Communicative Administration: The Administrative State Beyond Legal Administration, Daniel E. Walters

On many dimensions, the administrative state is at the nadir of its power. The Supreme Court has tightened administrative law controls on agency power, and the Trump Administration has stormed the bureaucracy in an unprecedented blitz designed to kneecap agency capacity and independence. For better or worse, many agencies and their civil servants are being sidelined as meaningful actors in the administration of government. Yet this familiar account doesn’t tell the entire story. At the same time that agencies are being stripped of the power to implement law—what this Article calls “legal administration”— they are steadily accumulating extensive and largely …

Non-Reformist Reforms In Environmentalism: Legal Theory And Praxis, Nicholas F. Stump

This Article explores how non-reformist reforms—as opposed to traditional environmental law—are required for ecologically transformative futures. Traditional environmental law is a critically flawed regime due to its embeddedness in our current ecological political economy, which functionally requires perpetual accumulation and growth. However, this accumulation- and growth-based paradigm is incompatible with the material realities of our planetary boundaries. This paradigm has thus engendered our current era of profound ecological crisis (i.e., as associated with notions of the Anthropocene).

Making Noise Through Law: Indigenous Legal Mobilisation Against A Power Plant In “French” Guiana, Pierre Auzerau

In so-called “French” Guiana, or Guyane, the Kali’na village of Atopo Wipi has fought for years against a hydrogen power plant being built on their land. Drawing on ethnographic fieldwork conducted between 2023 and 2024 in Guyane and Western Europe, where I collaborated with various stakeholders to support Atopo Wipi’s resistance to the power plant, my research focuses on the legal dimensions of the Kali’na’s struggle to protect their land. Specifically, this article examines how the Kali’na navigated different normative frameworks, including international human rights standards and French law, to fight the project. Law reviews sit at the center of American legal scholarship, but their role is widely misunderstood. They are not peer-reviewed, yet the academy treats their placement decisions as markers of scholarly merit. This Essay argues that law reviews function as participants in a prestige economy—one in which reputation, familiarity, and institutional brand often matter more than substantive judgment. Tracing the student-edited model from its pedagogical origins to its modern professional consequences, this Essay shows how prestige became currency, how that currency shapes editorial and authorial behavior, and why the system strains under political and methodological pressure. More work on originalism would seem to be among the last things the world needs. Yet the author hope to add two things to the debate. The first is a suggestion that originalist practice and theorizing have fallen prey to the phenomenon of methodolatry. This refers to an excessive focus on refinement of method for its own sake and in a manner that loses sight of the goals the method is designed to serve and, more importantly, the tendencies and capacities of those who must implement it. Academic freedom faces an existential crisis. The Trump administration, building on a movement that began in the states, is seeking ideological conquest of higher education. Some universities have already surrendered. Others fight on, facing an endless barrage of assaults on their institutional autonomy. Faculty too have chosen to resist, relying on their free expression rights. One of the most potent weapons in higher education’s arsenal is the constitutional academic freedom doctrine, a First Amendment protection that safeguards faculty’s academic expression and universities’ academic judgments. How did unrecognised gender biases impact the codification of international humanitarian law (IHL)? While recent studies on IHL have highlighted historical lawmaking processes, little research has examined gender biases behind the codification of the “Protection of Women” in the Geneva Conventions and additional protocols. This study examines gender biases and state interests reflected in the codification process by focusing on Article 76§3 of the 1977 Protocol Additional I, which incompletely protects civilian women internees who are pregnant or have dependent children by prohibiting execution but leaving room for pronouncement of the death penalty. Confronting Inequality: Three Eras Of Gender And Tax Scholarship, Bridget J. Crawford

Tax law is not neutral—it encodes social values and reinforces certain longstanding hierarchies. For over fifty years, legal scholarship at the intersection of gender and tax has exposed how seemingly neutral tax laws perpetuate gender inequality. This Article uses the metaphor of quilting to trace the evolution of this scholarly field across three distinct eras.
Part I names and defines the designing era (1971–1986), which began with Grace Blumberg’s writing on the gendered impact of tax laws on marriage, labor, and caregiving; she framed taxation as a tool of social control over women. Blumberg’s work laid the foundation for other …

It has become common for Supreme Court Justices—the most powerful legal actors in our society—to explain why “the law” requires them to facilitate, or at least tolerate, terrible human suffering. Such claims are wrong, not just morally but legally. More specifically, they expose the decisions of the Roberts Court as a based on a jurisprudence of nihilism, one that justifies human suffering through vague appeals to the rule of law. These appeals, in turn, thinly conceal a substantive political and moral project.
To support this claim, I proceed in five parts. Part I introduces Albert Camus’s account of nihilism …

Summary: The territorial conflict over the Sahara is one of the most enduring territorial disputes in international relations, involving issues of sovereignty, self-determination, and regional stability. In this context, Morocco’s 2007 Autonomy Plan is presented as a negotiated framework of self-government under Moroccan sovereignty.
This article analyzes the evolution and consolidation of the Autonomy Plan using a conceptual approach based on self-determination, territorial governance, and conflict resolution theories. In recent years, Latin America has emerged as a central transit region for extracontinental migrants originating from Africa, Asia, and the Middle East who seek to reach North America through alternative routes. This thesis examines the Los Angeles Declaration on Migration and Protection, among other regional migration governance frameworks that have reshaped migratory flows, state responsibilities, and protection outcomes in the Western Hemisphere. Focusing on the Darién Gap as a strategic chokepoint, the study analyzes the effects of coordinated migration policies, border externalization, and differentiated state roles on extracontinental mobility.

A Qualitative Study Into The Impact Of Sweeps On Homeless-Serving Mutual Aid Groups In Portland, Or, Clover Javurek-Humig

Sweeps and land use enforcement are among the most persistent issues impacting unhoused communities. Mutual aid groups in Portland network with unhoused people regularly to mitigate the impacts of sweeps, provide direct aid, and build social capital among encampments. This study aims to understand the impact of policing and sweeps on mutual aid groups working with unhoused communities in Portland, OR. I conducted 18 interviews with mutual aid organizers and 8 months of fieldwork with mutual aid groups in Portland, OR in the years of 2025–2026. Dynamic Displacement: How Algorithmic Rent Pricing Threatens To Exacerbate Barriers To Housing Voucher Use And Mobility, James W. Matthews
Minnesota Journal of Law & Inequality
Tenant-based rental vouchers have long played a central role in efforts to expand affordability and economic mobility. Despite growing demand amid a deepening housing crisis, funding for federal rental assistance is under attack. Meanwhile, longstanding barriers, such as rising rents, source of income discrimination, and program design limitations, continue to restrict access to housing, especially in high-opportunity neighborhoods. These challenges are now compounded by the growing influence of private equity firms and other institutional investors, whose rapid acquisition of rental properties is reshaping the market by prioritizing extractive profits over affordability and tenant stability.
