Barriers To Leadership In Women's College Athletics, Erin E. Buzuvis Jan 2015

Barriers To Leadership In Women's College Athletics, Erin E. Buzuvis

Faculty Scholarship

Today there is an enormous gender disparity among collegiate head coaches and athletic administrators in the United States. Women fill less than a quarter of head coach and athletic director positions in college athletics and are even minorities among coaches of women's teams. Few other professions are as impervious to gender integration. Leadership in college athletics is, in the words of one scholar, one of the "few male bastions remaining," which raises the question: Why are women so starkly underrepresented in leadership positions within college athletics? There is no easy answer, but rather a variety of factors that exclude, deter, …

Loyola of Los Angeles Entertainment Law Review

In recent years, a host of issues have arisen between the National Collegiate Athletic Association (NCAA) and the college athletes who provide the labor from which the NCAA and its member universities derive their profits. Many of these issues have been heavily publicized and have spurred a heated debate over the status of college athletes and the future of the collegiate athletic system. This Article primarily focuses on the issue of college athletes’ status as employees for purposes of federal labor law. The significant increase in the popularity of college sports in recent years has led to conference realignment, facility …

I’M The One Making The Money, Now Where’S My Cut? Revisiting The Student-Athlete As An “Employee” Under The National Labor Relations Act, John J. Leppler Mar 2014

I’M The One Making The Money, Now Where’S My Cut? Revisiting The Student-Athlete As An “Employee” Under The National Labor Relations Act, John J. Leppler

Pace Intellectual Property, Sports & Entertainment Law Forum

This Article argues why the National Collegiate Athletic Association’s (NCAA) Big-Time Division I College Football and Men’s Basketball student-athletes are legally “employees” and why these student-athletes are inadequately compensated for their revenue-producing skills.

Part II of this Article sets forth the common law “right of control” test and the National Labor Relation Act’s (NLRA) special statutory test for students in a university setting, and shows how the National Labor Relations Board (NLRB) and the judiciary determine whether a particular person, specifically a university student, meets these standards and is legally an “employee”. Moreover, the NCAA asserts it does not have …

Educating Athletes Re-Envisioning The Student-Athlete Model, William W. Berry Iii Jan 2014

Educating Athletes Re-Envisioning The Student-Athlete Model, William W. Berry Iii

Tennessee Law Review

This article contends that if the NCAA and universities are serious about saving the current student-athlete model, then they should double-down on the concept of "student" in the student-athlete model. In particular, this paper suggests that adopting a more realistic approach to educating athletes will benefit both the universities and student-athletes, relieving pressure on the current model and improving educational outcomes.

Specifically, this article argues for a revised student-athlete model. First, the new model would require mandatory six-year scholarships for student-athletes and a reduction in the required academic hours "in-season" from nine to three. The model also mandates that students …

This Comment is the first in a series of publications on Brazil's efforts and, we hope, its successes in reducing corruption in the 2016 Olympic Games. It is written as part of a course at the University of Richmond School of Law entitled "Brazil, Corruption, and the 2016 Summer Olympics"-the co-authors are eight students and their pro- fessor. While the ultimate product will be a comprehensive analysis of the role of Brazilian law in controlling corruption, this Comment has a more modest purpose. It will discuss the various trends and forces that have converged on Brazil's hosting of the Games, …

Making The Right Call: Why Fairness Requires Independent Appeals In U.S. Professional Sports Leagues, Jeremy R. Abrams Jan 2013

Making The Right Call: Why Fairness Requires Independent Appeals In U.S. Professional Sports Leagues, Jeremy R. Abrams

Marquette Law Review

Historically, the commissioners of the U.S. professional sports league have had a duty to preserve the integrity of the leagues. Developing from this concept through collective bargaining between the leagues and players’ associations, the disciplinary systems of the leagues are designed to keep conflicts out of the U.S. courts. Recently, these systems have come under considerable public scrutiny questioning their fairness and effectiveness and, in some cases, the integrity of the commissioners and sports. Specifically, there have been issues with conflict of interest of the commissioners and arbitrary decision-making in disciplining players. This Comment explores the disciplinary systems of the …

League Structure & Stadium Rent Seeking - The Role Of Antitrust Revisited, David Haddock, Tonja Jacobi, Matthew Sag Jan 2013

League Structure & Stadium Rent Seeking - The Role Of Antitrust Revisited, David Haddock, Tonja Jacobi, Matthew Sag

Faculty Articles

Professional North American sporting teams receive enormous pub for new and renovated stadiums after threatening to depart their hometowns, or by actually moving elsewhere. In contrast, English sporting teams neither receive much public money for such projects, nor move towns. This Article argues that no inherent cultural or political transatlantic variations cause the differences; rather, it is the industrial organization of sports in the two countries-the structure of league control-that enables rent-seeking by American teams but not by their English counterparts. Cross-country time series data contrasting American professional football and baseball stadiums with English soccer grounds support our claim, as …

A Customer-Based Assessment Of Casino Atmospherics, Karl J. Mayer, Lesley Johnson Dec 2012

A Customer-Based Assessment Of Casino Atmospherics, Karl J. Mayer, Lesley Johnson

UNLV Gaming Research & Review Journal

This study investigates the elements of casino atmospherics from the perspective of slot machine players in a Las Vegas Strip casino. Guest responses to a survey instrument that was developed to measure the elements of casino atmosphere were collected and quantitatively analyzed. The results of this study suggest that the design elements of floor layout and theme may be most closely aligned with the concept of casino atmosphere from the perspective of a slot player. This outcome supports the gaming industry's long-standing emphasis on these two areas of casino design. The study also provides further insight about physical evidence in …
