Nonlawyers In The Business Of Law: Does The One Who Has The Gold Really Make The Rules?, Thomas R. Andrews Jan 1989

Nonlawyers In The Business Of Law: Does The One Who Has The Gold Really Make The Rules?, Thomas R. Andrews

Articles

For at least sixty years nonlawyers have been prohibited from offering their nonlegal talents in a business combination with lawyers practicing law. Moreover, when the ABA's new model rules were adopted in 1983, the ABA considered carefully but rejected a proposal that would have lifted the traditional ban on nonlawyer ownership of a law business. Nonetheless, the point of each article was that the relevant restrictions in the ethical rules are on their way out.

Commentators have given considerable attention to the unauthorized practice of law by nonlawyers, and to the offering of legal services by nonprofit institutions. The focus …

To Keep The Balance True: The Case Of Coy V. Iowa, Ellen Forman Jan 1989

To Keep The Balance True: The Case Of Coy V. Iowa, Ellen Forman

UC Law Journal

Recently, states have enacted legislation aimed at protecting child victims of sexual abuse from the trauma of testifying face to face with the accused. The United States Supreme Court considered the constitutionality of one such statute in Coy v. Iowa. In Coy, the trial court permitted the use of a one-way screening barrier between the accused and the complaining child witnesses. The Court found that the procedure violated Coy's sixth amendment right of confrontation and reversed the conviction.

The Court's opinion is subject to criticism on two grounds. First, the decision was inconsistent with prior confrontation clause cases. Second, the …

Nonlawyers In The Business Of Law: Does The One Who Has The Gold Really Make The Rules, Thomas R. Andrews

UC Law Journal

Rules prohibiting nonlawyers from holding ownership or managerial interests in law firms remain on the books in practically every jurisdiction in the United States. This Article examines the history of these restrictions and concludes that the rules cannot be justified as necessary to protect the consumer because less restrictive alternatives are available. Indeed, the rules seem to owe their surprising tenacity more to the fact that they serve the profession's economic self-interest than to any valid public purpose. This Article argues that there is a need and a demand for innovative business arrangements between lawyers and nonlawyers. Such arrangements would …

Educating Men And Women For Service Through Law: Osgoode Hall Law School 1963-1988, Mary Jane Mossman

Dalhousie Law Journal

My work... has assumed the shape of ... a spiral curriculum, circling around the same issues, though trying to keep them open-ended. This statement was penned by Northrop Frye in Spiritus Mundi in the context of reflections about creativity and literary criticism, but it aptly describes as well the intellectual ferment of writing about legal education in Canada during the past few decades. Indeed, Frye's suggestion that the above quotation "may be only a rationalization for not having budged an inch in eighteen years ' may similarly offer an important clue about the legal education debate in Canada and the …

Relations Between The Sexes: Timely Vs. Timeless Principles, Joel J. Kupperman Sep 1988

Relations Between The Sexes: Timely Vs. Timeless Principles, Joel J. Kupperman

San Diego Law Review

In this Article, Professor Kuperman examines the morality of affirmative action with a primary focus on affirmative action for women. He outlines what he feels is a convincing case for a philosophically opposed position: that affirmative action programs are justified. After discussing the criticisms leveled against affirmative action, the author concludes by suggesting that the strongest case for affirmative action rests on its relation to a just society. The relation is that affirmative action should lead to a just society.

The Law: From A Profession To A Business, Norman Bowie May 1988

The Law: From A Profession To A Business, Norman Bowie

Vanderbilt Law Review

The public believes that the practice of law has become a business. They also believe that lawyers are in the profession for the money and that everything a law firm does is motivated by greed-well not every-hing, in L.A. Law lawyers are motivated by greed and lust. Allegedly, lawyers overcharge, create work, and delay in order to make more money. In return lawyers produce nothing useful; they do not make cars, steel, or heavy machinery. They are perceived by many as social parasites who make a handsome living off the productive labor of others. Economists note that the United States' workforce has …
