Two Contradictory Criticisms Of Clinical Education: Dilemmas And Directions In Lawyering Education, Carrie Menkel-Meadow
Two Contradictory Criticisms Of Clinical Education: Dilemmas And Directions In Lawyering Education, Carrie Menkel-Meadow
Antioch Law Journal
This article reviews what legal education is attempting to accomplish in teaching lawyering skills and where, from my perspective as a clinician, I think it has fallen short. I then offer some suggestions for what both clinicians and non-clinicians might do to further our efforts directed at truly educating lawyers. The two critiques I will offer of clinical education derive from two of clinical education's principal goals - teaching students how to "behave"as well as "think" like a lawyer (a behavorist goal), and teaching our students to think more broadly about the purpose of their roles as lawyers in the …
The Stages Of The Clinical Supervisory Relationship, Peter Toll Hoffman
The Stages Of The Clinical Supervisory Relationship, Peter Toll Hoffman
Antioch Law Journal
Clinical education is an established fact in legal education today, despite continuing battles in individual schools over the size and budget of the clinical curriculum and the status of clinical teachers.' Because of increasing pressure from students, the Bar, and faculty committed to the creation and maintenance of clinical courses, law schools have responded by labeling a widely diverse body of courses as falling under that heading. Many of these courses bear only scant resemblance to the service-oriented, live, poverty law clinics that were once the model for clinical programs.2 While no attempt will be made here to call for …

From False Paternalism To False Equality: Judicial Assaults On Feminist Community, Illinois 1869-1895, Frances Olsen

This essay will examine the "equal treatment" versus "special treatment" for women issue as it arose in Illinois in the late nineteenth century. In 1869 the Illinois Supreme Court barred Myra Bradwell from the practice of law on the basis that she was a married woman, and in 1870 it reaffirmed its exclusion of women in In re Bradwell, the state decision the United States Supreme Court upheld in Bradwell v. Illinois. This denial of equal treatment to women, especially the concurring opinion by United States Supreme Court Justice Bradley, appears to many to represent paternalism at its …

History:
The Law School was established as a department of Richmond College in 1870. In 1890 the family of the late T. C . Williams, who had been a devoted and valued Trustee, donated $25,000 as the nucleus of an endowment for the Law School. In recognition of this gift, the name of the School was changed to The T. C . Williams School of Law. At various times the School has received further generous gifts from members of the family of Mr. Williams. A substantial gift came through a bequest from Mr. T. C. Williams, Jr. who, like his …

The term "right" has a wide variety of connotations. On a very general level, it connotes a social commitment to the dignity and autonomy of the individual, an "affirmation of free human subjectivity against the constraints of group life." On a somewhat more specific level, one can distinguish procedural and substantive connotations. Procedural connotations concern official enforcement institutions. For example, in American legal culture, "right" often connotes judicial enforceability. Substantive connotations concern benefits or powers, such as freedom of speech or ownership of property, in civil society.
This essay is about the substantive connotations of the notion of "right" that …

Addressing Socio-Legal Problems: A Unifying Perspective For Social Workers, Raymond Albert
Addressing Socio-Legal Problems: A Unifying Perspective For Social Workers, Raymond Albert
The Journal of Sociology & Social Welfare
Problems where social work and the law overlap have consistently challenged social work professionals, and the challenges promise to continue. The overlap exposes important interdisciplinary issues, which are best addressed when certain conditions are met. The article describes these conditions within the context of a perspective that underlines the interaction between the two fields and structures the professional's approach to these interdisciplinary problems.
