Although the very concept of law school rankings is currently under fire, rankings abolitionism is misplaced. Given the number, diversity, and geographic dispersion of the more than 190 law schools fully ac­credited by the American Bar Association, rankings are essential to en­able various stakeholders to make comparisons between schools. How­ever, the current rankings landscape is dire. The U.S News law school rankings rely on poorly designed, highly subjective surveys to gauge "reputational strength," rather than looking to easily available, objec­tive citation data that is more valid and reliable. Neither the individualistic regulatory health paradigm nor the vulnerable populations approach of public health can provide the legal structure necessary to address the most pressing problems in health care today. These approaches fail to address conflicts between individuals and populations as well as challenges to qualifying for care and are in inherent conflict with each other, sometimes within the same statute. As health concerns become more global, it is necessary to move past a vulnerable populations approach to a broader population approach that respects individual choice but does not sacrifice community health for liberty interests.

Is climate change a national security issue? Human security? Ecological security? This Article addresses the growing nexus between climate change and various conceptions of security with a particular emphasis on climate change's national security impacts. This Article argues that there is a growing connection between national security and climate change and a corresponding need to address the normative implications of "climatizing national security." This connection can be observed through three lenses: mitigation (reducing greenhouse gas emissions from military and national security sources); adaptation (investing in climate resilient infrastructure in an effort to prepare for climate impacts), and response (addressing climate-exacerbated …

The Past As A Colonialist Resource, Deepa Das Acevedo

Originalism’s critics have failed to block its rise. For many jurists and legal scholars, the question is no longer whether to espouse originalism but how to espouse it. This Article argues that critics have ceded too much ground by focusing on discrediting originalism as either bad history or shoddy linguistics. To disrupt the cycle of endless “methodological” refinements and effectively address originalism’s continued popularity, critics must do two things: identify a better disciplinary analogue for originalist interpretation and advance an argument that moves beyond methods.

งานวิจัยฉบับนี้มีจุดมุ่งหมายเพื่อศึกษากฎหมายและนโยบายที่เกี่ยวข้องกับการส่งเสริมการบริจาคอาหารส่วนเกินในภาคธุรกิจอาหาร ซึ่งเป็นกลไกสำคัญในการลดขยะอาหาร เสริมสร้างความมั่นคงทางอาหาร และสนับสนุนเป้าหมายการพัฒนาที่ยั่งยืน (SDG 2 และ SDG 12) โดยใช้การวิจัยเอกสารเปรียบเทียบกฎหมายไทยกับกฎหมายของสหรัฐอเมริกา สหภาพยุโรป (โดยเฉพาะฝรั่งเศส) และแคนาดา ร่วมกับการประมวลทฤษฎีเศรษฐศาสตร์สิ่งแวดล้อมและเศรษฐกิจหมุนเวียน เพื่อศึกษาทางกฎหมายด้านความรับผิดของผู้บริจาค แรงจูงใจทางภาษี มาตรฐานความปลอดภัย ตลอดจนความเป็นไปได้ในการนำเครื่องมือคาร์บอนเครดิตมาใช้ในบริบทไทย ผลการวิจัยพบว่า ประเทศไทยยังขาดกฎหมายเฉพาะในการคุ้มครองผู้บริจาค ขาดสิทธิประโยชน์ทางภาษี และยังไม่มีแนวทางกลางด้านความปลอดภัยของอาหารบริจาค ซึ่งเป็นอุปสรรคต่อการส่งเสริมการบริจาคจากภาคธุรกิจ ผู้วิจัยเสนอให้ตราพระราชบัญญัติส่งเสริมการบริจาคอาหารและลดการสูญเสียอาหาร กำหนดนิยาม หลักเกณฑ์ และความคุ้มครอง จัดตั้งกองทุนเยียวยาและสนับสนุนระบบประกันภัย เพิ่มสิทธิประโยชน์ทางภาษี พัฒนา ระบบ e-Donation ควบคู่การตรวจสอบย้อนกลับ ออกแนวทางกลางด้านความปลอดภัย และนำการบริจาคอาหารเข้าสู่โครงการ T-VER มาตรการเหล่านี้จะสร้างกรอบกฎหมายที่ส่งเสริมการบริจาคอย่างรอบด้าน สอดคล้องกับหลักนิติธรรม ประโยชน์สาธารณะ และความยั่งยืนของประเทศ

การวิจัยครั้งนี้มีวัตถุประสงค์เพื่อศึกษา วิเคราะห์ และเปรียบเทียบปัญหาความรับผิดทางอาญากรณีปฏิเสธการให้ข้อมูลส่วนบุคคลอ่อนไหวของประเทศไทยกับกฎหมายต่างประเทศ เนื่องจาก การดำเนินคดีอาญาส่วนใหญ่กระทบสิทธิในข้อมูลส่วนบุคคล ยิ่งไปกว่านั้น ในประเทศไทย มีเพียงโทษทางอาญาที่นำมาใช้กับผู้ต้องหาที่ปฏิเสธการให้ข้อมูลส่วนบุคคลอ่อนไหว ดังนั้น เพื่อไม่ให้กระทบต่อศักดิ์ศรีความเป็นมนุษย์ และสิทธิของผู้ต้องหาในฐานะเจ้าของข้อมูลส่วนบุคคลจนเกินสมควรแก่เหตุ จึงเห็นสมควรให้บัญญัติมาตรการบังคับทางปกครอง นอกเหนือจากการลงโทษทางอาญาเพิ่มเติมไว้ในประมวลกฎหมายวิธีพิจารณาความอาญาด้วย

การทำสัญญาประกันวินาศภัยเป็นเครื่องมือทางเศรษฐกิจอย่างหนึ่งที่มนุษย์ใช้เป็นวิธีปกป้องตนเองจากผลกระทบทางการเงินที่อาจเกิดขึ้นจากความเสี่ยงภัยต่างๆ ซึ่งอาจเกิดจากเหตุการณ์ธรรมดาอย่างอุบัติเหตุ ไปจนถึงเหตุการณ์รุนแรงอย่างเช่นโรคระบาด โดยการโอนความเสี่ยงภัยนั้นเข้าสู่การรวมกลุ่มของความเสี่ยงภัยที่จะถูกบริหารจัดการโดยผู้ประกอบธุรกิจประกันภัย ด้วยกรมธรรม์อันเป็นหลักฐานแห่งสัญญาประกันวินาศภัยมีลักษณะเป็นสัญญาสำเร็จรูปที่ฝ่ายผู้รับประกันภัยโดยอาศัยความเชี่ยวชาญทางธุรกิจจัดทำขึ้นไว้แล้ว ซึ่งมิได้เปิดโอกาสอย่างแท้จริงให้ผู้เอาประกันภัยซึ่งเข้าทำสัญญาในฐานะผู้บริโภคสามารถต่อรองเงื่อนไขของสัญญาได้ จึงมักมีปัญหาว่ามีข้อสัญญาที่ผู้รับประกันภัยเป็นฝ่ายได้เปรียบกว่าอยู่มาก หรือมีข้อมูลที่ผู้บริโภคไม่ได้รับอย่างถูกต้องในเวลาที่เข้าทำสัญญา วิทยานิพนธ์นี้มุ่งศึกษาการคุ้มครองผู้บริโภคเกี่ยวกับสิทธิเลิกสัญญาประกันวินาศภัยในประเด็นศึกษาสองประการ ได้แก่ มีความเหมาะสมที่จะกำหนดข้อสัญญาซึ่งให้สิทธิผู้รับประกันภัยเลิกสัญญาได้ฝ่ายเดียวโดยไม่ได้ระบุเหตุแห่งการมีสิทธิเลิกสัญญาไว้ในสัญญาหรือไม่ และเพื่อคุ้มครองผู้บริโภคที่อาจเสียเปรียบในการเข้าผูกพันตามสัญญาสำเร็จรูปให้ได้ตรวจสอบข้อมูลอย่างถูกต้องและทำความเข้าใจตัวสัญญา มีความเหมาะสมในการกำหนดระยะไตร่ตรองในสัญญาประกันวินาศภัยเพื่อเป็นสิทธิเลิกสัญญาของผู้บริโภคในสัญญาประกันวินาศภัยหรือไม่ โดยทำการศึกษาผ่านลักษณะของสัญญาประกันวินาศภัย แนวคิดทางกฎหมายที่เกี่ยวข้องกับสัญญาและการคุ้มครองผู้บริโภค มาตรการทางกฎหมายที่เกี่ยวข้องกับการคุ้มครองผู้บริโภคในสัญญาประกันวินาศภัยในต่างประเทศและประเทศไทย จากการศึกษาได้ผลการวิเคราะห์ว่า 1) ข้อสัญญาซึ่งให้สิทธิผู้รับประกันภัยเลิกสัญญาได้ฝ่ายเดียวโดยไม่ได้ระบุเหตุแห่งการใช้สิทธิเลิกสัญญาไว้ไม่เหมาะสมที่จะถูกกำหนดให้อยู่ในสัญญาประกันวินาศภัย 2) ควรกำหนดให้สิทธิเลิกสัญญาภายในระยะเวลาไตร่ตรองแก่ผู้บริโภคไว้ในสัญญาประกันวินาศภัย โดยไม่จำกัดเฉพาะว่าจะต้องเป็นสัญญาที่เกิดขึ้นจากการเสนอขายที่คู่สัญญาอยู่ห่างกันโดยระยะทาง แต่ก็มีข้อจำกัดการให้สิทธิแก่สัญญาประกันวินาศภัยบางลักษณะ ทั้งนี้ วิทยานิพนธ์นี้ได้ทำการศึกษาวิเคราะห์มาตรการทางกฎหมายของประเทศไทยที่เกี่ยวข้องกับประเด็นศึกษาทั้งสองประการ จากการศึกษาพบว่ามาตรการดังกล่าวมีปัญหาที่ทำให้ผู้บริโภคยังไม่ได้รับความคุ้มครองอย่างเหมาะสม ผู้เขียนจึงมีข้อเสนอแนะแนวทางในการแก้ไขปรับปรุงมาตรการทางกฎหมายของประเทศไทยที่เกี่ยวข้องกับประเด็นศึกษาเพื่อให้ผู้บริโภคได้รับความคุ้มครองอย่างเหมาะสมยิ่งขึ้น

The deposition offers a singular opportunity to handcuff the deponent to an irreversible script. Consequently, both the attorney taking the deposition and defending counsel must prepare for and conduct the deposition with equal if not greater care than the trial.

Traditionally, lawyers have used the deposition to discover facts relating to the legal elements and the credibility, perception, and recollection of the witness. Nearly four million Americans undergo gynecological surgeries each year, but these procedures are unnecessarily risky, as many suffer avoidable lifelong, painful, and disabling injuries. This Article diagnoses the root cause in our legal framework for healthcare finance. It then identifies solutions.

America’s public–private system for reimbursing healthcare pays for procedures rather than outcomes, and it pays substantially more for work on male rather than female anatomies. In recent years, a number of jurisdictions have enacted laws recognizing that a child may have more than two legal parents (multi-parentage). Recognition of multi-parentage represents a significant change to the legal framework governing parentage— for most of U.S. history, it was well established that a child could have a maximum of two legal parents. Individuals regularly take steps to protect themselves, their property, and their broader legal interests. They carry pepper spray, have guard dogs, and install fences. Such measures are colloquially deemed methods of self-help. Yet, despite its ubiquity, self-help as a legal concept has been chronically understudied. Consequently, American private law is missing a doctrinally coherent and prescriptively useful framework for self-help. As a matter of legal theory, this conceptual void is problematic in and of itself; the doctrinal incoherence stemming from this analytical gap decreases the law’s stability and undermines its predictability.

The Supreme Court's rejection of a constitutional right to choose abortion in Dobbs v. Jackson Women's Health Organization has prompted legislatures to make significant changes to state laws. Some states have criminalized abortion in most circumstances, while others have granted patients and health care providers broader rights to choose and access abortion. Another, perhaps less-recognized, avenue for legislative change is by amending existing state conscience laws. This Article describes the avenues state legislatures might take in using conscience laws to impact abortion access in accordance with the state's policy preferences.

‘News Reporting On Possible Origins Of The Covid-19 Pandemic: A Critical Review And Case Study’, Raya M. Fanuzzi

This project is a critical analysis of news reports that discuss the potential origins of the 'COVID-19' pandemic for the purposes of identifying themes and trends in the actual reporting. Around 500 news reports published in the U.S. were analyzed and over 100 of them were selected for the critical review. Articles were found using 'Access News Archive' and Google search engine. Original methods for analyzing and reviewing articles were developed and used. A case study is included aside from the review which focuses specifically on trends in fact-check reporting during the pandemic.
