Internet Prescribing Limitations And Alternatives, Kara M. Friedman Jan 2001

Internet Prescribing Limitations And Alternatives, Kara M. Friedman

Annals of Health Law and Life Sciences

Ms. Friedman discusses the legal limitations placed on the consumer's ability to obtain drug prescriptions via the Internet. The article focuses on current legislative policies and regulations used to restrict access to prescription drugs over the Internet in the absence of a well-founded physician/patient relationship. The article argues that regulators might be able to satisfy the policy objective of ensuring that a learned intermediary is involved in prescription drug therapy by expanding the prescriptive authority of licensed pharmacists.

Whose Genetic Information Is It Anyway? A Legal Analysis Of The Effects That Mapping The Human Genome Will Have On Privacy Rights And Genetic Discrimination, 19 J. Marshall J. Computer & Info. L. 609 (2001), Deborah L. Mclochlin Jan 2001

Whose Genetic Information Is It Anyway? A Legal Analysis Of The Effects That Mapping The Human Genome Will Have On Privacy Rights And Genetic Discrimination, 19 J. Marshall J. Computer & Info. L. 609 (2001), Deborah L. Mclochlin

UIC John Marshall Journal of Information Technology & Privacy Law

"There is no information more personal and private than one's genetic information" – one's DNA. Under the Human Genome Project, mapping of the human genetic code is under way. From this mapping of genetic code, information such as the likelihood of developing cancer, diabetes, etc. would certainly become available. Although this information may be helpful to one's health providers, companies and governments may begin to use this information to discriminate individuals based on their genetic predispositions. This article focuses on the current federal legislation while proposing a new federal legislation in light of this great genetic endeavor. Legislation "has always …

Reconsidering The Abuse That Dare Not Speak Its Name: A Criticism Of Recent Legal Scholarship Regarding Same-Gender Domestic Violence, Ryiah Lilith Jan 2001

Reconsidering The Abuse That Dare Not Speak Its Name: A Criticism Of Recent Legal Scholarship Regarding Same-Gender Domestic Violence, Ryiah Lilith

Michigan Journal of Gender & Law

This article argues that while recent legal scholarship effectively disputes the applicability of a gendered model of domestic violence to same-gender abuse, it goes too far in embracing a completely gender-neutral model. Part I explains the theoretical problems with the non-gendered model of domestic violence by examining in detail the research which is most often cited in legal writings in support of this model. Part II briefly explores the pragmatic implications for lesbian and gay male victims of domestic violence when law enforcement policies such as mandatory arrest are based on a model of domestic violence which ignores contexts such …

The Everglades Ecosystem: From Engineering To Litigation To Consensus-Based Restoration, John J. Fumero, Keith W. Rizzardi

St. Thomas Law Review

"The Everglades were dying. The endless acres of saw grass, brown as an enormous shadow where rain and lake water had once flowed, rustled dry." As late as the 1800's, the Everglades consisted of a 60-mile wide shallow river, seldom more than 2 feet deep, flowing from Lake Okeechobee to Florida Bay. That was before the U.S. Army Corps of Engineers erected 1,400 miles of dikes, dams, levees and water control structures in the name of water supply and flood control Now in the year 2000, more than fifty years after Marjory Stoneman Douglas wrote about the demise of the …

Good Science Or Myopia: Will The 1991 Everglades Settlement Lead To An Optimal Restoration Or Will Phosporus Reductions Be Taken Too Far, William H. Green, Gary V. Perko Jan 2001

Good Science Or Myopia: Will The 1991 Everglades Settlement Lead To An Optimal Restoration Or Will Phosporus Reductions Be Taken Too Far, William H. Green, Gary V. Perko

St. Thomas Law Review

Everglades water quality restoration: What does it mean? How will it be achieved? How much will it cost? Will it promote re-establishment of historical wildlife populations? Despite years of scientific research, these questions remain answered for the control of phosphorus inputs under Florida's landmark Everglades Forever Act. A one-dimensional approach continues to drive Everglades restoration efforts along a narrow path of extreme phosphorus reductions despite mounting scientific evidence that this could harm wildlife and be unduly costly to society However, moderation of that goal may enhance Everglades wildlife habitat by restoring lost ecosystem functionality, and preserving areas where wildlife mercury …

Genetic Breakthroughs And The Limits Of Medicine: Short Stature, Growth Hormone, And The Idea Of Dysfunction, Peter H. Schwartz Jan 2001

Genetic Breakthroughs And The Limits Of Medicine: Short Stature, Growth Hormone, And The Idea Of Dysfunction, Peter H. Schwartz

St. Thomas Law Review

This article reviews arguments that have been presented for the use of growth hormone in some children without growth hormone deficiency. Some of these arguments, this article will claim, utilize confused ideas of dysfunction, and this has led to weak arguments that rely on poor data. Clarifying the concept of dysfunction produces clearer arguments that do not depend on such questionable empirical claims. This analysis aims to serve as a case study of how the careful definition and application of ideas can aid in evaluating the proper purview of medicine. The discussion of future genetic breakthroughs and the powers they …

The Nexus Between Intellectual Property Piracy, International Law, The Internet, And Cultural Values, David J. Stephenson Jr. Jan 2001

The Nexus Between Intellectual Property Piracy, International Law, The Internet, And Cultural Values, David J. Stephenson Jr.

St. Thomas Law Review

In a way similar to the dramatic transformation of mass into energy at the speed of light, intellectual property piracy disputes have compellingly special characteristics when multicultural values clash over the Internet. The sudden explosion of Internet use outside of Western Europe and North America, especially in Asia, is most apparent in Singapore, which has the highest per capita use of the Internet anywhere in the world. This rapid global expansion of Internet use has been accompanied by related claims of intellectual property piracy that frequently resemble disputes that have recently arisen in United States and European courts. For example, …

The Ayllu: The Basic Social Unit Of The Aymara People, Tomas Alarcon Jan 2001

The Ayllu: The Basic Social Unit Of The Aymara People, Tomas Alarcon

St. Thomas Law Review

The Aymara People have inhabited this Earth since time immemorial. Their civilization dates back to 1200 B.C., and their culture was based in the ancient city of Tiwanaku, between 400 and 1000 AD. Since its organization, the dwellers of this great city have endured and resisted conquest by the Inca empire, the Spanish, and the modem states surrounding Lake Titicaca. The Aymara now live in the Andes within the borders of Peru, Bolivia, Chile and Argentina.Their territory is an altiplano or plateau, Poopo, in the region surrounding Lake Titicaca at 4,000 meters above sea level. The Aymara ancestors selected this …
