The editors responsible for today's symposium have posed an alarming question: whether we are witnessing the demise of the First Amendment. I want to dispel at the outset any anxiety the question may have aroused. The First Amendment is alive and well; indeed, it is thriving. I believe, though I cannot prove, that public respect for the values it expresses has never been greater than it has been in recent years. Whether or not I am correct in that belief, however, it is certain that constitutional protections against governmental efforts to limit speech and other forms of expressive activity are …

Protecting Women's Welfare In The Face Of Violence, Martha F. Davis, Susan J. Kraham
Protecting Women's Welfare In The Face Of Violence, Martha F. Davis, Susan J. Kraham
Fordham Urban Law Journal
This article argues that the Aid to Families With Dependent Children program provides a valuable means of continuing support for impoverished women. It points out that such women are at an increased risk of domestic violence, and that they are often unable to escape from abusive relationships because they and their children are economically dependent on their partners. The article criticizes proposed reforms to AFDC from this context, arguing that without the safety net provided by public assistance, many women and children would be trapped by financial constraints in dangerous or life threatening relationships. Thus, an adequate level of public …

The article argues that the legal and psychiatric systems collaboratively categorize women who offend as either "mad" or "bad," failing to address underlying social issues. It examines how these systems pathologize women's behavior, using examples like pre-menstrual syndrome (PMS) and battered women's syndrome (BWS) as legal defenses, which often reinforce harmful stereotypes rather than providing meaningful solutions.

Redefining The Transracial Adoption Controversy, Ruth-Arlene W. Howe
Redefining The Transracial Adoption Controversy, Ruth-Arlene W. Howe
Duke Journal of Gender Law & Policy
I. Introduction Transracial adoption is a sensitive topic, evoking acrimonious debate "between those who view transracial placements as positive for both the children and society as a whole and those who view them as injurious to Black children and Black communities." 1 Efforts to declare race-matching preference policies or statutory schemes unconstitutional are intensifying. 2 Some legal writers assert that such a prohibition is needed in order to avoid or minimize harm to Black 3 youngsters in the foster care system. 4 In a re cent law review article analyzing the same-race statutory preference schemes of three states, the commentator …

Reclaiming Self-Determination: A Call For Intraracial Adoption, Jacinda T. Townsend
Duke Journal of Gender Law & Policy
The wholesale marketing of Black children to suit the economic interests of others was one of the cruelest aspects of slavery. Sons and daughters who were traded away from their parents would later struggle in vain to remember their families, their customs, and their countries of origin. Even the extended families which evolved in the transient slave communities were continually fragmented as children and their caretakers were merchanted to different plantations according to the whims of White slavemasters. 1 Although due to quite different circumstances, today the Black community continues to lose its children. At present, government sponsored entities, 2 …

ADR is unique in being interdisciplinary and interprofessional. ADR neutrals perform in a distinctive role and not as members of their own profession. The ADR process demands adherence to policies like voluntariness, respect for party autonomy, and confidentiality, which, in turn, make special ethical demands on ADR neutrals. Thus there are compelling reasons to contemplate an interdisciplinary code of conduct that addresses the professional duties and obligations of ADR neutrals. Standards of conduct for ADR has been a much discussed and debated topic over the past decade, both as to source and content. The two principal sources of standards have …
