A Critical View Of The Uniform Crime Reports, Sophia M. Robison Apr 1966

A Critical View Of The Uniform Crime Reports, Sophia M. Robison

Michigan Law Review

No one would deny that the FBI performs a vital function in investigating, identifying, and tracking down suspects who may endanger the life, liberty, and property of Americans. However, this writer feels that the Uniform Crime Reports published by the FBI should be subjected to a very critical analysis. Of primary concern are the indiscriminate acceptance of the official data by legislators and social science investigators and the doubtful inferences which a frightened public draws from news releases proclaiming that "the U.S. is sitting on a seething volcano of crime."

Two’S Company, John S. Bradway Apr 1966

Two’S Company, John S. Bradway

Duke Law Journal

This is an article which all lawyers should read. Its immediate concern is with legal services for the poor, but its thrust goes far beyond the immediate problem; indeed, its true emphasis concerns a fundamental evaluation of the legal profession and its place in our society. To state that it is thought-provoking is to give it little credit. The author is a man whose experience in the field spans almost half a century. The reader may disagree with the conclusions reached, but he must pay deference to the sincerity and sagacity of the views which it expresses.

The Legal Status Of The Educational Accrediting Agency, William A. Kaplin, J. Philip Hunter Jan 1966

The Legal Status Of The Educational Accrediting Agency, William A. Kaplin, J. Philip Hunter

Scholarly Articles

The educational accrediting agency is a powerful instrumentality in the United States-able, with minimal governmental interference, to set policies and standards in an area of vital concern to the public. As education becomes more complex, and as our society increasingly relies upon educational training and upon the standards by which that training is evaluated, the impact which the accrediting agency will have upon educational institutions and students enrolled in them will correspondingly increase. For all its influence, however, the accrediting agency occupies an ambiguous legal position. Therefore, in order to lay the framework for a more thorough understanding of the …

Judicial Intervention As A Psychiatric Therapy Tool, Eleanor A. Blackley Jan 1966

Judicial Intervention As A Psychiatric Therapy Tool, Eleanor A. Blackley

Cleveland State Law Review

Commitment to a mental institution by itself does not, in all states, suspend civil rights. The court psychiatric unit is an early outpost of a preventive, coordinative venture which gives, at long last, practical humane expression to protection of and consideration for the civil rights of the mentally ill adult involuntary patient whose condition obstructs his capacity to demand such safeguards himself. Persons suffering from mental disorders are frequently too disabled to claim their civil rights themselves.

The Interstate Child And Uniform Legislation: A Plea For Extra-Litigious Proceedings, Albert A. Ehrenzweig Nov 1965

The Interstate Child And Uniform Legislation: A Plea For Extra-Litigious Proceedings, Albert A. Ehrenzweig

Michigan Law Review

When I originally offered my re-interpretation of prevailing practice, I did not feel that it would be expedient to make suggestions for alternative solutions because I was then convinced that the courts were doing the very best they could with the procedural tools at their disposal and that there was little hope for an improvement of those tools. However, there is such hope now, and the time has come to help in the search for new answers. In the following discussion, I shall comment on two current proposals for uniform and federal legislation and shall attempt to formulate a tentative …

The Experience Of State Fair Employment Commissions: A Comparative Study, Arnold H. Sutin Jun 1965

The Experience Of State Fair Employment Commissions: A Comparative Study, Arnold H. Sutin

Vanderbilt Law Review

Passage of the new federal civil rights law in 1964 might have been expected to decrease the importance of the state fair employment practices (FEP) laws. Congress, however, chose not merely to permit these laws to continue in force to deal with purely local problems, but went further to entrust the primary administration of title VII, the federal fair employment statute, to state agencies where they exist. Thus the experience of these state agencies is of even greater importance now than formerly, for they will perform the day to day work of carrying out our nation's policy to prohibit discrimination in …

The Expanding Horizons Of Legal Services--I, Monrad G. Paulsen Apr 1965

The Expanding Horizons Of Legal Services--I, Monrad G. Paulsen

West Virginia Law Review

In no country of the world are lawyers so important or so influential as they are in America. Lawyers dominate legislative bodies almost everywhere in the United States; they often provide executive leadership for business enterprize and voluntary associations. The best lawyers are respected highly and rewarded with the greatest prizes. The theme of this paper is that the services offered by the legal profession, a profession already engaged in hundreds of tasks, are rapidly expanding. Some new ways of working are emerging. Some old functions are being performed in a new manner. More resources are being provided for that …
