Can Gender Equity Find A Place In Commercialized College Sports?, John C. Weistart

The premise of Title IX should be uncontroversial: no person may be ex- cluded from the benefits of an educational program on the basis of gender. 1 There is a sense in which Title IX, at the time of its adoption more than twenty years ago, simply captured what was an independent societal norm of considerable force. Women were participating in higher education, including graduate and professional education, in increasing numbers and were properly claiming a right to equal opportunities. Merit, Ol' Boy Networks, And The Black-Bottomed Pyramid, Kenneth L. Shropshire

UC Law Journal

What will happen in this country when questions of merit no longer serve as barriers to the advancement of minorities, particularly African Americans, to top-level positions in American corporations and society? What will happen when merit questions are eliminated but minorities are still underrepresented in these powerful positions? Arguably, the critical issue for society then will be to determine why there remains an absence of minorities at the top. Further, if a society without merit differentiation develops and discrimination continues, should America's much-beleaguered affirmative action programs be asserted in a newly aggressive manner?

When Is A Corporate Executive "Substantially Unfit To Serve"?, Jayne W. Barnard

The recently enacted Securities Enforcement Remedies and Penny Stock Reform Act of 1990 provides that, in an SEC enforcement action, a federal court may enjoin or "disbar" the defendant from serving in the future as an officer or director of a public company. A court may enter such an order if it finds that the defendant is "substantially unfit" to serve as a corporate executive; the Act, however, does not define "substantial unfitness." In this Article Professor Jayne Barnard provides a framework for defining this term and identifying the defendants to which the Remedies Act should apply. Professor Barnard begins …
