Control Of Crime: Incorporating The Conference Model Into The United States Juvenile Justice System, Amanda L. Paye

Washington International Law Journal

Juvenile crime is one of the preeminent concerns of many Western societies today, yet the current retributive styles of justice that purport to "get tough" on youth crime have not been effective. In defiance of the "get tough" rhetoric, and despite the lack of meaningful legislative recognition, communities are adjudicating juvenile cases through alternative programs based on the Restorative Justice theory. Because of the promising effects of Restorative Justice on youth crime, New Zealand and Australia have taken the bold step of restructuring their juvenile justice systems via landmark legislation that incorporates an innovative "conferencing" model. The model is a …

Commentary On A Victory For "Comfort Women": Japan's Judicual Recognition Of Military Sexual Slavery, Etsuro Tutsuka

Washington International Law Journal

Despite international condemnation, Japan has done little to recognize its responsibility for forcing over 200,000 "Comfort Women" into sexual slavery for the Japanese Imperial Army during the Second World War. However, in a landmark April 1998 decision, a Japanese court ordered Japan to compensate three Korean "Comfort Women." This was the first time that a Japanese court found in favor of foreign plaintiffs in a postwar compensation case. The court held members of the Diet negligent under the State Liability Act for failing to enact a compensation law for the "Comfort Women." Although the judgment will almost certainly be overturned, …

The International Legal Implications Of "Non-Lethal" Weapons, David P. Fidler Jan 1999

The International Legal Implications Of "Non-Lethal" Weapons, David P. Fidler

Michigan Journal of International Law

In this Article, the author attempts a comprehensive international legal analysis of "non-lethal" weapons to raise awareness about how many international legal issues they create and about the complexity of analyzing the international legality of the development and use of these weapons. In short, the emergence of "non-lethal" weapons does not rescue international law from its crisis in connection with controlling war. Indeed, in some respects, the coming of "non-lethal" weapons threatens to deepen that crisis in new and disturbing ways.
