Major Questions About Presidentialism: Untangling The “Chain Of Dependence” Across Administrative Law, Jodi L. Short, Jed Handelsman Shugerman
Major Questions About Presidentialism: Untangling The “Chain Of Dependence” Across Administrative Law, Jodi L. Short, Jed Handelsman Shugerman
Faculty Scholarship
A contradiction about the role of the president has emerged between the Roberts Court’s Article II jurisprudence and its Major Questions Doctrine jurisprudence. In its appointment and removal decisions, the Roberts Court claims that the president is the “most democratic and politically accountable official in Government” because the president is “directly accountable to the people through regular elections,” an audacious new interpretation of Article II; and it argues that tight presidential control of agency officials lends democratic legitimacy to the administrative state. We identify these twin arguments about the “directly accountable president” and the “chain of dependence” as the foundation …

The Problem Of Indonesian Contract Brides In China And Its Implications For Cross-Border Marriage, Liu Xiang Mei
International Review of Humanities Studies
The rise of Indonesian contract brides in China has become a major focus that requires urgent action to protect their rights and well-being. The initiative aims to prevent exploitation in the context of cross-border marriages and ensure that such marriages are conducted fairly and legally. This situation arises from a number of factors, including difficult economic conditions, unlicensed intermediary operations, and a strong desire to live more prosperously. It also deals with issues of commercial marriage, human trafficking, and marital fraud, which require a careful and coordinated approach. Therefore, China should take steps to renew the international marriage law, enhance …

The Manifestation Of Misogyny In The Pick Me Boy Trend On Tiktok Indonesia, Ying Wang, Mina Elfira
The Manifestation Of Misogyny In The Pick Me Boy Trend On Tiktok Indonesia, Ying Wang, Mina Elfira
International Review of Humanities Studies
Misogyny is hatred, contempt, or prejudice against women or girls. It is a form of sexism used to keep women in a lower social status than men, thereby maintaining patriarchal social roles. Hegemonic masculinity is the most exalted configuration of gender practices that legitimizes patriarchy. This article draws on the framework of Raewyn Connell's theory of masculinity and Kate Manne's concept of misogyny to discuss the phenomenon of Indonesian TikTok videos with the hashtag “Pick Me Boy” or #Pick Me Boy. Pick Me Boy challenge traditional masculinity to gain women's attention, and then demean women if rejected. This article uses …
Multimodality Of Japanese Backchannel In Beauty Vlog, Filia Filia Dr., Nilam Husna Muthia
Multimodality Of Japanese Backchannel In Beauty Vlog, Filia Filia Dr., Nilam Husna Muthia
International Review of Humanities Studies
A backchannel is generally known as a response in a conversation that serves as a sign that the interlocutor is paying attention. In conversation, verbal backchannel speech can simultaneously occur with nonverbal gestures. Backchannel in conversations in digital content is often found. Beauty content from Hiro Beauty Channel shows that backchannel in beauty vlogs often occurs through verbal and nonverbal . Previous studies have researched the behaviour of backchannel usage (Cutrone, 2011; Nurjaleka, 2019; Bodur et al., 2022; Ramadhani, 2023) and the behaviour of gazing gestures (Walker, 2010). However, there has yet to be research about the multimodality of backchannels …

Niger Delta uprising always evokes controversial positions viewed from a single perspective from the pages of print to electronic media with which many dramas and films on their themes clone some intertextual discourses as the absolute voice on the Niger Deltans’ problem. The major concern is usually the violence caused by the people of the Niger Delta to disrupt the peace of the Nigerian society without giving a second thought to the people’s complaint about the political which worsens the situations of the region. Using qualitative research methodology, framed on Mikhail Bakhtins’ theory of Dialogism as a suitable theoretical framework …
2020 Racial Justice Protests In Portland, Or: An Analysis Of Radical Place-Making And Police Tactics In A Neighborhood Context, Claire Brumbaugh-Smith
2020 Racial Justice Protests In Portland, Or: An Analysis Of Radical Place-Making And Police Tactics In A Neighborhood Context, Claire Brumbaugh-Smith
Dissertations and Theses
During the George Floyd protests, police used tactics infrequently seen until now, including the use of tear gas and sonic weapons in contested spaces. Police tactics are presumably sanctioned by policing directives, but little is known about how these tactics may vary across space at a granular spatial level, or how they might be normalized over time. To address this knowledge gap, I used the concept of repertoires of protest control to characterize and quantify the tactics of the Portland Police Bureau (PPB) deployed on racial justice protesters during the 2020 racial justice protests and describe the role of these …

In life, one is always faced with uncertain risks. In the case of the COVID-19 pandemic, a person traveling abroad for business or tourism purposes has the risk of being infected with COVID-19. One of the efforts that one can make to minimize the risk of being infected with the COVID-19 is to transfer the risk to the Insurer by registering with an Insurance Company to get a Travel Insurance. The COVID-19 International Travel Insurance provides a guarantee of protection to someone traveling internationally from the risk of being infected with the COVID-19 so that the trip becomes comfortable, safe, …

“He’S In Jail Now And I Don’T Feel Bad”: Analyzing Sureties’ Decisions To Report Bail Violations, Rachel Schumann, Carolyn Yule
International Journal on Responsibility
The control, supervision, and rehabilitation of criminalized people often falls on the shoulders of non-state agents and organizations. Surety bail releases are a clear embodiment of this trend, as the courts call upon relatives, friends, and employers to supervise the pre-conviction activity of people accused of a crime. According to the law, sureties must report all bail violations to the police; the resulting diffusion of responsibility is said to increase the penal state’s power and control over criminal justice-involved individuals while minimizing reputational risks. Yet how sureties carry out this role in the community remains unexplored. Using data from 36 …
So Many Roads, So Much At Stake: The Composition Of Faculty Bargaining Units, William A. Herbert, Joseph Van Der Naald
So Many Roads, So Much At Stake: The Composition Of Faculty Bargaining Units, William A. Herbert, Joseph Van Der Naald
Publications and Research
This book chapter from Contingent Faculty and the Remaking of Higher Education: A Labor History traces the history of faculty bargaining unit composition in higher education. It examines the evolution in higher education from wall-to-wall bargaining units to professional craft units of tenured, tenure-track, and contingent faculty to separate contingent faculty units. The chapter presents historical examples of bargaining units, starting with early CIO wall-to-wall units in the 1940s, and the facts, preferences, and legal doctrines that has resulted in faculty being placed in combined or separate bargaining under collective bargaining laws. It will also explore the conflicting and congruous …
International Borders: Yours, Mine, And Ours, Beth Simmons
International Borders: Yours, Mine, And Ours, Beth Simmons
University of Chicago Legal Forum
International borders have become divisive issues in international and domestic politics. They have also become sites where the human rights of vulnerable persons have increasingly been documented as at risk. Policies of border hardening in the face of growing human mobility and other external threats—real and imagined—have made international borders focal sites of conflict at many levels. This Article argues that international law can reframe our understanding of bordering, leading to a more constructive approach to border management and greater respect for human rights. Borders are essentially institutions with the potential to settle coordination problems over territory. But of growing …
Borders And Boundaries In Markets: A Sociocognitive Approach For Market Definition And Implications For Antitrust, Elizabeth G. Pontikes
Borders And Boundaries In Markets: A Sociocognitive Approach For Market Definition And Implications For Antitrust, Elizabeth G. Pontikes
University of Chicago Legal Forum
Categorical distinctions are foundational to firm competition and regulation. Yet, market categories are notoriously difficult to define. The question of how to delineate markets is well-worn in the antitrust literature but is now the focus of a growing sociocognitive literature in strategy and organizational sociology.1 Historically, there has been little cross-pollination between these research areas. More integration, however, may be increasingly important in modern markets, where change is rapid, new technologies are key differentiators in many traditional industries, and platform competition is on the rise. In this paper, I introduce recent theoretical and empirical advances in sociocognitive research on categories …

Deploying Trustworthy Ai In The Courtroom: Lessons From Examining Algorithm Bias In Redistricting Ai, Wendy K. Tam Cho, Bruce E. Cain
University of Chicago Legal Forum
Deploying trustworthy AI is an increasingly pressing and common concern. In a court of law, the challenges are exacerbated by the confluence of a general lack of expertise in the judiciary and the rapid speed of technological advancement. We discuss the obstacles to trustworthy AI in the courtroom through a discussion that focuses on the legal landscape surrounding electoral redistricting. We focus on two particular issues, data bias and a lack of domain knowledge, and discuss how they may lead to problematic legal decisions. We conclude with a discussion of the separate but complementary roles of technology and human deliberation. …
The Gravity Of Legal Diffusion, Anu Bradford, Adam Chilton, Katerina Linos
The Gravity Of Legal Diffusion, Anu Bradford, Adam Chilton, Katerina Linos
University of Chicago Legal Forum
A persistent empirical finding is that bilateral trade between two countries is proportional to the size of their economies and inversely proportional to their geographic distance. We hypothesize that a similar pattern is likely to hold for the diffusion of laws. We specifically argue that countries’ propensity to update their laws to converge with the leading regulator in a given policy area is likely to be proportional to the size of their economies and inversely proportional to their geographic distance. We then empirically test this theory in the area of antitrust and assess countries’ convergence to the world’s leading antitrust …
The Unwritten Norms Of Civil Procedure, Diego A. Zambrano
The Unwritten Norms Of Civil Procedure, Diego A. Zambrano
Northwestern University Law Review
The rules of civil procedure depend on norms and conventions that control their application. Civil procedure is a famously rule-based field centered on textual commands in the form of the Federal Rules of Civil Procedure (FRCP). There are over eighty rules, hundreds of local judge-made rules, due process doctrines, and statutory rules, too. But written rules are overrated. Deep down, proceduralists know that the application of written rules hinges on broader norms that animate them, expand or constrain them, and even empower judges to ignore them. Unlike the FRCP and related doctrines, these procedural norms are unwritten, sociological, flexible, and …
The Social Clerisy: Conservative Political Philosophy As A Philosophy Of Pluralism And The Social Group, Luke C. Sheahan
The Social Clerisy: Conservative Political Philosophy As A Philosophy Of Pluralism And The Social Group, Luke C. Sheahan
The Journal of Contemporary Legal Issues
Conservative political philosophers should be counted among, as Nisbet writes, “those thinkers who have resisted the appeal of the One, the unitary and monistic, and have found not merely reality but freedom and justice and equity to lie in plurality.” They should take as their starting point Nisbet’s tradition of the plural community. Given our place in history, following the increasing alienation and decline of social groups chronicled by Putnam and others, conservatives should feel free to pillage the ideas of pluralist thinkers outside the conservative tradition. Nisbet admits repeatedly throughout the decades of his long career that there seems …
Global Criminal Justice Practices And Public Safety, Rachel Hwang
Global Criminal Justice Practices And Public Safety, Rachel Hwang
Posters-at-the-Capitol
Popular political discourse in the U.S. assumes that more funding for law enforcement and prison facilities will make civilians safer, presumably by reducing crime and sense of disorder. However, studies have shown that the relationship between these factors may not be as straightforward. With the killing of George Floyd and increased media coverage of police brutality, existing literature focuses mainly on the relationship between police and crime in the U.S. The impact of incarceration (the result of procedural justice) on the community (for whom procedural justice exists) is less known, especially on a global scale. We argue that cycling people …

Library Philosophy and Practice (e-journal)
Background: As technology continues to advance, individuals' interactions with digital platforms have become integral to daily life. Amidst this technological evolution, a novel concern emerges—Digital Phobia, hereafter referred to as “Digiphobia.” This phenomenon, although not previously explored in scholarly literature, necessitates an in-depth investigation due to its potential impact on individuals' well-being. Our research employs a two-step methodology to investigate its existence, implications, and manifestations.
Introduction: This research paper introduces and proposes the term "Digiphobia" as a comprehensive conceptualization of anxiety arising from interactions with digital spaces, applications, and environments. The proliferation of digital technologies has led to the emergence …

Rumpole And The Dissatisfied Client: Lessons On Justice From Four Case Studies In Client Objectives V. Lawyer Means, Thomas N. Bulleit, Esq.
St. Mary's Journal on Legal Malpractice & Ethics
Fictional barrister-at-law Horace Rumpole is a skillful, tenacious, and even fearsome courtroom advocate for his criminal defense clients. He cares deeply about winning. But Rumpole departs from the stereotypical heroes and antiheroes of fictional courtroom drama in that he typically complies fully with the ethical constraints on advocacy and the truth-finding process. When Rumpole does occasionally stumble, it is in the other direction: by losing track of his client, and presenting often unwanted truths to elevate victory above other needs or interests that the client considers just as, or sometimes much more, important than a favorable verdict.

Decentralizing The Nigerian Police Force: A Plausible Approach To Hinterland Securities, Amobi P. Chiamogu, Uchechukwu P. Chiamogu
Journal of African Conflicts and Peace Studies
The structure of the Nigerian police has overtime depicted a centralized composition that negate principles of power sharing in a federal system of government. The complexities and diverse nature of policing in Nigeria remains the bane to effective and virile administration and management of the organization. The office of the Commissioner of Police vis-à-vis those of State Governors spell contradictions in power configuration from both the Constitution and the Police Act. The enactment of vigilante services and neighbourhood watches by state governments are indicative of a failing security system especially at the component units of the Nigerian federation. The hinterlands …
