American Philosophy Of Law, Clarence Emmett Manion Jan 1943

American Philosophy Of Law, Clarence Emmett Manion

Journal Articles

America’s philosophy of law is a rich heritage sculpted by the American Revolution. The bold aspirations of the Declaration of Independence, which advances notions of inalienable, God-given rights find more mild-mannered forms in our Constitution. However, this prevailing concept is what makes our legal and political environment distinct from our English forebears.

Quasi-Contracts - Recovery By Donor Of Charitable Relief From Paupers And Their Estates, James L. Mccrystal Aug 1942

Quasi-Contracts - Recovery By Donor Of Charitable Relief From Paupers And Their Estates, James L. Mccrystal

Michigan Law Review

The question whether or not a pauper or his estate assumes an obligation to reimburse the donor of charitable relief has been subject to many varied and inconsistent answers. Most of the cases in this field are not distinguishable on their facts, and hence the inability to reconcile them must be laid to the differences in the reasoning of the courts in their attempts to handle these cases more from a sociological approach than from a legal point of view. In discussing this problem it is desirable to place these cases in three principal classes: (1) where relief is given …

Judicial Sales - Right To Set Aside A Successful Bid, Michigan Law Review Jun 1942

Judicial Sales - Right To Set Aside A Successful Bid, Michigan Law Review

Michigan Law Review

At a public sale, the trustee in bankruptcy struck off to the plaintiff a bankrupt's assets for $16,850, a reasonable price. A referee vacated the sale when a private bidder offered $150 more and insured reopening of the bankrupt's mines and employment of its former employees. The sale was finally confirmed to the private bidder at a price only $50 in excess of the final offer made by the highest bidder at the public auction. Plaintiff appealed to the court to review the referee's order. Held, although the courts do not generally approve of vacating a fair public sale …

Law School Catalogues

A Law School was first established in Richmond College in 1870. In 1890 the family of the late Mr. T. C. Williams, who had been a devoted and useful trustee, donated $25,000 as the nucleus of an endowment for the Law School. In recognition of this gift, the name of the School was changed to the T. C. WILLIAMS SCHOOL OF LAW. At various times the School has received further generous gifts from members of the family of Mr. Williams. The largest of these gifts came through a bequest from Mr. T. C. Williams, Jr., who like his father, was …

Torts - Right Of Privacy - Economic Exploitation Of Name, Michigan Law Review

Michigan Law Review

Defendant, a department store, signed plaintiff's name without his knowledge or consent to a telegram which it caused to be sent to the governor of Oregon. The telegram urged the veto of a bill which, had it become law, would have prevented defendant from continuing the practice of optometry. Plaintiff brought suit to recover damages for the invasion of his right of privacy. Held, on appeal from the lower court's judgment sustaining defendant's demurrer, that the complaint stated a cause of action. Hinish v. Meier & Frank Co., (Ore. I94I) I I3 P. (2d) 438.
