Observations On The Insanity Defense And Involuntary Civil Commitment In Europe, John Q. La Fond Jan 1984

Observations On The Insanity Defense And Involuntary Civil Commitment In Europe, John Q. La Fond

Seattle University Law Review

There are several perspectives from which one could analyze the insanity defense and involuntary civil commitment in foreign legal systems. However, the comparative perspective on which this Essay is based focuses on: a) how foreign legal systems formulate and administer the insanity defense; b) how the power of the state is defined to civilly commit mentally ill persons; c) who makes the important decisions and when and how they are made; and d) what happens to offenders who are considered mentally ill and to others who are considered mentally ill and suitable for involuntary commitment.

Fairness In The Allocation Of Housing: Legal And Economic Perspectives, A. Wayne Mackay, Margaret Holgate Oct 1983

Fairness In The Allocation Of Housing: Legal And Economic Perspectives, A. Wayne Mackay, Margaret Holgate

Dalhousie Law Journal

Housing is an emotional, almost religious, topic. Indeed, even church groups have been active in promoting public housing in Canada and elsewhere.' The housing market has also become a battleground for a struggle between vested property interests and citizens' groups which insist upon a redefinition of the right to shelter. Organizations, such as the Toronto-based People's Housing Coalition, Halifax's Access Housing Services Association, and a host of tenants' unions, ensure that housing problems are not hidden from public scrutiny. Developers and landlord associations have risen to the challenge and, under the banner of free enterprise, they steadfastly resist any charges …

Directing The Development Of A University Centre Of Criminology, John Li. J. Edwards Oct 1983

Directing The Development Of A University Centre Of Criminology, John Li. J. Edwards

Dalhousie Law Journal

The original sod out of which the University of Toronto's Centre of Criminology grew was a proposal that I drew up while teaching a course in criminology as part of the LL.B. curriculum in the Faculty of Law at Dalhousie University in 1958-59.1 The proposal reviewed the extent of criminological teaching and research in Canada, and drew particular attention to the lack of implementation of the recommendations of the Fauteux Committee - a committee established in 1956 by the Canadian federal government to study the country's penal system and to make recommendations for change and improvement. 2 In its report, …

Case Law And Social Welfare: A Framework For Analysis, Jan L. Hagen Sep 1983

Case Law And Social Welfare: A Framework For Analysis, Jan L. Hagen

The Journal of Sociology & Social Welfare

This paper illustrates an approach for analyzing case law within the framework of social welfare programs and policies. Drawing on a framework first developed by Burns and later expanded by Gilbert and Specht, selected court decisions related to income maintenance are categorized on the basis of four parameters: basis of social allocation, the nature of social provisions, the structure of the delivery system, and the method of financing. Unlike the legal framework typically used to analyze court decisions, an assessment of court decisions along the parameters of social welfare policies and programs highlights the court's role and its importance in …

Legal Education In Saskatchewan: The Last Ten Years, Donald H. Clark Apr 1983

Legal Education In Saskatchewan: The Last Ten Years, Donald H. Clark

Dalhousie Law Journal

It may appear immodest to note how appropriate it is that the Dalhousie Law Journal should include Saskatchewan in this survey of recent trends in Canadian legal education. Yet from an historical standpoint, the ties between the respective universities have always been strong, and the influence of native Maritimers on the development of the College of Law in Saskatoon, as my colleague Howard McConnell (himself a New Brunswicker) observes in Prairie Justice, "can hardly be overestimated".' The University's first President, Walter Murray, brought west in 1909 one of his former students at Dalhousie, Arthur Moxon, destined to become the College …

Collaboration Between Lawyers And Mental Health Professionals: Making It Work, Donald N. Duquette Jan 1983

Collaboration Between Lawyers And Mental Health Professionals: Making It Work, Donald N. Duquette

Book Chapters

Many questions presented to the court in child welfare cases are resolved with the direction, professional advice, and judgment of mental health professionals. Lawyers and judges look to a number of different professions for this guidance; chief among them are psychiatrists, psychologists, and clinical social workers. The focus of this chapter is on ways for lawyers to enhance and improve the performance of the mental health professionals in the courtroom.

This chapter presents a step-b/step process for lawyer collaboration with mental health professionals in child protection and foster care cases, which is relevant for attorneys representing the child welfare agency, …

Contemporary Social Historical Perspectives On Mental Health Reform, Lawrence O. Gostin Jan 1983

Contemporary Social Historical Perspectives On Mental Health Reform, Lawrence O. Gostin

Georgetown Law Faculty Publications and Other Works

The argument presented in this article is that a new role has been developing in law which can and should be used as a strategy in the provision of services. It will be further argued that there is an important place for the law in setting limits on established psychiatric measures relating, for example, to compulsory admission and treatment, and even to particularly hazardous measures taken with the consent of the patient. The final role of law is to ensure the civil status of those who are the consumers of psychiatric services. One must accept the fact that pernicious legal …
