Criminal defendants face an uphill battle when attempting to prove that the government’s loss or destruction of evidence that could have played a significant role in their defense deprived them of their constitutional due process rights. To make this showing, the defendant must prove that the government lost or destroyed the evidence in bad faith. This requirement is problematic because direct evidence illustrating the subjective intent of the government officials who lost or destroyed the evidence is unlikely to exist, and in the off chance it does, the prosecution is unlikely to freely hand it over to the defendant. Scrutinizing The Bathroom Binary: Equal Protection Theories For Nonbinary Students, Annie Schuver

Over the past decade, transgender students have challenged discriminatory school bathroom policies under the Equal Protection Clause with varying success. But another group of students, facing similar discrimination, has yet to see its day in court. Like their transgender peers, nonbinary students often lack access to gender-appropriate restrooms at school. Many K–12 schools offer only “boys” and “girls” restrooms, ignoring the needs of students who identify as neither boys nor girls, as both of those genders, or as something else entirely. Forced to use sex-segregated bathrooms (or no bathroom at all), nonbinary students suffer adverse health, safety, and educational outcomes. …

Collaborative governance (CG) has emerged as a tool for addressing increasingly complex societal problems by engaging a diverse of set of cross-sector actors in a deliberative process with the aim of realizing consensus-driven outcomes. Emerson et al.’s (2011) Integrated Framework for Collaborative Governance (IFCG) attempts to improve understanding of these arrangements by articulating causal connections between collaborative drivers and dynamics across different contexts. At the 2000 General Assembly, the World Intellectual Property Organization (WIPO) established the Intergovernmental Committee on Intellectual Property and Genetic Resources, Traditional Knowledge and Folklore (IGC) to address intellectual property issues relating to genetic resources, traditional knowledge (TK) and traditional cultural expressions (TCEs). Although the IGC initially focused its work on studying these issues, it obtained a new mandate to accelerate its work in October 2009 and began text-based negotiations on an international instrument, or international instruments, a few months later. When Kentucky and Arkansas instituted work requirements in 2018 as a condition to receiving Medicaid benefits, residents from both states sued the Trump Administration to block the program, arguing that the requirements were contrary to the Medicaid statute. In Gresham v. Azar, the DC Circuit agreed, holding that "the objective of Medicaid was to furnish medical assistance." Even though the Secretary of Health and Human Services determined that the work requirements were "likely to assist in improving health outcomes," the court concluded that "better health outcomes as [an] objective of Medicaid… lacks textual support. Per- and polyfluoroalkyl substances (“PFAS”) are devastating our food systems and our health. Recent studies link even small exposure to PFAS to a host of adverse health outcomes, including cancer, autoimmune diseases, thyroid disease, liver damage, childhood obesity, infertility, and birth defects.

Food consumption is a primary route of PFAS exposure. PFAS are omnipresent at dangerous levels in our marine and agricultural environments, including in water, soil, fertilizers, compost, and air. From there, they can find their way into virtually every plant, fish, animal, and animal product, and ultimately (in the greatest concentration) into the consumer. In addition, PFAS-laden food …

International human rights jurisprudence has increasingly mandated state action which integrates a gender perspective, taking into consideration the discriminatory norms, harmful social practices, stereotypes, and violence that women have and still suffer. Law enforcement officers commonly must respond to situations in which a person is experiencing acute symptoms of a mental illness. Yet from the first moment of police involvement, these community members face the possibility of negative outcomes. Consequences include officers' use of excessive force leading to injury or death, criminal arrest and prosecution that results in deprivation of liberty, separation from the community, and the creation of a permanent criminal record that affects other rights.

Ownership over the deep seabed and its mineral riches was unsettled until well into the twentieth century. Yet, by the 1960s, a remarkable spirit of universalism prevailed. States declared the deep seabed to be the common heritage of [hu]mankind, determining that its exploitation and protection would require collective management. The seabed beyond national jurisdiction (or, the “Area”) spans roughly half of the surface of the Earth. It contains critical minerals, such as cobalt and copper, which technological advances have rendered increasingly within reach. Florida's newest legislation leaves many Florida queer teachers feeling marginalized and unprotected in the classroom (Block, 2022). The “Parental Rights in Education” Bill (FL HB 1557 and FL HB 1069), infamously renamed “Don’t Say Gay”, was created ostensibly to help protect parental rights and choices in education. The new law prohibits the discussion of gender identity and sexual orientation in kindergarten through twelfth grade classrooms. “Don’t Say Gay” provides vague guidelines for queer teachers on approaching topics like sexual orientation and gender identity. เอกัตศึกษาฉบับนี้ มีวัตถุประสงค์เพื่อมีมาตรการ หรือแนวคิดริเริ่มเพื่อส่งเสริมธุรกิจอาหารทางเลือกจากพืชในประเทศไทยให้เติบโตมากขึ้น เพื่อสร้างประโยชน์ในระยะยาวให้กับเศรษฐกิจและสังคมไทยอย่างยั่งยืน ประโยชน์ของธุรกิจดังกล่าวส่งผลกระทบในด้านต่าง ๆ ดังนี้ (1) ประโยชน์ด้านสุขภาพ สามารถช่วยให้มีสุขภาพดีขึ้น รวมถึงลดความเสี่ยงต่อโรคต่าง ๆ (2) ประโยชน์ด้านสิ่งแวดล้อม การรับประทานอาหารทางเลือกจากพืชใช้ทรัพยากรต่าง ๆ เช่น ที่ดิน แหล่งน้ำ และพลังงาน น้อยกว่าอาหารที่มีส่วนผสมจากเนื้อสัตว์ จึงถือเป็นการประหยัดพลังงานและช่วยรักษาสิ่งแวดล้อมได้เป็นอย่างดี (3) ประโยชน์ด้านความมั่นคงทางอาหาร สามารถช่วยลดความเสี่ยงจากการขาดแคลนอาหาร เนื่องจากกระบวนการผลิตอาหารทางเลือกจากพืชใช้ทรัพยากรด้านต่าง ๆ น้อยกว่าผลิตภัณฑ์จากสัตว์ และ (4) ประโยชน์ด้านสวัสดิภาพสัตว์ การรับประทานอาหารทางเลือกจากพืชถือเป็นการคุ้มครองสัตว์ เพราะเป็นการลดการผลิตผลิตภัณฑ์จากเนื้อสัตว์ในฟาร์มเอกัตศึกษาฉบับนี้ มีการดำเนินการวิจัยด้วยวิธีการศึกษาเชิงเอกสาร (Documentary Research) โดยการศึกษาค้นคว้า รวบรวม วิเคราะห์ข้อมูล จากหนังสือ บทความ ตำรา วิทยานิพนธ์ เอกัตศึกษา เอกสารสิ่งพิมพ์ หลักภาษีอากร โดยมีการใช้ฐานข้อมูลออนไลน์ ที่มีบุคคลอื่นได้บันทึกหรือตีพิมพ์เผยแพร่ไว้เกี่ยวกับมาตรการเพื่อส่งเสริมธุรกิจอาหารทางเลือกจากพืช ทั้งในประเทศไทยและต่างประเทศ จากนั้นนำข้อมูลที่รวบรวมได้มาทำการศึกษา เรียบเรียง และวิเคราะห์อย่างเป็นระบบ เพื่อเสนอแนวทางการสร้างแรงจูงใจให้กับผู้ประกอบธุรกิจอาหารทางเลือกจากพืชจากการศึกษา พบว่า ในปัจจุบัน ไทยยังขาดมาตรการส่งเสริมธุรกิจอาหารทางเลือกจากพืชที่ชัดเจนและครอบคลุม เมื่อเทียบกับหลายประเทศที่ให้ความสำคัญกับเรื่องนี้ เช่น สหรัฐอเมริกา สหภาพยุโรป และสิงคโปร์ ทั้งนี้ เพื่อส่งเสริมธุรกิจอาหารทางเลือกจากพืชในไทยให้เติบโตอย่างยั่งยืน ควรมีการดำเนินการดังนี้ (1) จัดทำแผนยุทธศาสตร์ระดับชาติ และกฎหมายเฉพาะเพื่อส่งเสริมอาหารทางเลือกจากพืช: กำหนดเป้าหมายและแนวทางการดำเนินงานที่ชัดเจน (2) บูรณาการนโยบาย เชื่อมโยงนโยบายด้านอาหารกับนโยบายอื่น ๆ เช่น สุขภาพ สิ่งแวดล้อม และเศรษฐกิจ รวมถึงการสนับสนุนการวิจัยและพัฒนา เพื่อส่งเสริมการพัฒนานวัตกรรม ซึ่งจะเป็นองค์ประกอบสำคัญในการพัฒนาผลิตภัณฑ์ใหม่ ๆ และเทคโนโลยีที่เกี่ยวข้อง (3) ส่งเสริมด้านสิทธิประโยชน์ทางภาษีเพื่อส่งเสริมธุรกิจอาหารทางเลือกจากพืช ทั้งในส่วนที่ส่งผลกับอาหารทางเลือกจากพืชโดยตรง เช่น การพิจารณาปรับลดอัตราภาษีมูลค่าเพิ่มสำหรับอาหารทางเลือกจากพืช และส่วนที่เกี่ยวข้องกับการให้สิทธิประโยชน์ทางภาษีทางอ้อม เช่น การหักค่าใช้จ่ายที่ใช้สำหรับการวิจัย (4) สร้างความตระหนักรู้ และประชาสัมพันธ์ข้อมูลเกี่ยวกับประโยชน์ของอาหารจากพืช ทั้งต่อผู้บริโภคเอง และต่อสังคมในภาพรวม (5) สนับสนุนเกษตรกร และส่งเสริมการปลูกพืชที่ใช้เป็นวัตถุดิบในการผลิตอาหารจากพืชการดำเนินการเหล่านี้จะช่วยให้ไทยมีอุตสาหกรรมอาหารทางเลือกจากพืชที่แข็งแกร่ง สามารถแข่งขันในตลาดโลก และตอบสนองความต้องการของผู้บริโภคที่ใส่ใจสุขภาพและสิ่งแวดล้อมมากขึ้น นอกจากนี้ …

The number of females under correctional supervision has been increasing in the last four decades. For adult women, these offenses are generally drug offenses; however, there have also been increases in the number of women committing violent crimes. Unfortunately, violent females are an understudied population, which limits the data available to inform programs and policies that could address the problem. This study explored potential factors related to violent behavior among adult females by analyzing public-use data from the Bureau of Justice Statistics’ Survey of Prison Inmates, 2016. Federal court records have been available online for nearly a quarter century, yet they remain frustratingly inaccessible to the public. This is due to two primary barriers: (1) the federal government’s prohibitively high fees to access the records at scale and (2) the unwieldy state of the records themselves, which are mostly text documents scattered across numerous systems. Official datasets produced by the judiciary, as well as third-party data collection efforts, are incomplete, inaccurate, and similarly inaccessible to the public. The Article further provides updates on EU-ETS, CORISA, RED III and the minimum quota of SAF supply in accordance with Refuel EU Aviation up to October 2023. This Article compares human reproductive cloning (HRC) and heritable genome editing (HGE) to identify factors that encourage bans on novel reproductive technologies. HRC drew legislative opposition in part because it involved asexual reproduction and was incorrectly associated with copying. HGE and other technologies that involve sexual reproduction do not have those problematic qualities. HRC also became entangled with research in which human embryos were cloned to be harvested for their stem cells. HGE did not because scientists learned how to create and edit pluripotent stem cells without creating embryos. However, the legal history of HRC predicts that reproductive technologies strongly …

For years, social media companies have sparred with lawmakers over how much independent access to platform data they should provide researchers. Sharing data with researchers allows the public to better understand the risks and harms associated with social media, including areas such as misinformation, child safety, and political polarization.
