Judicial Examination Of The Accused-A Remedy For The Third Degree, Paul G. Kauper Jun 1932

Judicial Examination Of The Accused-A Remedy For The Third Degree, Paul G. Kauper

Michigan Law Review

In its report on "Lawlessness in Law Enforcement" the Wickersham Commission concludes that in the police systems of a number of American municipalities the "third degree" is very generally practiced as a means of extorting from accused persons under arrest confessions, incriminating statements, and other information of value to the police. The conclusion of the Commission confirms the results of private investigation made in the same field. It is true that the. methods of inquiry pursued by the Commission leave doubt as to the accuracy of some of the facts reported. But the quality of the evidence submitted as the …

Criminal Law - Federal Removal Proceedings - Conclusiveness Of The Indictment

Michigan Law Review

The government, when asking removal, presents to the court or commissioner a copy of the indictment found in the district to which removal is asked, and frequently rests on this, after giving evidence that the defendant is the party named in the indictment. The defendant, on the other hand, usually presents a mass of evidence, relevant and irrelevant, in an endeavor to …

The Cost Of Criminal Justice In West Virginia, George A. Shipman, Carl M. Frasure

West Virginia Law Review

The National Commission on Law Observance and Enforcement, generally known as the Wickersham Commission, is popularly associated with prohibition, as critic, protagonist, propagandist, or apologist, depending upon the point of view. The more fundamental aspects of its work have escaped popular attention. The first two reports dealt with the problem of national prohibition. Twelve more were devoted to other phases of crime and its treatment. Here attention is to be devoted to the Report on the Cost of Crime in an effort to determine the economic burden through taxation, private expenditures, and economic loss which results from the necessity of …
